THE ATTORNEY-CLIENT RELATIONSHIP: A JEWISH LAW PERSPECTIVE STEVEN H. RESNICOFF* Professors Thomas L. Shaffer and Robert F. Cochran, Jr., describe four models for approaching moral choices in the attor- ney-client context.1 These paradigms portray the practitioner as (1) godfather, (2) hired gun, (3) guru, or (4) friend. They prin- cipally differ as to the extent to which the attorney, rather than the client, controls the relationship and the degree to which the interests of persons other than the 2 client are considered important. As godfather, the lawyer perceives the client's narrowly defined interests as paramount and does "whatever it takes," irre- spective of the impact on others, to promote such interests. The godfather attorney pursues this path without even consulting the client concerning ethical qualms. The hired gun approach simi- larly accepts the client's interests as the sole barometer of suc- cess. -

Printing, Hebrew Book Culture and Sefer Ḥasidim Joseph A. Skloot All rights reserved ABSTRACT Printing, Hebrew Book Culture and Sefer Ḥasidim Joseph A. Skloot This dissertation is a contribution to the fields of the history of the Hebrew book and ear- ly modern Jewish cultural history. It is a study of Sefer Ḥasidim, a text that originated in the me- dieval Rhineland, in its first two printed editions (of 1538 and 1581, respectively). By analyzing these editions closely, and by comparing them to their manuscript antecedents, it is possible to determine how the work of printing changed Sefer Ḥasidim and how printing shaped readers’ understanding of the text. These investigations advance the argument that the printing of Hebrew books was a creative act, not merely a process of reproduction and dissemination. Like all cre- ative productions, moreover, these editions can be read as witnesses to the particular social and cultural contexts from which they emerged—in this case, a period of upheaval in Jewish life and European society. Moreover, the varied cast of characters who produced these editions—printers, editors, proofreaders, press workers, among others—were influenced by commercial, intellectual and religious interests unique to the sixteenth century and to Italy. These interests left their mark on the texts of Sefer Ḥasidim that emerged from their presses (in the form of censorship and emendations), as well as their associated paratexts (e.g. -

Abortion of the Diseased Fetus in Jewish Law Ari Berger INTRODUCTION The legalization of abortion seized a prominent position among the many social upheavals of the 1970s, carrying with it a plethora of questions for ethical debate. Although superficially boiled down to a question of pro-choice versus pro-life, the modern question of abortion is multifaceted and multidisciplinary. While the debate of abortion-on-demand centers around an analysis of a woman’s ma- ternal rights over her body versus fetal rights and fetal status, the full scope of pregnancy termination includes questions of fetal qual- ity of life, fetal life expectancy, psychological impact on mother, child, and family, as well as risks to the mother. Abortion is unique amongst the many social revolutions of the later twentieth century in that it remains a hotly debated topic with unusually strong political import and medical attention. Historically, the treatment of abortion in Halacha was sparse in comparison to the myriad of works and treatises addressing other ar- eas of Torah law, for the simple reason that abortion rarely present- ed as a question of practical significance requiring conclusive analy- sis—until the modern era, that is.1 With the abortion debate flung across America, prominent rabbis and Jewish educators scrambled to enlighten the Jewish community with the halachic perspective on abortion, lest the masses draw their own conclusions based solely on 1 Dr. Abraham Steinberg, trans. Yair Hayyim ben Moses Samson Bacharach (1638-1702) is well-known for his knowledge of halakha and Kabbalah. Over the course of his lifetime, he served as the rabbi in several locations in the Holy Roman Empire. In these two responsa, Bacharach deals with one of the halakhic problems surrounding women’s trade with non-Jews. Such trade inevitably caused women to enter into seclusion (yihud) with non-Jews, especially since according to Jewish law, the presence of the non-Jew’s wife did not alleviate the prohibition of seclusion with a non-Jew. The Revival of Mishnah Study in the Early Modern Period Abstract Upon its completion in the sixth century C.E., the Gemara, the rabbinic commentary to the Mishnah, the authoritative corpus of Jewish law, became the primary focus of Jewish study and intellectual effort while the Mishnah itself was largely neglected. Gemara-centric scholarship prevailed through the Gaonic and medieval eras; indeed, it was not until the mid-sixteenth century that the Mishnah regained a place of prominence amid the vast array of Jewish literature. In this paper, we explore first the oler and status that the Mishnah occupied among rabbinic scholars before the sixteenth century. We then present evidence of, and reasons for, the Mishnah’s tremendous revival in two geographically and culturally distinct Jewish communities in the mid-sixteenth century. Finally, we look at the aftermath of this revival, explore the convergence between the two traditions, and discuss the enduring effects of the revival on the study of Mishnah in the centuries that followed. -

With the Egyptians on one side and a large body of water on the other, B’nei Yisrael were in a state of despair. Moshe Rabeinu threw up his arms in prayer, prima facie the classic Jewish response. Sur- prisingly, however, the Talmud tells us that Hashem was not pleased, “Yedidi tov’im bayam v’atah ma’arich bitfilah—My beloved are drowning at the sea, and you are supplicating with lengthy prayer.” Although somewhat astonishing at first blush, the Talmud’s descrip- tion of Hashem’s response highlights a crucial and critical lesson: Although something may seem insurmountable and unachievable, it may not be. -
