Decizia Nr. 1034 Din 14.11.2019 Privind Somarea S.C. ELECTRON S.R.L. Lupeni, Com. Lupeni, Nr.112, Jud. Harghita CUI:498941 În Decizia nr. 1034 din 14.11.2019 privind somarea S.C. ELECTRON S.R.L. Lupeni, com. Lupeni, nr.112, jud. Harghita CUI:498941 Întrunit în şedinţă publică în ziua de 14 noiembrie 2019, Consiliul Naţional al Audiovizualului a analizat în sinteză rapoartele întocmite de Serviciul Inspecţie cu privire la respectarea prevederilor legale de către distribuitorii de servicii audiovizuale retransmise prin rețele de comunicații electronice. Distribuitorul de servicii S.C.ELECTRON S.R.L. deţine avizul de retransmisie nr. A1779.1/30.04.2009 pentru rețeaua de comunicații electronice cu adresa cap de rețea în Lupeni, județul Harghita. Analizând sinteza realizată în baza rapoartelor prezentate de Serviciul Inspecţie, membrii Consiliului au constatat că distribuitorul de servicii S.C. ELECTRON S.R.L. a încălcat prevederile art. 74 alin. (3) din Legea audiovizualului nr. 504/2002, cu modificările şi completările ulterioare. Potrivit dispozițiilor invocate: - art. 74 alin. (3) Distribuitorii de servicii pot modifica structura ofertei de servicii de programe retransmise numai cu acordul Consiliului. În fapt, în urma controlului efectuat de inspectorul teritorial al C.N.A., în data de 02.09.2019, în localitatea Lupeni, judeţul Harghita, a rezultat următoarea situaţie: “ ANALOGIC Sunt retransmise un nr. de 53 programe în sistem analogic DUNA TV, MINIMAX HU, PRO TV, VIASAT NATURE, M2, TV2, EUROSPORT1, RTL+, FISHING&HUNTING, FILM CAFE, KISS TV, SOROZAT +, LIFE NETWORK, PRO GOLD, EUROSPORT 2, TV5, OZONE NETWORK, TVR2, DIGI 24, M5, COOL TV, EURONEWS, FILM+, RTL KLUB, DISCOVERY CHANNEL, CBS REALITY, RTL II, ID, TVR3, TVR1, ATV, M1, PARAMOUNT CHANNEL, PROX, PRIMA, M4 , PRO2, ETV, GALAXY/4, TV/4, BONUM, ANIMAL PLANET, AXN, DISCOVERY SCIENCE, PRO CINEMA, VIASAT EXPLORER, RTL GOLD, REALITATEA, ROMÂNIA TV, DUNA WOLRD, NATIONAL TV, STORY 4, TVR TÂRGU MUREȘ. Prin comparație cu ultima ofertă de servicii de programe aprobată de C.N.A. la data de: 18.07.2019 - programe retransmise în reţea fără a fi înscrise în aviz (4) - 4 PROGRAME– (TV2, SOROZAT+, CBS REALITY, GALAXY/4) programe existente în Aviz, cu acorduri valabile, dar neretransmise în reţea la data controlului (30) 15 PROGRAME (MAGYAR SLAGER TV, ECHO TV, ARDEAL TV, TVR INTERNATIONAL, COMEDY CENTRAL, COMEDY CENTRAL 1 FAMILY, NICKELODEON, MEGAMAX, TLC, DTX, VIASAT HISTORY, DA VINCI LEARNING, ARCADIA TV, PAPRIKA TV HU, SZEKELY TV ) 15 PROGRAME MUST CARRY (NATIONAL 24 PLUS, NEPTUN TV, TV SUD EST, B1, NASUL TV,UTV, MUSIC CHANNEL, HIT MUSIC CHANNEL, FAVORIT, ORIZONT, INEDIT TV, TARAF TV, TRINITAS, SPERANTA, SUPER ONE) (...) Prin comparație cu ultima ofertă de servicii de programe aprobată de C.N.A. la data de: 18.07.2019 - programe retransmise în reţea fără a fi înscrise în aviz (15) - 15 PROGRAME – (EUROSPORT 1 HD, EUROSPORT 2 HD, FASHION TV, TV2, SOROZAT+, GALAXY/4, CBS REALITY, NICK.JR., SUPER TV2, AXN WHITE, AXN BLACK, MUZSIKA TV, CNN, ESTRADA, ETNO TV HD) programe existente în Aviz, cu acorduri valabile, dar neretransmise în reţea la data controlului (19) 8 PROGRAME (ECHO TV, ARDEAL TV, EURONEWS, PRO 2 HD, PRO X HD, ID, VIASAT NATURE, ARCADIA TV) 11 PROGRAME ”MUST CARRY” (NAȚIONAL 24 PLUS, NEPTUN TV, TV SUD EST, NASUL TV, MUSIC CHANNEL, FAVORIT TV, ORIZONT TV, INEDIT TV, TRINITAS TV, ALFA OMEGA, SUPER ONE )” Față de situația prezentată, membrii Consiliului au constatat că distribuitorul a retransmis servicii de programe fără a fi înscrise în oferta de servicii şi fără a solicita acordul Consiliului înainte de modificarea structurii acesteia, iar alte programe, deşi înscrise în ofertă, nu erau retransmise. Toate aceste fapte constatate contravin dispozițiilor art. 74. alin. (3) din Legea audiovizualului, potrivit cărora distribuitorii de servicii pot modifica structura ofertei de servicii de programe retransmise numai cu acordul Consiliului. Pentru aceste considerente, ţinând cont de criteriile de individualizare a sancţiunii prevăzute la art. 90 alin. (4) din Legea audiovizualului, membrii Consiliului au propus sancţionarea cu somaţie publică a distribuitorului de servicii. Supusă la vot, propunerea a fost adoptată cu respectarea condiţiilor de legalitate prevăzute de art. 15 din Legea audiovizualului. 2 În temeiul dispoziţiilor art. 90 alin. (1) lit. j) şi alin. (3) din Legea audiovizualului nr. 504/2002, cu modificările şi completările ulterioare, Consiliul Naţional al Audiovizualului adoptă următoarea DECIZIE: Art. 1. Distribuitorul de servicii S.C. ELECTRON S.R.L. (deținător al avizului de retransmisie nr. A1779.1/30.04.2009 pentru rețeaua de comunicații electronice cu adresa cap de rețea în Lupeni, județul Harghita) se sancţionează cu somaţie publică de intrare în legalitate pentru încălcarea prevederilor art. 74 alin. (3) din Legea audiovizualului nr. 504/2002, cu modificările şi completările ulterioare. Art. 2. În conformitate cu prevederile art. 93 alin. (3) din Legea audiovizualului, prezenta decizie poate fi atacată direct la secţia de contencios administrativ a curţii de apel, fără a fi necesară formularea unei plângeri prealabile, în termen de 15 zile de la comunicare. Potrivit dispozițiilor invocate: Art. 74 alin. (3): Distribuitorii de servicii pot modifica structura ofertei de servicii de programe retransmise numai cu acordul Consiliului. Art. 82 alin. (2): Distribuitorii care retransmit servicii de programe au obligaţia, la nivel regional şi local, să includă în oferta lor cel puţin două programe regionale şi două programe locale, acolo unde acestea există; criteriul de departajare va fi ordinea descrescătoare a audienţei.
