CASH VAN REQUIRED ON LEASE

Sealed offers are invited from authorized agencies offering CASH VAN services in Kerala for providing Secured Cash Van (to be modified as per requirement) along with dedicated drivers on monthly rental basis to carry out cash remittances between different Branches and currency chest under Idukki & nearby districts of Kerala Circle,. The cash van shall be attached to CAC Elappara, Idukki. DESCRIPTION OF FACILITY:

The facility may be required to be provided anywhere in Idukki and in neighbouring districts.

CONTRACT PERIOD:

The contract for providing facilities will be for a term of two years from the date of commencement of the provision of the facility. The contract may be extended at the sole discretion of State Bank of India, after mutual negotiations between the Bank & Agency. The bank reserves the right to terminate the contract before the expiry of the contract period by giving one month notice if the quality of services provided is not to our satisfaction. In the event of closure of the CAC or any other incidents which may arise during the tenancy of the contract, Bank may terminate the contract by giving one month notice, depending on the situation.

DATE AND TIME OF OPENING OF TENDER:

A) The main cover and the “Cover-1 (Technical Bid)” will be opened at the due date and time specified in the tender notice.. B) The Technical Bid will then be scrutinised and the eligible bidders pre-qualified. The financial bids of pre-qualified bidders only shall be opened. C) The date and time of opening the “Cover-2 (Financial Bid)” shall be intimated to pre- qualified tender participants. The decision of the Bank regarding the qualification of tender participants shall be final.

ELIGIBILITY CRITERIA:

A. Only those applicants who possess the following eligibility criteria should apply, along with documentary proof.

a) The applicant should possess valid certificates / license necessary for the execution of the said contract from the appropriate State/Central Government authority and be able to submit them at the time of execution of the contract.

b) The applicant should be able to produce an appropriate vehicle, registered in his name/ company name, having the specifications mentioned in the tender document, within 60 days of acceptance of the tender.

c) The bidder should have positive net worth as on 31st March 2021 and should not be a defaulter /NPA at any point of time to any Bank/Financial Institution.

d) The applicants are required to furnish their ID Proof, PAN No, Registration details of the vehicle etc. as applicable.

PROVIDING SECURED CASH VAN SERVICES AT CASH ADMINISTRATIVE CELL (CAC) ATTACHED TO SBI ELAPPARA (63103) - TECHNICAL BID (COVER 1)

PART A: GENERAL INSTRUCTIONS

State bank of India, RBO-5 Thodupuzha, invites sealed tenders for providing fabricated Secured Cash Vans on hire basis for a period of Two years for cash remittances between their Branches/ Currency Chests/ RBI locations under CACs attached to SBI Elappara. The hiring of the vehicles will be for a period of two years subject to review of the performance every year. Unsatisfactory performance would render the contract liable for termination.

Mode of Submission of Tender: The tender shall be submitted in physical form in two cover system, in accordance with the procedure detailed herein below. Specified documents shall be sealed in envelopes of appropriate size each of which shall be sealed.

1. First envelope marked Cover 1 shall contain, Technical Bid, General instructions, Terms & Conditions and Other documents as specified in the tender documents duly signed by the tenderer. 2. Second envelope marked Cover 2 shall contain Financial Bid only.

Technical Bid envelope (Cover 1) and Financial Bid envelope (Cover 2) shall be placed in a bigger envelope and superscribed as “Tender for providing services of Cash Van at CAC Elappara under the control of RBO-5 Thodupuzha” Also mention Name and contact number of the owner on the envelope. This envelope containing both the bids shall be submitted to the Regional Manager whose address is given in the Tender Notice, on or before the last date and time for submission of tender as mentioned in the Tender Notice.

Offers submitted in any other format other than the specified proforma of technical and financial bids shall be rejected. The technical bids will be opened on the last date & time as stated above.

TERMS & CONDITIONS

1. The hire charges shall include the cost of all expenses towards fuel, maintenance & repair cost of the vehicle, Fitness Certificate, insurance cover for the vehicle and all wages/ remuneration to the driver under various applicable labour laws, road taxes, and any other incidental charges that may arise while operating the vehicle for the bank’s purpose.

2. All transport risks, accidents, mishaps that may occur during the services provided to bank will be at the sole risk and responsibility of the hirer/bidder. The owner of the vehicle / applicant shall totally indemnify the Bank from all risks, accidents, claims arising out of any incident during the operation of the vehicle. The successful bidder shall submit an

indemnity bond and enter into the hire contract agreement, in the prescribed proforma of the Bank.

3. The costs, if any, incurred by the applicants towards submission of tenders, obtaining necessary clarifications or attending discussions, conferences or site visits will be reimbursed by the Bank. The authorised person of the firm/ company/owner shall sign in all the pages of the application with seal of the company/ firm if any. If, information and details furnished by applicants are found to be false at any time in future or any relevant information withheld, which comes to the notice of the Bank at a later date, the contract of such applicant will be cancelled immediately, at the discretion of the Bank.

4. Any amendments/ corrigendum shall be published in Bank’s website only. Therefore, tenderers are requested to visit Bank’s website regarding modifications/ corrigendum issued in regard to extension of date of submission/ opening of bids etc.

5. In case of any dispute arising regarding the job contract including the interpretation or the scope or working thereof, the decision of the Regional Manager, RBO 5 Thodupuzha, shall be final and binding on the Contractor.

6. The tenderer must obtain himself on his own responsibility and his own expenses all information and data which may be required for the purpose of filing this tender document and enter into a contract for the satisfactory performance of the work. The Tenderer is requested to satisfy himself regarding the availability of water, power, transport and communication facilities, capacities that may be required, the quantity of the materials, labour, the law and order situation, climatic conditions local authorities requirement, traffic regulations etc; The tenderer will be fully responsible for considering the financial effect of any or all the factors while submitting his tender.

7. Design and layout of the vehicle is to be approved by the Bank, However all the fabrication work/ modification is in the scope of the vendor and shall be done by vendor himself. 8. The vendor has to submit the self-attested stability certificate of the whole installation on thereof at the time of executing the contract. 9. The Bids will be opened in the presence of tenderers, who choose to be present at the above said office. All tenderers are advised to be present, at their own interest, on the said date, time and venue for opening of the bids. 10. The vehicle to be hired will be on consolidated monthly rental basis including cost of fuel, replacement of tyres, break down maintenance, periodical maintenance/ services, driver’s salary, their bata, etc and all inclusive. The rates quoted shall be valid and firm for two years and throughout the contract period.

11. The vehicle shall be insured under comprehensive policy and the policy should be lodged with the Bank. Road Tax, Insurance and all other charges payable to statutory agencies, etc are to be paid out of the rate quoted by the service provider. Any claim/charges arising out of usage of vehicles like accidents, damages of life and property of third party etc, is to be borne/dealt by the service provider.

12. The service provider should always maintain the vehicle in good running & road worthy condition and should provide alternative driver/assistant, having bonafide & valid driving license and police clearance certificate, whenever the regular person is not available.

13. The Bank has the right to request for change of the Driver /Attendant of the vehicle in the event of their misbehaviour /rash-driving/misconduct etc or in the event of and frequent breakdown of the vehicle and on non-compliance of such directions, Bank can terminate the contract of hiring within 3 days by issuing notice.

14. The service provider has to supply the vehicle along with necessary modifications to suit cash remittance purpose and to be certified by Manager (Security), AO Ernakulam.

15. The driver/Vehicle should be available exclusively at the office hours on all working days. He shall report to duty at least 30 minutes before the commencement of the working hours.

16. Proportionate amount will be deducted from monthly payment for the days the vehicle is not in working condition. If the non-availability of the vehicle is likely to extend for more days, the contractor shall arrange for alternate arrangement complying with all the guidelines stipulated for the cash van and produce the relevant documents of the alternate arrangement shall be produced before the Bank for verification. In the event of the contractor failing to supply the cash van/ alternate arrangements, suitable remedial action will be taken by the Bank, inclcluding levy of penality or termination of the contract or both, subject to the sole discretion of the Bank.

17. If the Cash Van is used by the service provider for own use, without the permission of the Manager of the respective office, written warning shall be issued and repetition of the same may lead to termination of the service.

18. Service provider has to enter into an agreement on requisite stamp paper as per Bank’s format, detailing all the contractual terms.

19. On acceptance of the application of the successful bidder the above terms & conditions and other conditions, if any accepted by the Bank, would be entered upon through an agreement.

20. In the event of noncompliance of the agreed terms & conditions or default in supplying the vehicle, Bank can terminate the contract of hiring at any time by giving 3 days’ notice. In such a case, the service provider has to reimburse the bank all the loss/ expenses incurred by the bank in this regard.

21. The Bank shall be indemnified by the service provider against any claims/damages arising out of usage of vehicle like accidents, damages to life and property of third party etc.

22. The hiring shall be based on the following model: a. Fixed rate for a distance of 2000 Kms (Excluding GST) b. Rate per km for distance more than 2000 Kms (Excluding GST) c. GST at applicable rates will be paid as extra on the basis of the GST bills submitted.

23. No advance for hiring shall be paid. The payment of hire charges shall be after submission of the bills and subsequent verification by the Bank.

24. The bank may at its discretion utilise the cash van for the same or any other purpose on Bank duty, at its discretion.

25. A permanent mobile phone to be provided to each cash van irrespective of the cash van driver at the owners cost and recharged enough to make emergency calls to the concerned Bank officials and Police Stations. The mobile number shall have important contact numbers of Bank officials to contact in case of an emergency.

26. The Price Bid shall be on a fixed rate basis. No upward revision in the rates would be considered on account of subsequent increase in Government Taxes, Customs Duty, Excise Tax, Sales tax, Toll Tax, minimum wages, fuel price etc.

27. Fitness Certificate from RTO: To be submitted once in a year.

28. All papers relating to Vehicle/Driver must be up to date.

29. Goods Carriage Certificate to be obtained by the service provider.

30. Security of the Vehicle & Driver will be at the risk of the Service Provider.

31. Insurance: Insurance shall be covered for the vehicle with minimum 1+4 passengers.

32. Rent/Rate quoted shall include all types of Charges / Entry Fee / Toll Charge / Repair / Cost of Insurance etc. GST shall be paid by the Bank as applicable to the rate for the distance run in a month.

33. Applicable TDS shall be deducted from the rent/ rate payable and paid to the Tax authorities. GST as applicable shall be paid to the Tax authorities by Cash Van owner, as per the bills duly quoting the GST Registration number.

34. The Vendor shall ensure that the drivers employed for the Cash Van are provided salary and other benefits as per the provisions of the Minimum Wages Act 1948 and should comply with provisions of Contract Labour (Regulation & Abolition) Act 1970 and all other prevailing statutory requirements in this regard. The service provider shall submit the details of wages paid to the driver along with the GST invoices. Any litigation arising in future, in connection with violation of the provisions of the said Acts will be the sole responsibility of the Vendor.

35. The Vendor shall provide a security deposit of Rs.10,000/-- (Rupees Ten thousand only) by way of a fixed deposit in the Bank earmarked for the purpose for a period of two years. The security deposit is liable to be forfeited in case the operator unilaterally withdraws from the contract before the expiry of the term of contract. Any expenses or costs that may be incurred by the Bank as a consequence of the breach or non-fulfilment of any of the terms and conditions of the contract on the side of the service provider will be debited to service provider’s account/ monthly payment. The Bank reserves the rights to discontinue the contract at any point of time, by giving one month notice without assigning any reasons what so ever.

36. Successful tenderer should deliver the vehicle with desired modifications within 60 days of acceptance of the tender.

37. Conditional or incomplete tender or any alterations in the original proforma of technical bid or financial bid will lead to disqualification and rejection of the tender. Applications received after the due date and time are liable for rejections. SBI reserves its right to reject any/ or all the applications without assigning any reasons whatsoever.

38. Tender may be cancelled at the sole discretion of the Bank without assigning any reason whatsoever.

VEHICLE SPECIFICATIONS:

1. Make & Model (a) It should be an LCV (Light Commercial Vehicle), with an Engine capacity of not less than 2200 CC, preferably Turbo charged and registered as a commercial vehicle. (b) Vehicle should not be more than 02 years old at the time of hiring and not more than 05 years old at any point of time. (c) Ground Clearance – Not less than 190 mm. (d) Vehicle should accommodate minimum 1 + 4 passengers (factory built). (e) Vehicle should have four (04) doors for driver/ passengers and one separate door for cash cabin. (f) All doors to have independent locking system from inside and outside. (g) Should have tubeless tyres including Stepney (h) Complete tool kit containing jack and handle and tools to open wheels and minor repairs (i) Factory fitted air conditioner.

2. Layout: (a) Body should be of a sheet metal of minimum 19 Gauge, however the floor should be of minimum 16 Gauge chequered plate. (b) There should be at least 4 iron eyelets on cash cage floor, of sufficient diameter (say 2-2.5”), bolted to the chassis from below. The eyelets should be spaced in a way so as to accommodate multiple cash box stacks in the cash cage. (c) There should be 2 rows of seats in the driver’s cabin, front row for driver and one Bank Guard (co-driver) and the rear row for one armed guard and 2 other staff.

3. Cash Compartment Security: (a) Cash cage compartment should have door and grille gate. (b) The entrance of the cage should be from the left side of the van and rear should be completely closed. (c) Locking arrangement: One internal lock and 02 pad locks at the door of cash cabin. (d) All windows and wind screen should have wire mesh protection (of not more than 1 square inch). Each Window mesh should have a circular port-hole of dia. 6 inches for use of weapon.

4. Driver Cabin:

(a) It should have mobile charging facility. (b) Fitted with CCTV system with GPS and 30 days recording facility and 03 cameras as under: (i) Rear (ii) Front (iii) Cash Compartment (c) Hooter for security purpose. (d) One first aid box with adequate first aid kit shall be fitted near driver’s seat. (e) One ABC type (stored pressure) 2 kg fire extinguisher shall be provided near driver seat. (f) GPS based vehicle tracking system shall be provided by the contractor at their own cost.

Cash Van Modifications:

1. Vehicle should accommodate minimum 1+4 passengers and insurance coverage should also cover minimum 1+4 passengers. The service provider also shall take and service the policy of fidelity insurance for reasonable amount covering the cash van and driver.

2. Necessary endorsement of RTO for modification/seating capacity is needed in the RC book. The cash van shall have RTO passing, required clearances to operate in the State of Kerala and Commercial Goods Carriage permits for commercial activity as required for the Bank.

3. All the laws applicable to the State of Kerala, relevant Central and local laws, ordinances, regulations and codes shall be complied.

DRIVER

1. The driver provided by the Vendor to drive the vehicle will at no point of time stake claim to be an employee of the Bank.

2. The driver should be courteous and should always be vigilant and should be in uniform. He should be medically fit to drive the van and should hold valid driving license.

3. The vehicle should be made available at the Banks premises with a dedicated driver as per prescribed timings. The Vendor shall get the antecedents of the dedicated / reserve drivers verified by the police authorities in advance and furnish a copy of the same along with the copies of proof of their residence, driving license etc. to the Bank. The fuel tank of the vehicle being supplied shall be topped up every day well before commencement of the day’s schedule.

4. The driver shall be experienced, expert in speaking of local language and should be able to carry out minor repairs. 5. He must carry a valid Driving License to drive a goods transport commercial vehicle and updated documents of the cash van.

6. Frequent change of drivers without prior intimation and approval of the Bank shall not be permitted.

7. The driver shall maintain secrecy of the Bank’s operation.

8. Car dairy to be maintained with provision for entry of details like start/end meter reading etc.as required by the Bank.

AGREEMENT PROVISION OF CASHVAN SERVICES TO STATE BANK OF INDIA CURRENCY ADMINISTRATION CELL, ………….

THIS AGREEMENT made on this ….st day of ………… .…. at …….. between Mr. ………………, (Hereinafter referred to as the “Contractor” which expression shall include its successors and assigns)

AND

State Bank of India, a body corporate constituted under the State Bank of India Act 1955 and having its Local Head Office at Trivandrum and Currency Administration Cell at ………… represented by its Branch Manager (Hereinafter called the “Bank” which expression shall include its successors and assigns).

WHEREAS:-

1. The Bank proposes to carry out cash remittance among and between its various branches and its Currency Administration Cell, …………... The Contractor agreed to provide one Secured Cash Van ………………. (Air Conditioned) which is registered as LMV goods carrier bearing registration number ………….. as a public conveyance and modified with security features as approved by the bank at the cost of the contractor.

NOW THIS AGREEMENT WITNESSETH AND IT IS HEREBY AGREED BY AND BETWEEN THE PARTIES HERETO AS UNDER:

2. The Bank hereby appoints the contractor in return for a fixed sum, at contractor’s own risk and cost, to provide a cash van as per requirement of the Bank, purely on contractual basis, for cash remittance purposes, and other official purposes, from its various branches in …….. and neighboring districts to its Currency Administration Cell, …………… and vice versa. 3. The Bank shall pay the Hiring Charges for use of the aforesaid vehicle for cash remittance/transportation of cash from their branches to Currency Administration Cell, Elappara or vice versa or other official purposes at the lumpsum amount of Rs ……….. /- (Rupese ……………….. only) plus GST at prevalent rates on total billing, per month, upto 2000 kilometers per month. The bank shall pay Rs …. /- (Rupees …… only) for additional kms/ month beyond 2000 Km . An overtime payment of Rs …. /- (Rupees ………… only) per hour beyond 10 hrs duty, holiday charges of Rs……… /- (Rupees ………………… only) will be paid when applicable, at the end of every month. 4. The monthly charges agreed above are valid up to …………... No extra charges on account of hike in fuel, oil, lubricants shall be paid by the bank during the agreement period. The bank agrees to a yearly revision of……. on the previous year’s basic rental charges to offset hike in operational cost.

5. THAT THE Contractor may terminate this agreement by giving thtree months written notice in advance in writing to the bank of his intention to terminate the agreement and on expiry of the said period, the agreement shall be terminated. The bank shall also be entitled to terminate the agreement by giving one months’ notice in writing to the first party of its intention to terminate the agreement and this agreement shall stand terminated on the expiry of said notice period. And in such case of termination, compensation or damages will not be paid by the Bank.

6. THAT THE Contractor agrees to provide, at his own cost, and maintain the necessary devices as per the direction of the bank, in conformity with RBI directions.

7. THAT THE Contractor shall not let or hire to anyone the said cash van during the period of this contract, not only during the office hours of the Bank but also after office hours. 8. THAT THE Contractor shall not use or allow his agents or representative to let the vehicle to be used for any purpose i.e. Other than cash remittance or any other official duty from the Branch or to Currency chest or as assigned by the Branch Manager. 9. THAT THE Contractor shall modify the vehicle as per the requirement of the Bank and provide the vehicle with necessary grills, partition door, security camera, security alarm system with loud siren, and any other requirements/arrangements as per the stipulation of the Bank as well as Reserve Bank of India regulations applicable to cash vans, at the cost of the contractor. 10. THAT THE Contractor shall provide at his own cost, One DCP/ABC powder type firefighting equipment along with the first aid box in the cash van, and maintain the same in good condition. 11. THAT THE Contractor shall maintain the vehicle in good running condition without giving any scope for complaint and observe regularity in attendance and co-operate with the Bank in smooth and efficient running of the arrangement . The tyres etc., provided with the van should always be in good condition. 12. THAT THE Contractor shall ensure that the driver, including replacement driver, engaged by them shall be persons of good character and a Police Screening/ verification regarding the character and antecedents is got done, and a copy of the police verification report shall be submitted to the Bank. The driver shall have desirable driving efficiency, courtesy and good behavior. He shall possess a valid driving licence issued by the Transport authorities and he shall be medically examined for his eyesight and other physical fitness on yearly basis. The contractor shall ensure that the driver shall not be under influence of liquor or any other intoxicants or narcotic or psychotropic drugs while on duty.

13. THAT THE Contractor shall absolutely be responsible for the payment of the salary, insurance and all other statutory obligations for the driver employed, the cost of all repairs, maintenance, accessories, fuel & oil used in the running of the van, or any other expenses connected with the vehicle. 14. THAT THE Contractor shall alone be responsible for plying the van against all risks at his own cost and shall be regular in paying the required insurance premium, motor vehicle tax and other taxes , driver’s licence and in case of any alleged violation of any rules of Motor Vehicles Act or any other law relating to the subject, the owner shall be responsible for not only payment of fines, but also other payments and damages that may be levied or claimed against him on his behalf. The Bank shall reimburse toll charges paid by the Contractor on a monthly basis. The bank shall allow parking of cash van in the bank premises during and after the working hours. 15. THAT THE Contractor shall allow the Bank to have armed guards and other staff members as may be required to accompany the cash remittance on its trip to any branch or for any other official duty by Bank staff assigned by the Branch Manager, limited to Five persons inclusive of driver as per Road Taxation and Insurance Rules. 16. THAT THE Contractor shall provide the van with its fuel tanks topped up at the Branch/Collection Centre of the Bank for 10 hours, from ……. hours to ……… hours, on all Bank working days of the month. The cash van will be at the disposal of the bank for remittance of cash or any other bank duty to run any where as per Bank’s requirement within the areas of Idukki and its neighboring districts, covering whole of Kerala. Sufficient essential spares shall also be carried when moving on outstation duty. 17.That the daily trip sheets/ running diary shall be prepared & maintained by the Contractor for the van and it shall be verified by the Branch Manager of the Currency Administration Cell at the

beginning of each day, counter signed at the end of the day. The trip sheet shall consist of the time van reported at the Currency Administration Cell and the starting Kilometer reading. Closing km and time shall also be recorded at the end of the day. 18. THAT THE Contractor shall agree that the persons employed/ engaged by the Contractor, i.e. driver or any other person is under the control and supervision of the Contractor and not the Bank. It is further agreed that the Contractor shall be absolutely responsible for the payment of salary all other statutory obligations for the driver etc. employed and arrears of salary, employment termination, compensation or other claims of whatever nature shall be at the risk of the Contractor, and Bank has no connection whatsoever relating to such matters and they are not treated as employees of the Bank. 19. In case of cash van going off the road for any reason, alternate arrangements should be made by the contractor so that services to the branches are not affected. 20. In case the cash van is not made available for any reason during the month, the actual expenses incurred by the bank towards making alternate arrangement in this respect shall be borne by the contractor, which will be deducted from the corresponding monthly rental payable to the contractor. In addition, Bank at its discretion may take suitable remedial action for breach of contract, including levying penalty, termination of the contract, forfeiture of the security deposit etc as deemed fit. 21. The rent/hire money for the cash van shall be paid by the bank to the Contractor after the last working day of every month, within one week provided the GST invoice is produced well in time with all the supporting documents. 22. It is mutually agreed between the parties that before the expiry of the agreement, either party can take up the matter for renewal of the agreement for further period, on mutual terms and conditions that may be agreed to between them, subject to the guidelines of the Bank..

23. Notwithstanding anything contained here in before the contractor hereby agrees that the Bank shall have the right to stipulate such other conditions as may deem or arise or necessary in the circumstances either on its own or at the instance of Government or Reserve bank of India or Indian Bank’s Association and if stipulated by the Bank at a later date, it is deemed to have stipulated now and the contractor further agrees to perform it without any demur.

24. The tender documents submitted by the vendor, Bank’s offer letter etc shall also form part of this agreement.

The Bidder shall quote the rent and other charges excluding GST but including all other taxes and cess, Levies, License/ Permit Charges, Road Tax, Insurance, Service Charges, Fuel charges, Driver & Labour charges, Maintenance Charges etc as applicable.
