RESUME OF WORK TRANSACTED BY THE TAMIL NADU LEGISLATIVE ASSEMBLY FROM 27TH TO 29TH JANUARY 1969 AND FROM 21ST FEBRUARY TO 31ST MARCH 1969 ------

PROROGATION

The Fourth Session of the Tamil Nadu Legislative Assembly was prorogued with effect from 28th December 1968.

The Fifth Session of the Fourth Tamil Nadu Legislative Assembly which was summoned to meet on 25th January 1969 was adjourned sine die on the 29th January 1969 in view of the grave illness of the Hon. Chief Minister late Dr. C.N. ANNADURAI, and again commenced on 21st February and adjourned sine die on 31st March 1969.

SITTINGS OF THE ASSEMBLY

The Legislative Assembly met for 33 days during the period from 27th to 29th January and 21st February to 31st March 1969 and in terms of hours it sat for 170 hrs. and 11 minutes.

RESIGNATION OF OFFICE OF DEPUTY SPEAKER

Under Clause (b) of Article 179 of the Constitution of , Pulavar K. Govindan resigned his office as Deputy Speaker of the Legislative Assembly with effect from the afternoon of 21st February 1969.

ELECTION OF SPEAKER AND DEPUTY SPEAKER

As both the offices of Speaker and Deputy Speaker were vacant, the Governor appointed Thiru K.R.Nallasivam, Member, Legislative Assembly representing Modakkurichi Constituency, as the Speaker Pro Tem to conduct the election of Speaker.

On the 22nd February 1969, the Speaker Pro Tem read out to the Assembly the names of members who had been validly nominated for the office of Speaker together with those of their proposers and seconders:-

As Pulavar K. Govindan was the only member validly nominated as a candidate for election as Speaker, Pro Term declared Pulavar K. Govindan as having been unanimously elected as Speaker.

On the 20th February 1969 the Hon. Speaker announced that Thiru G.R. Edmund Fernando was the only member validly nominated as a candidate for election as Deputy Speaker of the Legislative Assembly and declared that Thiru G.R. Edmund Fernando had therefore been unanimously elected as Deputy Speaker.

CONDOLENCE RESOLUTION

On the 21st February 1969, Hon. Thiru M. Karunanidhi, Leader of the House moved the following Condolence Resolution and the same was adopted unanimously.

“This House records with deep regret its profound grief on the sad and sudden demise for our revered and beloved late Chief Minister Dr. C.N. ANNADURAI on the 3rd February 1969, the unique and great Leader of Tamil Nadu, the elder brother of the Tamils, the sentinel of the Tamil Language, the matchless orator and forceful writer in Tamil with a unique style of his own evolved by him, the classical example of the pattern of ideal life propounded by Thiruvalluvar, the embodiment of Tamil culture, the true democrat who embodied in his life his own triple code of conduct. Namely, ‘Duty, Dignity and Discipline’ and worked for the integrity and solidarity of the Nation, the staunch worker for the uplift of the Tamil Language and the Tamils, more particularly the poor and the down-trodden and a selfless and dedicated public worker till the last breath of his life.

This House conveys its deep and heartfelt condolences to his noble spouse Thirumathi Rani Annadurai and the members of his family in their sad bereavement”.

The members stood in silence for a minute as a mark of respect and by way of paying homage to the departed soul. As a mark of respect to the memory of the late Chief Minister the House adjourned for that day.

OBITUARY REFERENCES

On the 27th January 1969, the Hon. Deputy Speaker announced to the House the demise of the following persons on the dates noted against each:-

On 24th February1969, the Hon Speaker announced to the House the demise of Thiru K.R. Viswanathan, former member of the Assembly, in August 1968.

On 27th March 1969, the Hon. Speaker announced to the House the demise of Thiru S. Chinniyan, a former of the Assembly, on 21st March 1969.

The members stood in silence for a minute as a mark of respect to the deceased.

1. On 28th January 1969, the Hon. Thiru K.A. Mathialagan, Minister for Food made a statement correcting the answer given by him to a supplementary question put by Thiru K. Vinayakam under question No. 112 on 23rd August 1968.

2. On 29th January 1969, the Hon. Thiru M. Karunanidhi, Minister for Public Works made a statement correcting the answer to a supplementary question put by Thiru N. Kasiraman to question No. 214 put by Thiru G. Gomathisankara Dikshidar, answered on 31st August 1968.

FINANCIAL BUSINESS

(i) The Demands for Grants for Excess Expenditure for the year 1964-65 was presented to the Legislative Assembly by Hon. Thiru K.A. Mathialagan, Minister for Finance, on the 24th February 1969 and the grants were made on the 26th February 1969.

The Appropriation Bill relating to the Demands for Grants for Excess Expenditure for the year 1964-65 was introduced in the Assembly on 26th February 1969 and was considered and passed on the 28th February 1969.

(ii) The Second Supplementary Statement of Expenditure for the year 1968-69 was presented to the Legislative Assembly by Hon. Thiru K.A. Mathialagan, Minister for Finance on the 24th February 1969 and it was discussed and voted on the 26th February 1969.

The Appropriation Bill relating to the Second Supplementary Statement of Expenditure for the year 1968-69 was introduced in the Assembly on 26th February 1969 and was considered and passed on the 28th February 1969.

(iii) The Budget for the year 1969-70 was presented to the Legislative Assembly by Hon. Thiru K.A. Mathialagan, Minister for Finance on the Ist March, 1969. The general discussion on the Budget took place for six days from 3rd to 8th March 1969. The Hon. Minister for Finance replied to the debate on 8th March 1969. Voting on Demands for Grants lasted for fourteen days, namely 10th,11th,12th,13th 14th,15th,17th,18th,20th,21st,22nd, 24th,25th, and 26th March 1969.

Of the 1,759 cut motions 179 cut motions were moved and they were either put and lost or, by leave of the House, withdrawn.

The Appropriation Bill in regard to the Budget for 1969-70 was introduced in the Assembly on 26th March 1969 and it was considered and passed on 28th March 1969.

The Tamil Nadu Agricultural Lands Record of Tenancy Rights Bill, 1969 (L.A. Bill No.18 of 1968).

On the 22nd March 1969, the Hon. Thiru K.A. Mathialagan, Minister for Finance moved that the following amendment made by the Legislative Council inrespect of the a bill as passed by the Legislative Assembly.

CLAUSE 3

In Sub-clause (2) of Clause 3 delete the word ‘and’ after item(2), Re-number item (e) as item(f) and before item(f) so renumbered, add the following as item(e):-

“(e) the survey number of sub-division number, the extent and local name, if any, of the land cultivated by the owner; and”.

The amendment was put to the vote of the House and declared lost.

GOVERNORS ADDRESS

Sardar Ujjal Singh, Governor of Madras, addressed the members of both the Houses of the Legislative assembled together in the Legislative Assembly Chamber, Fort St.George, Madras at 11 a.m. on Saturday, the 25th January 1969. The discussion on the Motion of Thanks to the Governor’s Address took place in the Assembly for six days on 27th,28th,29th January 1969, 22nd,24th and 25th February 1969. Sixty-two Members took part in the discussion. The Hon. Chief Minister replied to the debate.

Thiru Aladi Aruna moved the Motion of Thanks to the Governor’s Address and Thiru S. Murugaian seconded. Seven amendments were moved to the Motion of Thanks and they were by leave of the House withdrawn. The Motion of Thanks was adopted.

GOVERNMENT RESOLUTIONS

(1) On 28th February 1969, Hon. Thiru A. Govindasamy, Minister for Food and Agriculture moved the following resolution and the same was put and carried.

‘That the following draft of a Notification to be issued by the State Government under section 7 of the Cotton Transport Act, 1923 (Central Act III of 1923), amending the Notification issued under the said section, be approved as required by section.8 of the said Act.

DRAFT NOTIFICATION.

In exercise of the powers conferred by section 7 of the Cotton Transport Act,1923 (Central Act III of 1923) the Governor of Tamil Nadu hereby makes the following amendments to the preamble to the Notification S.R.O. No.A-769 of 1968, dated the 8th 27

October, 1968 published at pages 899-902 of the Rules supplement to Part I of the Fort St. George Gazette, dated the 25th December 1968 the same having been approved by resolutions of the Legislature as required by section 8 of the said Act.

AMENDMENT

In a preamble to the said notification, the following paragraph shall be added, namel;y:-

“2 The amendments hereby made shall come into force on the Ist February 1969”.

(1) On 28th March 1969, Hon. Thiru M. Karunanidhi, Chief Minister moved the following resolution:-

“That this House recommends to the Legislative Council that they do nominate five members of the Council to associate with the Committee on Estimates of this House for the year 1969-70 and communicate to this House the names of the members so nominated”.

The resolution was put and carried.

(3) On 28th March 1969, Hon. Thiru Si.PA. Aditanar, Minister for Co-operation moved the following resolution and the same was put and carried.

“That the following draft of rules to be issued by the State Government under sub- section (I) of section 17 of the Madras Motor Vehicles Taxation Act,1931 (Madras Act III of 1931), amending Schedules II and III to the said Act, be approved as required by sub-section (3) of the said section.

DRAFT RULES

In exercise of the powers conferred by sub-section (i) of section 17 of the Madras Motor Vehicles Taxation Act, 1931 (Madras Act III of 1931), the Governor of Tamil Nadu hereby makes the following amendments to Schedule II and III to the said Act.

AMENDMENTS

(I) In the said Schedule II, for the entries in columns (2) and (3) against item 4(iv) in column (I), the following entries shall respectively be substituted, namely:-

“50.00 75”;

(2) In the said Schedule III, for the entries in columns (2) to (5) against item 4 (d) in column (I), the following entries shall respectively be substituted, namely:-

“6.00 18.00 9.00 27.00”

EXPLANATORY NOTE

The tax payable under the Madras Motor Vehicles Taxation Act, 1931 in respect of omnibuses namely, vehicles permitted to ply solely as contract carriages (not being stage carriages plying as contract carriages) and to carry more than five persons (other than the driver) is Rs. 30 per seat per quarter. With a view to avoiding unhealthy competition between omnibuses and regular stage carriage, it is proposed to increase the tax for the omnibuses to Rs. 50 per seat per quarter so as to be on par with the rate of tax for stage carriages”.

(4) On 31st March 1969, Hon. Thiru M. Karunanidhi, Chief Minister moved the following resolution:-

“As a result of the failure of monsoon in 1968, the economic situation in entire Tamil Nadu has deteriorated,. The people are undergoing sufferings in several ways, the food production has been adversely affected and the people have to face a very critical situation. The Tamil Nadu Government are taking measures to afford relief to the people affected by the drought conditions. This House applauds with gratitude the sympathetic consideration shown and steps taken by the Hon. The Prime Minister Thirumathi Indira Gandhi, Hon, the Deputy Prime Minister Thiru Moraji Desai and Hon. The Food Minister Thiru Jagjivan Ram in deference to the appeal made by the State Government to afford immediate relief and help;

This House expresses its gratitude to the Centre for having deputed a Central Team and to the Prime Minister for having agreed to tour certain parts of the drought affected areas as desired by the Tamil Nadu Government:

This House recommends to theTamil Nadu Government to impress on the Central Government to supply immediately along with the first instalment of one lakh tones of rice requested for, another instalment of 2 lakhs tones of rice, as it is feared that drought condition will extend to the other areas in this State and as it is expected that the situation will become explosive with problems such as food scarcity, water scarcity and unemployment cropping up in a dangerous form;

This House recommends to the Tamil Nadu Governement to request the Central Government to sanction immediately the amount requested for by the State Government as also additional amounts that may be required in the shape of grants so as to afford relief to the drought affected areas where the situation is worsening day by day”.

Amendments to above resolutions were moved by Thiru K.Ramamoorthi, Thiru.V.K. Kothandaraman and Dr. H.V. Hande and the same were, by leave of the House, withdrawn.

The resolution was passed unanimously.

GOVERNMENT MOTIONS

(1) Hon. Thiru K. A. Mathialagan, Minister for Finance moved the following motion on the 28th February 1969:-

“That the following amendment to the Madras Land Reforms (Disposal of Surplus Land) Rules, 1965, published with Revenue Department Notification S.R.O. No.A- 1240 of 29

1965, dated the 25th November, 1965, at pages 1284-1296 of Part V of the Fort St.George Gazettee, dated the Ist December 1965, which it is proposed to make in exercise of the powers conferred by sub-section (I) of Section 94 of the Madras Land Reforms (Fixation of Ceiling on Land) Act, 1961 (Madras Act 58 of 1961) be approved under the proviso to the said sub-section.

DRAFT AMENDMENT

For sub-rule (3) of rule 6 of the said rules, the following sub-rule shall be substituted, namely:-

“(2)The value for the surplus land and for the buildings and trees thereon, if any, shall, at the optionof the assignee, be payable in a lump-sum or in equal annual instalments not exceeding twenty, with interest at the rate of five per centum per annum on the outstanding instalments:

Provided that the assignee shall be entitled to pay, at any time, any sum in excess of the annual instalments and such excess shall be adjusted towards the subsequent instalment or instalments.”

(3) Hon. Thiru K.A. Mathialagan, Minister for Finance moved the following motion on the 6th March 1969:-

“That with reference to Rule 183 of the Madras Legislative Assembly Rules this Assembly do proceed, on a date to be fixed by the Hon. The Speaker, to elect twelve members to be members of the Committee of Privileges for the Financial Year 1969-70”.

(4) Hon. Thiru K.A .Mathialagan, Minister for Finance moved the following motion on the 6th March 1969:-

“That with reference to Rule 221(1) of the Madras Legislative Assembly Rules this Assembly do proceed, on a date to be fixed by the Hon. The Speaker, to elect eleven members to be members of the House Committee for the financial year 1969-70”.

(i) Hon. Thiru M. Muthusamy, Minister for Local Administration moved the following motion on 17th March 1969:-

That the following draft of an amendment to clause (a) of sub-rule (I-A) of rule 8 of Schedule IV to the Madras District Municipalities Act, 1920 (Madras Act V of 1920) proposed to be made by the Governor of Tamil Nadu under sub-section (I) of section 305 of the said Act be approved.

CENSURE MOTION

On 27th January 1969, Hon. Deputy Speaker announced to the House that Thiru P.Jayaraj had given notice of the following motion disapproving the policy of the Ministry.

“This House censures and disapproves the policy of the Ministry in particular respect, namely, its failure to maintain law and order in Thanjavur District resulting in the ghastly incident of arson on 25th December 1968 in the village of Kilvenmani and the death of 42 innocent women, children and old men.”

The Deputy Speaker declared that leave of the House was granted to make the motion since more than twenty-four members stood up in support of the motion and that the date on which the motion would be taken up for discussion would be intimated in consultation with the Business Advisory Committee. In the meantime, as the new Ministry headed by Hon. Thiru M. Karunanidhi was formed, consequent on the demise of Hon. Chief Minister late Dr. C.N. Annadurai the above motion became infructuous.

On 25th February 1969, Hon. Speaker announced to the House of the fresh notice of the above motion given by the same member and requested those members who were in favour of leave being granted, to rise in their places. As more than the requisite number of members stood up, Hon. Speaker declared that the leave of the House was granted and that it will be taken up for consideration on 28th February 1969. The discussion on the above motion took place on 28th February 1969. Twelve members participated in the discussion, and Thiru P. Jayaraj replied to the debate. The motion of Thiru P. Jayaraj was put to vote and the House divided as follows:-

Ayes --- 36 Noes --- 125 Neutral --- Nil.

The motion was declared lost.

PRIVILEGE MATTERS

1. On 27th January 1969, the Hon. Deputy Speaker referred suo motu to the Committee of Privileges, a matter of privilege in regard to the interruption caused by Thiru A. Balasubramanyan by making a statement and staging a walk-out followed by a few members of a Opposition before the Governor rose to deliver his Address to the Joint Session of the Legislature on 25th January 1969.

2. On 6th March 1969, Hon. Speaker withheld his consent to Thiru K. Ramamoorthi to raise a privilege matter against the Hon. Minister for Co-operation with reference to certain statements made by him in regard to the Leader of the Opposition in the Assembly On 5th March 1969.

3. On 15th March 1969. Thiru N.S.V. Chithan raised a matter of privilege against the Tamil daily”Maravan Madal” for having published the expunged portionof the speech of Thiru R. Ramachandra Dorai. The Hon. Speaker announced that he would took into the matter and take necessary action against the daily. On 25th March 1969. Hon. 32

Speaker announced that in view of apology published by the Editor”Maravan Madal”, the matter be dropped.

4. On 24th March 1969, Thiru M.Chinnaswamy raised a matter of privilege against ‘Navasakthi’, a Tamil Daily for incorrect publication of the proceedings of the Assembly in its issue, dated 22nd March 1969. On 25th March 1969, Hon. Speaker announced to the House that the said paper had published a correction but had not expressed regret. He, therefore, announced that he would await publication of regret by the said daily and postponed the matter until next day.

5. On 24th March 1969, Thiru Kolathur Kothandam raised a matter of privilege against ‘Navamani’, a Tamil Daily for having published a garbled and perverted report of the Proceedings of the Assembly in its issue, dated 22nd March 1969. On 25th March 1969 Hon. Speaker announced to the House that in view of the corrections published by the said paper, further action be dropped.

6. On 24th March 1969, Thiru S. Ramachandran raised a matter of privilege against the Leader of Opposition for the alleged untrue statement made by him in the Assembly on 21st March 1969. On 25th March 1969 Hon. Speaker announced that in view of the explanation given by the Leader of the Opposition, there was no need to pursue the matter.

7. On 28th March 1969, Thiru G.R. Edmund, Chairman, Committee of Privileges presented the following reports of the Committee:-

(1) Case in regard to the alleged direct accusation made by Dr, H.V. Hande, M.L.A., against the Chair.

(2) Case in regard to the alleged incorrect statement made by late Thiru S. Balasubramanian, M.L.A. while he raised a privilege matter aginst the then Hon. Minister for Public Works.

(3) Interim reports on_

(i) Matter of privilege in regard to the alleged wrong and untrue statement attributed to the Hon. Speaker by the Hon. Speaker by the Hon. Member Thriu T. Martin.

(ii) Matter of privilege against the Editor and Publisher of the Tamil Daily ‘Kaditham’ in regard to the publication of certain passages in its issue, dated 27th August 1968.

(iii) Matter of privileges against the Hon. Member Thiru A. Balasubramanyan and others.

On a motion moved by the Chairman, Committee of privileges, the reports were considered and adopted by the House on the same day.

ELECTION TO THE SENATE OF THE ANNMALI UNIVERSITY

On 5th March 1969, Hon. Speaker announced to the House that (1) Thiru S. Ramachandran, (2) Thiru R. Govindarajan and (3) Thiru G. Bhuvarahan were declared duly elected to the Senate of the Annamalai University which was reconstituted with effect from 6th December 1968.

MISCELLANEOUS

(1) On 22nd February 1969, Hon. Speaker felicitated Thiru G. Gomathy Sankara Dikshidar, M.L.A. on the completion of his age of 81 years.

(2) On 13th March 1969, Hon. Speaker announced that action will be taken to constitute a Committee of a House to enquire into the correctness of the alleged statement by Thiru K.R.Gnanasambandan that Congressmen were responsible for the Kilvenmani incident.

(3) On 14th March 1969, Hon. Deputy Speaker announced that a Committee of the House would be constituted to go into the alleged statement made by Thiru M.C. Balan against Thiru K.Kamaraj and Thiru Sankara Reddiar. On 15th March 1969, the Hon. Speaker announced that in view of the availability and production of certain records now in support of the allegations made by Thiru M.C. Balan, the constitution of a Committee to go into the matter as announced by the Deputy Speaker on 14th March 1969, was not necessary.
