Against Impartiality Ian Shapiro Journal of Politics, forthcoming 2016 Iustitia, the goddess of justice, holds a sword in her right hand and a set of scales in her left. The sword represents the power to punish, while the scales, held slightly above it, signal that fair weighing of the merits comes first. But it is the blindfold, common in depictions of her since the sixteenth century, that proclaims her impartiality. Lady Justice is blind. 1 She screens out any risk of favoritism, special pleading, or irrelevant distraction so as to render decisions that embody unbiased reason. It is this image of justice as, above all, impartial that many in our generation of political philosophers have found alluring. In my view they are misguided. Lady Justice is indeed blind; she cannot help us see what justice is or what it requires. My goal is to establish that arguments about the justice of political arrangements do not turn in any important way on the idea of impartiality. To the extent that impartiality does play a role, this is either in the application of ideas about justice that have been defended on some other grounds, or impartiality turns out on inspection to be a stalking horse for those other grounds. Put differently, disagreements about the justice of political arrangements cannot be settled by appeal to impartiality. Rather, hostility to domination, or something close to it, usually does the heavy lifting. If I am right, people would do better to recognize that debates about impartiality are confusing red herrings and focus instead on the sources of domination and the means of preventing it. -

Joseph Schumpeter went so far as to characterize Rousseau’s account as the “classical” theory of democracy, even though his was really a neoclassi- cal view—an eighteenth-century adaptation of the ancient Greek theory in which democracy had meant ruling and being ruled in turn. 1 Many commentators have followed Schumpeter’s lead in treating Rousseau as the father of modern democratic theory, yet it is my argument here that John Locke merits the distinction. -

The first third of the course will be concerned with classic treatments of subject from Smith to Schumpeter. The middle third will deal with contemporary writings on capitalism and democratic regulation, with particular attention to the ways in which apparently technical matters conceal political conflicts and choices. The final third will focus particularly on the financial sector, with attention to the lessons to be gleaned from the political and social responses to the global credit crisis of 2008-10. An intensive case study of the relationship between high-powered financial institutions and the political elites and central banks of major western countries will be a major focus of this segment. Requirements: Students will be expected to write either two 10 page papers (one due by midterm, the other at the end of the semester), or a 20 page research paper. Students who choose the second option must discuss a one- to two-page paper prospectus with the instructor and submit it for approval ahead of time. -

Raphael de Kadt This brilliant study by Adam Przeworski must surely become mandatory reading not only for anyone who takes his or her socialist commitments seriously but also for anyone who wishes adequately to understand the relationship between class and electoral politics in the countries of advanced capitalism. The principal burden of Przeworski's intricate and multifaceted analysis of the dilemmas facing social democratic parties in the twentieth century is to show that the decision to participate in electoral politics necessarily constrains the capacity of such parties to effect, through command of the parliamentary system, a transition to socialism. This incapacity turns on the pivotal fact that nowhere (with the possible brief exception of Belgium in 1912) has the industrial working class constituted a majority of the population. In the countries of Western Europe, for example, 'from 1890 to 1980 the proletariat continued to be a minority of the population' (p23). The implications of this fact for parliamentary socialism have been profound, for the essence of the parliamentary system is that, in order to govern, parties must be able to claim representation of an effective majority of the population. Given the minority status of the industrial working class, those parties claiming to represent it have been forced into securing alliances with other classes - and white collar workers, petite bourgeois, students and retirees have all been targeted as potential allies in the socialist cause. -

SELF-CONTRADICTIONS AND MORALITY: A NATURAL LAW CRITIQUE OF DELIBERATIVE DEMOCRACY A Thesis Presented to the faculty of the College of Arts and Sciences of Ohio University In partial fulfillment of the requirements for the degree Master of Arts Robert W. Sidwell June 2007 Abstract Should democracy itself be a value worth striving for? If so, should it take precedence over other values? Is it possible to “add” democracy to a list of these other valuables and treat them all as equally good? Finally, how did the Framers of the United States Constitution view democracy, and why? This thesis seeks to answer these questions. It argues that theories of natural law, not deliberative or direct democracy, offer a level of theoretical precision and protection for human rights and freedoms that democracy cannot be safely trusted to do if it is without the guidance of such a law. Training and Intellectual Formation: From Poland to the United States Q: How did you first get interested in studying politics? What impact did growing up in Poland have on your view of politics? A: Given that I was born in May of 1940, nine months after the Germans had invaded and occupied Poland, any political event, even a minor one, was immediately interpreted in terms of its consequences for one’s private life. All the news was about the war. I remember my family listening to clandestine radio broadcasts from the BBC when I was three or four years old. After the war, there was a period of uncertainty, and then the Soviet Union basically took over. Again, any rumbling in the Soviet Union, any conflict between the Soviet Union and the United States, was immediately seen in terms of its consequences for our life. It was like this for me until I first left for the US in 1961, right after the Berlin Wall went up. One’s everyday life was permeated with international, macro-political events. Everything was political. But I never thought of studying politics. For one thing, in Europe at that time there really was no political science. What we had was a German and Central European tradition that was called, translating from German, “theory of the state and law.” This included Carl Schmitt and Hans Kelsen, the kind of stuff that was taught normally at law schools. -

SS475: Comparative Political Institutions DEPARTMENT OF SOCIAL SCIENCES UNITED STATES MILITARY ACADEMY Course Overview “Institutions are the rules of the game in a society or, more formally, are the humanly devised constraints that shape human interaction. In consequence they structure incentives in human exchange, whether political, social, or economic. Institutional change shapes the way societies evolve through time 1 and hence is the key to understanding historical change.” The study of political institutions – “the rules of the game” that structure political competition within all states – sits at the center of comparative politics as a discipline and is the subject of SS475. In particular, we will focus on explaining the institutions that relate broadly to a country’s “regime type.” Though regime type is often boiled down to a distinction between democracy vs. dictatorship, political regimes are better understood as collections of institutions that regulate political power within a polity: how is power gained and lost? How is political power transferred? How is power divided, dispersed, or consolidated? By whom is political power granted and by whom is it taken away? Who has the right to exercise political power, and who does not? When viewed in comparative perspective, democracies, dictatorships, and “hybrid” regimes alike can all be analyzed along these dimensions and debates. Such a comparative analysis is the overarching objective of SS475. Part I of the course (“Foundations of Political Regimes”) begins with a critical assessment of the concept of democracy, exploring key debates in political science over how democracy should be defined and measured. From there we shift our attention to a rich literature that seeks to understand which – if any – economic and cultural factors influence whether countries become democracies or dictatorship. -

Traditional political economy studied this topic, by assuming that environments and political institutions are given and neutral with regard to the market allocations; they are there but they do not act. New political economy differs from the traditional approach in its treatment of politics. It accepts that political institutions and their relations to the economy and society are populated by actors who have interests/ideologies/faiths and pursue them. Hence, this course is based on the belief that socioeconomic development is fundamentally a political phenomenon. Another firm belief is that the politics of growth and inequality should be understood in terms of capitalism historically embedded in particular conditions. A warning: political scientists cannot study political economy without knowing some sort of economics, as we cannot study political history without dealing with history. So, we will study economic theories and formulations as well. The first part of the course examines the fundamentals of the capitalist system – the system of “the trinity of the capital-nation-state” (Karatani 2014), by reading Polanyi, Schumpeter, Gramsci, and Marx (mostly as a political observer, not as an economist). The second part provides a critical evaluation (with some methodological comment) of the main theories and empirics of the politics of inequality under the so-called “advanced” capitalist democracies. -
