O R D E R

1. Sri M. A. Rahman, Secunderabad-500003 has filed 2nd appeal dated 10-10-2017 which was received by this Commission on 10-10-2017 for not getting the information sought by him from the PIO-1 / O/o The Revenue Divisional Officer, Keesara Division, Medchal-Malkajgiri District, PIO-2/ O/o The Deputy Tahsildar, Shamirpet Mandal, Medchal-Malkajgiri District and 1st Appellate Authority / The District Revenue Officer, O/o The District Collector, Medchal-Malkajgiri District.

The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 28-01-2017 before the PIO requesting to furnish the information under Sec.6(1) of the RTI Act, 2005, on the following points mentioned in his application:

3. The Public Information Officer-2 / O/o The Deputy Tahsildar, Shamirpet Mandal, Medchal-Malkajgiri District has given reply to the appellant vide Memo. no. A/2227/2016, dated 07-09-2017.

4. Since the appellant did not receive the information from the Public Information Officer, he filed 1st appeal dated 31-07-2017 before the 1st Appellate Authority requesting him to furnish the information sought by him u/s 19(1) of the RTI Act, 2005.

5. The 1st Appellate Authority has transferred the application u/s 6(3) of the RTI Act to the Public Information Officer-1 / O/o The Revenue Divisional Officer, Keesara Division, Medchal-Malkajgiri District and Public Information Officer-2 / O/o The Deputy Tahsildar, Shamirpet Mandal, Medchal-Malkajgiri District vide letter no. A3/RTI/316/2017, dated 09-08-2017.

As the appellant did not get the information from the Public Information Officer / 1st Appellate Authority even after 30 days of filing his 1st appeal, he preferred this 2nd appeal before this Commission requesting to take action against the PIO and 1st Appellate Authority for not furnishing information sought by him and also to arrange to furnish the information sought by him u/s 19(3) of the RTI Act, 2005. The Appeal was taken on file and notices were issued to both the parties for hearing on 09-03-2018.

The case is called on 09-03-2018. The Appellant is present. The Public Information Officer is present.

The Appellant submitted that the sought information was not furnished.

The Public Information Officer submitted that they are not holding the sought information.

The Commission directed to issue notice to the RDO.

The case was adjourned to 04-01-2019.

On 04-01-2019 the case is called. The Appellant is present. The Public Information Officer-1 / Smt R. Subhashini, District Administrative Officer, O/o The Revenue Divisional Officer, Keesara Division, Medchal-Malkajgiri District is present. The Public Information Officer-2 / O/o The Tahsildar, Shamirpet Mandal, Medchal-Malkajgiri District is absent. The First Appellate Authority is absent.

The Appellant submitted that he sought certified copies of file in C. No. 2745/2015 and RDO File No. 2138/15, relating to a case pending before Lokayuktha. He also submitted that he has not received sought information so far.

The Public Information Officer submitted that the connected records are held up with erstwhile RDO Office, Malkajgiri, Medchal District that the record is not transferred to them after bifurcation of Keesara Division, that she is deputing a Senior Assistant of their office to get the record from the O/o The Revenue Divisional Officer, Malkajgiri and will provide required information to the appellant.

Neither the Public Information Officer nor the Appellant was in a position to state what exactly is the matter that is being investigated by the Lokayuktha and how the Appellant is concerned with the subject matter. It is not known whether section 11 of the RTI Act is applicable to the case and whether it is covered by any of the provisions of Sec. 8 of the RTI Act.

The Commission, therefore direct the Public Information Officer to examine the issue and furnish the sought information, in accordance with the provisions of the RTI Act, within one month from the date of receipt of this order.

With the above direction, the case is closed.
