Asian Highway No. 1 Semi-Annual Social Monitoring Report October-December 2018 SECTION 1.0 INTRODUCTION 1.1.Introduction In this report activities carried out towards the implementation of Resettlement Plan (RP), Indigenous People’s Pan (IPP) and other related Social Safeguards have been presented for the reporting period from October to December 2018. 1.2. Project Background Asian Development Bank (ADB) has approved the loan for South Asia Sub Regional Economic Cooperation (SASEC) Road Connectivity Investment Program (SRCIP). The SRCIP is a multi-tranche financing facility (MFF) that aims to improve about 500 km of priority road sections in North Bengal and Northeast of India, through an investment program set out in phases (tranches).Under Tranche 1 of the investment program, two identified core subprojects totalling about 134 km inWest Bengal and one non-core subproject in the State of Manipur are taken up considering theirsignificant regional cooperation. The second tranche includes two subprojects in the State of Manipur:Four laning of Imphal-Moreh section of NH-39 (renamedas NH-102)which is part of Asian Highways 1 (AH-1)from Km 330.000 to Km 350.000 (Package I)andtwolaningof Imphal- Moreh section of NH-39 (renamed as NH-102)from Km 350.000 to Km 395.68.000 (Package II).

The Ministry of Road Transport and Highways (MORTH) will be the Executing Agency for the tranche 2 project road and the National Highways and Infrastructure Development Corporation Limited (NHIDCL) will be the Implementing Agency (IA).

1.3. Project Objectives The road stretch is a critical section of the UNESCAP Asian Highway -1 (AH-1), paving theWay for India and other South Asian countries to , and further to ASEAN countries.The main objecting of the project is upgrading the existing road to 2-laning with paved shoulders, together with safety features including construction of Vehicle under Pass atbusy junctions. Performance-based maintenance will be undertaken for 5 yearsafter the construction.

1.4. Project Description The Trance 2 subproject road section is part of NH-39 connecting Imphal and Indo- Myanmar Boarder at Moreh. The road section traverses through six districts of Manipur i.e. Imphal East, Imphal West, , , Chandeland districts. Out of 65.68 kilometers, the initial 20kilometers starting from km 330.000 and ending at km 350.000 is under package-I and the remaining 45.68kilometersstarting from km 350.000 and ending at km 395.680 is under package-II. The instant package-II subproject is under four districts viz Thoubal, Kakching, Chandel and Tengnoupal districts. The first 16km falls in plain area falling in Thoubal and Kakching districts and inhabited by both general and tribal people having private ownership of land. SECTION 2.0. SOCIAL SCENARIO OF THE PROJECT 2.1. Introduction Imphal-Moreh road section of Tranche 2 is divided in to two sections based on its geographical and social features. The 1st section i.e. from -Wangjing is in plain area falling in Imphal East, Imphal West and Thoubal and inhabited by general people having private ownership of land. The 2nd section i.e. Wangjingto Khongkhang is in plain and hilly area falling in Thoubal, Kakching, Chandel and Tengnoupal districts inhabited by both general and tribal people community only having private ownership and community/customary landholding systems. A single Resettlement Plans (RPs) is prepared for these two sections though treated them as separate subprojects. The available RoW for this road section is not sufficient to accommodate the widening proposal and therefore acquisition of additional strip of land is required for the entire section.Land acquisitionfor the project roadis under direct purchase mode through negotiation. 2.2. Review and Findings from Resettlement Plans (RP) 2.2.1. Resettlement Plan (RP) for the subproject This Resettlement Plan (RP) for the subproject is prepared based on the detailed design report. The RP complies with the applicable State Government, Government of India and ADB policy and legal framework. The total length of the project section is 65.680km. The subproject area falls in Imphal East, Imphal West, Thoubal, Kakching, Chandeland Tengnoupal districts of Manipur. There are 38 villages falling within the 65.680km Imphal- Morehroad section. 2.2.2. Summaryof Subproject Impacts

The proposed subproject can be viewed as boosting economic growth and poverty reduction which will bring substantial social and economic development in the region. The social benefits arising due to the subproject will be triggered off due to improved accessibility to various services such as easy access to markets, health facilities, schools, workplace etc. which in turn increases the income of the locals, and ultimately elevating their standard of living.

The subproject has adverse social impacts in the form of acquisition of 169.64acres of land from private / community ownership and it affects 615 structures. About 2275 households are getting affected with a population of 12478. There are altogether 449 CPRs which are being impacted due to the subproject. Table 2 presents all adverse impacts of the subproject in a nutshell.

Loss of Livelihoods in the Subproject As per the census survey, out of 1582 DPs losing livelihoods includes 317 (20.04%) owners of agricultural land, 729 (46.08%) owners of commercial structures, 137 (8.66%) owners of residential cum commercial structures, 42 employees in commercial structures, and 357 commercial tenants. 2.2.6. Vulnerable Households being affected in the Subproject

According to subproject census survey there are 1,257 households enumerated as vulnerable households as per the definition provided in the RF. In this subproject vulnerable group includes 112 SC households, 252 ST households, 252 women headed households, 9 households headed by physically handicapped persons and 364 Below Poverty Line (BPL) households. As per the latest Planning Commission, Government of India estimate, any person having monthly per capita consumption and expenditure (MPCE) of Rs. 11184 in rural area and Rs. 1170 in urban area of Manipur is considered to be living below poverty line. Based on calculation of poverty line figure, average annual household MPCE in rural Manipur is Rs. 67080. 226 households earning less than the average MPCE and another 41 non-titled holder households not falling under any other category are also considered as vulnerable households in the project. 2.3. Review and Findings from Indigenous People’s Plan (IPP) of Imphal MorehRoad section 2.3.1. Legal and Institutional Policy

The legal framework and principles adopted for addressing resettlement issues in the Project have been guided by the existing legislation and policies of the GOI, the , Asian Development Bank and the Resettlement Framework (RF) adopted for the project. Prior to the preparation of the RP, a detailed analysis of the

Page 7 Asian Highway No. 1 Semi-Annual Social Monitoring Report October-December 2018 existing national and state policies was undertaken and a RF has been prepared for the entire program. This RP is prepared based on the review and analysis of all applicable legal and policy frameworks of the country and ADB policy requirements.

2.3.2. Identification of Affected Communities

The area along Imphal-Moreh road project from chainage 366+800 km to chainage 395+680 km is inhabited by indigenous people of different ethnicity. The Naga and Kuki are the main tribes found in around 10 villages in Chandeland Tengnoupaldistricts will be affected due to widening and improvement of the said road project. According to census of India, 2011, the proportion of schedule tribe in Manipur state is 35% of state population. The concentration of ST in is high as 88.9% of total ST population.

2.3.3. Social Impact Assessment

The project will affect 253 households and 1540 DPs belonging to ST communities.Male- female proportions are 50.78% and 49.22%, indicating slightly higher ratio of malepopulation over females. Sex ratio among the affected population is 969 females per 1000males, which is higher than average sex ratio of Chandel district (932). Average family size ofthe AHs is 6.1 which is a “medium” size of family in tribal villages.

The Affected households are classified according to type of land ownership. Of the total 253 AHs, 72 families are private land owners. Majority (86%) of them own private revenue land while only 10 AHs own land in hill areas.

Further, 62 households having private revenue land are “Titleholder”, while, 10 households are owners of customary right over private hill land. According to tribal customary law of the Kuki community, all lands belong to Village Chief, who has power to take decision on division of land among the households as per the requirement.

In all, 285 private structures will be affected. Out of all affected structure 9.5% are ownedby legal titleholders, 5% structures are owned by encroachers and the largest share 85.6%(244) is of those having structures on customary land rights.

The affected households were classified according to their annual household income. 79AHs, (31%) of all 253 AHs have income more than Rs. 1 Lakh. Similarly, 71 HH (28%) haveannual income ranging from Rs 60000 to Rs.100000. 29 AHs, or nearly 12% fall under theincome group category ranging from more than 50000 to Rs. 60000. 61 families or, 24.1% of allAHs are having income between 30000 to 50000. Only 10 families have annual householdincome less than Rs.30000.

For implementation of IPP prepared of sub project, the Executing Agency (EA) for the Project is Ministry of Road Transport and Highways (MORTH) and the Implementing Agency will be the National Highways and Infrastructural Development Corporation (NHIDCL). The existing NHIDCL has already established a Branch Office (BO) which will be the Project Implementation Unit (PIU) headed by a General Manager (GM), who will be the Project Director (PD). The NHIDCL, headed by MD will have overall responsibility for implementation of loan and will also be responsible for the overall coordination among ADB, MORTH and PIU. For resettlement activities, PIU will do the overall coordination, planning, implementation, and financing. The PIU will appoint a Resettlement Officer (RO) at the rank of Manager and required support staff for the duration of the Subproject to ensure timely and effective planning and implementation of resettlement activities. The RO will be assisted by the respective PIU and NGO for planning and implementation of resettlement activities in the subproject. An experienced and well-qualified NGO in this field will be engaged to assist the PIU in the implementation of the RP. To enhance their capacity, a training/workshop will be conducted under the project involving implementation support agencies.

SECTION 3.0 SOCIAL MONITORING OF RP AND IPP IMPLEMENTATION 3.1.Status of Land Acquisition

Status of Land Acquisition for package- I from Lilong(Starting Chainage330+00 km) to Wangjing (350+000 km), the road passes through plains / valley and falls in the Govt. of Manipur (GoM) Revenue Land areaunderImphal East, Imphal West and Thoubal districts. In this stretch land will be acquired through negotiation with private owners (Titleholders) for direct purchase. In cases where negotiation will fail, NH Act will be followed and acquisition of land will be done as per the prevailing law. Land acquisition for this portion through direct purchase mode is in progress.

Status of Land Acquisition for package- II from Wangjing (Starting Chainage 350+000 km) to Khongkhang (395+680 km), the road passes through plains / valley and hilly areasfalling in Revenue and non revenue land areasunder Thoubal, Kakching, Chandeland Tengnoupal districts.Land compensation amounts had been deposited in the CALA accounts of Thoubal, Kakching, Chandeland Tengnoupal districts.Land acquisition for is in progress. Payment for land compensation amount for Tengnoupal district completed and land handed over by CALA, Tengnoupal (copy enclosed as annexure - I). Land acquisition for stretches under Kakching and Chandel districts is in final stage and acquired stretches had been handed over by respective CALAs (copy enclosed as annexure - II). Title holders are receiving all entitlements for applicable

3.2.2.Statuses of disbursement of replacement cost of Standing structures and other attachments to land. Disbursement of replacement cost of Standing structures and other attachments to landare almost in final stage except some cases of payment of solatium in Tengnoupaldistrict which had been misused by the previous DC. Time line for resolution of the fund misuse is yet to be decided by the state government for which an FIR had been issued against the previous Deputy Commissioner by the incumbent Deputy Commissioner. For land, compensation money had already been given to the land owner and fund misuse is not related with land. Solatium amounts for replacement cost of standing structures are still pending due to misuse of fund and their structures are not yet dismantled. Payments of compensation are as per the guide lines of loan agreement and RP/RF. 3.3. Mobilization of NGO for RP / IPP Implementation SAI International Sansthan, the INGO has signed final contract with NHIDCL on 30th October2017 and has mobilized on the same day. Identification and Verification of DPs and CPRs The process of identification and verification of displaced persons (DP) has started since 12th November 2017by the INGO and still continuing. So far identification and verification of displaced persons (DP) under Kakching, Chandel and Tengnoupla districts have been completed as furnished by the nominated NGO and details are as follows inTable 8.

3.5. Micro Plans of DPs

Micro Plan of NTH DPs under Chandel district had been approved. The Micro plans of NTH DPs under Tengnoupal district and TH DPs under Kakching district have been submitted by the nominated NGO. However, it was instructed for resubmission after modification.

3.6. Mobilization of Civil Construction Contractor at Site

It has been noticed that the contractor has started mobilization of its machineries and manpower. Contractor has started setting up of Construction and labour campsat Laijing village (Vangkhei) on the eastern side of the project road near Km

3.7. Status of Temporary Land Acquisition

The Civil Contractor has made lease agreementswith the private owner for temporary acquisitionof8.40 acres of land for setting up their construction and labour camps, field office, plant and machinery sites etc. The Civil Construction Contractor has started developing Construction Camp site.

The Contractor has also mobilized for negotiating with the villagers for procuringsuitable community land parcels to establish Disposal Sites.

3.8. Health Camps / HIV / AIDSAwareness Training Programmes conducted at Construction Camps for Construction Labourers A Health checkup unit has been set up in the camp.HIV / AIDS Awareness Training Programmesare yet to start and will be undertaken in association with INGO.

3.9. Grievance Redress process

Grievance Redress Committees (GRC) for package II subproject road has been constituted on 21st December 2018. This GRC will look into all cases of grievance registered by the parties (Village Communities, Village Chairpersons and Customary Right Holder individuals). 4.0.
