    INTRODUCTION HAPTER C 1 Michael Cosser, Narnia Bohler-Muller & Gary Pienaar 1Introduction 1.1 Making the road by walking The Constitution of the Republic of South Africa, the final draft of which was forged over a two-year period between 1994 and 1996, assumed a particular profile in the body politic in 2016. Following the release of the Public Protector’s 2014 report on improvements to President Zuma’s Nkandla residence,1 the Constitutional Court in March 2016 declared binding her findings and recommendations about the need for the President to repay public monies spent on non-security upgrades to his residence.2 Such high-profile cases, however, can distract us from the importance of the Constitution in shaping the lives of ordinary people. In catapulting the Constitution into the limelight, the ‘Nkandla judgement’, as it is known colloquially, has created renewed interest in what meaning the Constitution has for South Africans in 2018 and beyond. The initial impetus for this book came from a public address by former Chief Justice Sandile Ngcobo. Chapter 5. The Performance of the Judiciary Linette Du Toit 5.1. Introduction The purpose of this chapter is to evaluate the performance of the Constitution in respect of the judiciary. In order to measure the performance of the Constitution in this regard, we have to consider the performance of the judiciary itself: whether it has been structurally and operationally transformed according to constitutional prescripts and whether it is fulfilling its constitutional purposes. While thin compliance with concrete goals are easily measurable, the achievement of these goals in a ‘thick’ sense, as well as abstract objectives are more complex and challenging to determine. We shall examine some of the problems of the design of judicial institutions in South Africa in the Constitution as well as the manner in which they have functioned in relation to key stress points which have arisen in the past 20 years. 5.2. Goals of the Constitution No feature of the South African state escaped the depredations of apartheid. The judiciary was no exception. On the one hand, the judiciary sought to cultivate an aura of independence and excellence.

D. Cornell University 2011 This dissertation examines the role of discourse and domestic structure in the diffusion of norms and the conditions under which the policy recommendations of transnational advocates transplant to the domestic law of a target state. In particular, it examines contemporary episodes of transnational pressure that either succeeded or failed to bring a country’s legal commitments more closely in line with the constitutive and regulative norms of international society. This research challenges mainstream international relations literature on the subject, which relies on either a rationalist logic of norm diffusion or the constructivist logic of norm localization. In addition, this work expands beyond sociological institutionalist literature that leaves largely unexamined the agency of domestic actors in the promotion and resistance of normative change. Instead, I explore the communicative interactions among transnational actors, domestic reformers, and domestic reactionaries (so-called “legal nationalist rebels”) to show that normative change is determined not only by coercion or emulation, but also by the discursive practices of these actors. Through a study of legal development in a civil law state—China—and common law state—South Africa—this dissertation demonstrates that transnational discourse can both create and block channels for the diffusion of ideas about best practices, legitimacy, and perceptions of policy problems.

Dennis, thank you so much for agreeing to participate in the Constitutional Court Oral History Project. DD Pleasure. Int The last time I interviewed you was in 2008 for the Legal Resources Centre Oral History Project and we didn’t manage to get a really extensive biography from you. DD Oh, okay. Int So I wondered whether we could talk about early childhood and how you think events in your life may have shaped your particularly social justice and legal trajectory? DD Oh, fine. I think they have, in a very profound way. Although it’s funny about that, you kind of only think about that later in life, you know. You look back and think things are…because I came from an unusual background for a Jew. Jew growing up in Cape Town in the 1950s into the sixties, most of the Jews, from this time of my age, would have grown up with parents who were either professional people, doctors, lawyers or accountants, or business people. My father was a motor mechanic, and my mother was a typist / secretary for a law firm. So if it is possible to describe them, I was one of Jewish working class; it was unusual in the kind of racist and stratified society of that period. And that did have a bearing on me in all sorts of ways. My parents, for some reason, which I never quite understood, after I’d gone to Kings Road School – which I think still exists…doesn’t exist I think, actually when I think about it – in Sea Point, they were going to send me to Christian Brothers College.
