[Doc. # 57 (“first MTD Order” or “MTD1 Order”).] On September 3, 2020, Counterclaimants filed their First Amended Answer (“FAA”), which contains counterclaims for: (1) a judicial declaration that they are joint authors and co-owners of Truth Hurts; (2) an accounting of revenues from the use of Healthy in Truth Hurts; (3) “further relief” under 28 U.S.C. § 2202; (4) an accounting of revenues from Truth Hurts enjoyed by all Counter-defendants, or by Lizzo and Jesse St. John Geller (“St. John”); and (5) a constructive trust. [Doc. # 58.] On September 24, 2020, Lizzo filed a second motion to dismiss (“MTD”) the first, third, fourth, and fifth amended counterclaims. [Doc. # 60.] The motion has since been fully briefed. -

Global Animal Partnership’s sole substantial activity appears to be the operation of a program to certify that certain food products sold by Whole Foods Market. In addition, Whole Foods Market may be paying fees to Global Animal Partnership to provide services that benefit Whole Foods Market. Whole Foods Market Corporation (“Whole Foods”) is a Texas-based chain of premium supermarkets that promotes itself as “America’s Healthiest Grocery Store.” Whole Foods provides both traditional groceries and meat and poultry products, as well as prepared foods. In 2005, Whole Foods founded Global Animal Partnership (GAP), a tax-exempt organization whose principal activity is developing and promoting its “5-Step® Animal Welfare Rating Standards.” In turn, the Standards’ principal use appears to be to certify that meat products sold by Whole Foods Market satisfy the Standards. Whole Foods’ founder and long-time CEO, John Mackey, was a board member of GAP until 2014. InSight: RIVIER ACADEMIC JOURNAL, VOLUME 13, NUMBER 1, SPRING 2017 “ALL CREATION GROANS”: The Lives of Factory Farm Animals in the United States Sr. Lucille C. Thibodeau, pm, Ph.D.* Writer-in-Residence, Department of English, Rivier University Today, more animals suffer at human hands than at any other time in history. It is therefore not surprising that an intense and controversial debate is taking place over the status of the 60+ billion animals raised and slaughtered for food worldwide every year. To keep up with the high demand for meat, industrialized nations employ modern processes generally referred to as “factory farming.” This article focuses on factory farming in the United States because the United States inaugurated this approach to farming, because factory farming is more highly sophisticated here than elsewhere, and because the government agency overseeing it, the Department of Agriculture (USDA), publishes abundant readily available statistics that reveal the astonishing scale of factory farming in this country.1 The debate over factory farming is often “complicated and contentious,”2 with the deepest point of contention arising over the nature, degree, and duration of suffering food animals undergo. “In their numbers and in the duration and depth of the cruelty inflicted upon them,” writes Allan Kornberg, M.D., former Executive Director of Farm Sanctuary in a 2012 Farm Sanctuary brochure, “factory-farm animals are the most widely abused and most suffering of all creatures on our planet.” Raising the specter of animal suffering inevitably raises the question of animal consciousness and sentience. Jeremy Bentham, the 18th-century founder of utilitarianism, focused on sentience as the source of animals’ entitlement to equal consideration of interests. -

Canadian Film Fest Announces New Award and 2021 Masterclass and Industry Series Lineup

Expanding on the CFF’s mission to celebrate and inspire Canadian filmmakers, Best Producer will be presented to a BIPOC short filmmaker by CFF and the EDA Foundation. The CFF’s Masterclass and Industry Series brings together actors, directors, producers, and key stakeholders in the Canadian film industry each year to offer notable opportunities for filmmakers and creatives to build up their industry knowledge. A complete list of the industry sessions follows below, with the schedule available here. Masterclass registration opens today at canfilmfest.ca. The Canadian Film Fest presented by Super Channel is the second virtual edition of the Festival, which begins Thursday, April 1 on Super Channel Fuse for three consecutive weekends. Access to the online industry programs and masterclasses are a key aspect of the virtual festival experience, together with the on-air film premieres and screenings, pre- recorded and live filmmaker Q&As, and a virtual awards presentation. Commonwealth of Virginia Office of the Governor HISTORY Executive Directive NUMBER TWELVE (2020) CONTINUING THE COMMONWEALTH OF VIRGINIA CAMPAIGN: EMPLOYEE WORKPLACE GIVING AND VOLUNTEERISM Importance of the Initiative The Commonwealth of Virginia Campaign (CVC) is an annual charitable giving campaign created in 1997 under the Virginia Department of Human Resource Management (DHRM) to promote a culture of caring and giving within the Commonwealth of Virginia. The CVC assists the Commonwealth’s employees in their charitable giving by providing a single vehicle for charitable contributions that minimizes workplace disruptions and maximizes charitable contributions. Since its inception, employees of the Commonwealth have given over $50 million, including $2.2 million in 2019. In 2010, Governor McDonnell recognized the CVC as an annual campaign and created the Advisory Council in Executive Order 26 (2010). Recognizing the importance of charitable giving by state employees, Governor McAuliffe continued the CVC through Executive Order 27 (2014). In his Executive Order, Governor McAuliffe expanded the size of the Advisory Council and established Agency Coordinators to organize the CVC within each agency. The success of the campaign in 2020 is vital due to the global impact of the COVID-19 pandemic. Now more than ever, Virginians helping Virginians when they are able is important. The CVC’s newly-designed website makes it easy for state employees to support trusted local and global charities. The website contains everything employees need to support charities, including online pledges using ePledge. I know that state employees stand ready at a moment’s notice to step up and help where needed and, with the support and guidance of Virginia’s leadership, can accomplish anything. -
