In summary, the application is contrary to the Council’s development plan and there are no material considerations that would reasonably support any decision to approve. It is clear from the information submitted with the application that the proposed dwelling would be constructed as a ‘new build’ development, rather than through conversion as suggested by the applicant’s agent. Thus, the proposal relates to the redevelopment of a brownfield site within the green belt which is not supported by the Council’s development plan. Also attached is the recommended schedule of conditions in the event that the Local Review Body upholds the Review. Rural Building Protection: This consent relates to the conversion and alteration of the existing structure only; and notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 (as amended) no consent is given, or implied, for any works which result in the removal of the original building to which the proposals relate, and should the building be removed for any reason, then this consent shall be held to be incapable of implementation. 2. Permitted Development Rights: Notwithstanding the provisions of Classes 1 & 3 of Schedule 1 to the Town and Order 1992 (as amended) the proposed dwelling house hereby approved shall not be not be altered in any way nor any building and/or means of enclosure erected within the curtilage of the dwelling house without an express grant of planning permission from the Planning Authority. 3. Details of Materials: Details/samples of the materials to be used for the external walls and roof for the buildings hereby granted permission shall be submitted to, and approved in writing by the Planning Authority prior to the commencement of works on site.
