CIVIL JUDGE (SR.DN.) & CJM COURT, NIPPANI, BE DIRECTED TO BE RELEASED ON BAIL. : 5 : THESE PETITIONS COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING: ORDER These petitions arise out of the same offence of respondent-police, wherein the petitioners are the accused persons, who seeks anticipatory bail under Section 438 of Cr.P.C. to enlarge them on bail in the event of their arrest. 2. The substance of the complaint is that on 17/07/2018, M/s. Writer Safeguard Private Limited, : 6 : Belgavi Branch filed complaint against the petitioners alleging that M/s. Writer Safeguard Pvt. Ltd.,(WSG) provides banking support services like cash transportation, cash management, automated teller machine and bulk note acceptor servicing and cash replenishment. The company load or replenish the ATMs with currencies provided by the banks and report the same to the concerned banks on daily basis and the company deployed the petitioners/ accused as ATM operators. 4. This being the fact, on 21.06.2018 company noted shortage of Rs.8,67,900/- in ICICI Bank, Ashok Nagar, Nippani and Rs.4,63,800/- in Corporation Bank, ATM and it was accepted from them to load the currency into the ATMs. As per the version of the complainant, accused persons committed misappropriation of the amount in both the cases. : 7 : 5. When the discrepancy in respect of non- depositing of the currency note, the matter came to the knowledge of the company; and on being enquiry it is stated that the accused No.1 in both the cases pleaded that they would return the amount on or before 13.07.2018, but they did not. Thus the complaint came to be lodge in Nippani P.S.Crime No.129/2018 and Basaveshwar Chowk Nippani P.S.Crime No.67/2018. 6. Learned counsel for the petitioners submits that the cases wherein appellants are filed separately as per the tabular mentioned above to the effect that accused persons are innocent and they have not committed any offences, but they have been wrongly booked in the cases on the basis of the grounds which are false. 7. The learned HCGP submits that when the petitioners bear the liability as the amount was : 8 : handed over to them, then they are legally responsible to pay the amount. 8. The question herein is the faith particularly, bank entrusting the amount to be loaded/deposited in ATM. It is the question of confidence of the public in the banking system. In these circumstances, it was submitted that the accused persons are all young; and wrong allegations are made against them. The learned counsel for the petitioner/accused No.2 in Crl.P.No.101669/2018 would submit that it is accused No.1, who has under taken to settle the amount on or before 13.07.2018. 9. Regard being had to the fact that the date of incident is 21.06.2018, the amount involved is Rs.8,67,900/- in Crime No. 67/2018 and Rs.4,63,800/- in crime No.129/2018. It has to be noted that the quantum of amount is not the issue, more particularly when trust is reposed by the bank : 9 : or by agencies in the employees. It is not the question of undertaking to settling the amount, as such under taking does not absolve the offence. The investigation is said to be under progress, at the event the duty of the petitioners/accused to co- operate the investigation at this stage. 10. In the circumstances of the cases, petitioners in both the cases have not made ground for getting the benefit of anticipatory bail under these circumstances Criminal Petition Nos.101708/2018,101669/2018,101707/2018,1023 38/2018 are rejected and the petitioner in all the cases are directed to surrender before the concerned police station forthwith.
