GONZALEZ: The first item of business is the roll call. MR. HAMBY: Actually, Mr. Gonzalez, the first order of business would probably be to elect a temporary chairman since the chairman is absent. MR. GONZALEZ: Recognize Shad. MR. BOGANY: I'd like to get this meeting rolling. Our chair and our vice-chair is not able to be here today, and so what we're going to do is elect a temporary chair, and I'd like to move that Vidal Gonzalez be elected temporary chair. MAYOR SALINAS: Second. MR. GONZALEZ: We have a motion and a second, seconded by Mayor Salinas. At this point I would like to recognize the new board member that has been already approved and sworn in, and that's Mr. Dionicio Vidal Sonny Flores. He was previously with the General Services Commission Board; he's currently the president of PEC Corporation; he's from Houston; and he's class of '58 from Texas A&M University. We'd like to welcome you onboard. (Applause.) MR. GONZALEZ: We have a motion and a second. ON THE RECORD REPORTING (512) 450-0342 7 All those in favor, please indicate by saying aye. Beth Anderson should be joining us later, she's absent at this time. Kent Conine is absent at this time. Mayor Salinas? MAYOR SALINAS: Here. MR. GONZALEZ: Shad Bogany? MR. BOGANY: Here. MR. GONZALEZ: And Mr. Flores? MR. FLORES: Here. MR. GONZALEZ: And I do have a question. Do you go by Sonny or Dionicio? MR. FLORES: I was named after my father and my grandfather, and then my mother was in the receiving room at my house, not knowing that the doctor insisted on a name before he walked out the door, and my grandfather and my father named me after themselves, and my mother balked beginning day one, and I've been called Sonny by her all her life, so if you'd call me that, I'd appreciate it. ON THE RECORD REPORTING (512) 450-0342 8 MR. GONZALEZ: Okay, that's great. For all the rest, it's Mr. Board Member, I guess. (General laughter.) MR. GONZALEZ: We've got some witness affirmation forms, and so we'll go into the public comment. We're going to limit the public comment to two minutes, and I'll start off with the first one, Mr. Granger MacDonald, who has been here since early in the morning, chomping at the bit. MR. MacDONALD: Thank you, Mr. Chairman. Congratulations, I think. Anyway, you can see after a few meetings whether you think that's good or not. (General laughter.) MR. MacDONALD: I'd like to encourage the board to consider forward commitments in Regions 3 and 9 this term. The GO Zone for the Houston Katrina/Rita situation is very well established and very needed, but Dallas and San Antonio are deeply affected by the hurricanes. We've got 100 percent occupancy in both communities. We finished a property in early September in Dallas, 150 units, it was 100 percent leased by the end of October. I'd love to tell you it's the world's greatest property because I believe that, but I think that the storm had a lot to do with it. There are no available ON THE RECORD REPORTING (512) 450-0342 9 units for people to rent for low income housing right now in Dallas; San Antonio is the same way. We brought 250 units of rehab online in late August, we have a huge waiting list there already. Both communities should have been somehow considered in the same situation for the additional funds that the GO Zone was, and I'd like for you to consider forward commitments as the time becomes appropriate in the next few months. I'm the city manager of the City of Flatonia, and I'm here to comment briefly on some of the changes that were made recently to the HOME Program.

Justin Miller Jun 9, 2021, 6:00 am CST In 2001, state lawmakers and business leaders warned that the state’s high property tax rates were discouraging corporations from locating big projects in Texas. At the time, Site Selection magazine—a trade publication about economic development—showed Texas’ national ranking on new manufacturing plants had plummeted to 37th in the nation, and without a state income tax, the Lone Star State had no choice but to lean on sales and local property tax revenue to fund basic services like public education. In order to attract large manufacturing projects, lawmakers proposed allowing school districts to offer generous property tax abatement deals—with the state picking up the tab—as a way to lure companies to Texas. Proponents promised that good-paying jobs and long-term investment that came with those projects would more than make up for the cost of the tax breaks. The bill, dubbed the Texas Economic Development Act, passed quickly, championed by then-state Representative Kim Brimer, a Fort Worth Republican, and backed by powerful business groups. Colloquially known as Chapter 313 due to its place in the state’s tax code, the program is immensely popular for both industry and school districts. For the last two decades, it’s been the state’s largest corporate welfare program. But data reveals that 313 projects routinely lose more value than originally estimated when they return to the tax rolls, at a total cost of nearly $10 billion to Texas since the program’s beginning, raising questions about whether the projects ever actually pay off.

GENERAL DENIAL Davis denies generally every allegation contained in Plaintiff’s Original Petition and demands strict proof thereof by a preponderance of the credible evidence in as expeditious a fashion as allowed by law. Davis prays that Mr. Brimer’s suit be dismissed promptly in the interests of substantial justice and the rights of the voters of Texas Senate District 10. 1 | P a g e II. Davis lawfully resigned her city council seat well prior to becoming a candidate for State Senate District 10. Finally, Mr. Brimer himself admits that Davis’ tenure on the city council ended no later than January 8th of this year, well before her election to the Senate would occur. Under any and all of these circumstances, Davis is an eligible candidate for the Texas Senate.

The 12-member Commission is a legislative body that reviews the policies and programs of more than 150 government agencies every 12 years. The Commission questions the need for each agency, looks for potential duplication of other public services or programs, and considers new and innovative changes to improve each agency’s operations and activities. The Commission seeks public input through hearings on every agency under Sunset review and recommends actions on each agency to the full Legislature. In most cases, agencies under Sunset review are automatically abolished unless legislation is enacted to continue them. The organization also has responsibility for settling transactions in the state’s wholesale spot market for electricity. But the term “ERCOT” also is used loosely in other ways. For instance, the term can describe the geographical footprint for retail electric deregulation in Texas. It is also sometimes used to describe the state’s wholesale energy market. This report touches upon policy questions relating to all these conceptualizations of ERCOT: as an organization, as an energy market, and as the area of Texas with competitive electric suppliers. To distinguish between these meanings, the term “ERCOT” will be used whenever practicable to refer to the organization, “the ERCOT region” will be used to refer to deregulated areas of the state, and “ERCOT market” will be used to describe the wholesale energy market within the ERCOT region. The reader should note that the Texas Public Utility Commission typically has responsibil- ity for setting the highest level ERCOT market policies, while the ERCOT organization oversees grid operations.

Legislative Interim Study Committees will begin meeting in earnest starting in April and your TADC Legislative Vice Presidents and the Committee are busy reviewing interim charges and preparing testimony and white papers on issues of importance to the Civil Justice System. In our last E-Update, we provided links to these studies for your information. I would encourage any member who has a concern or wishes the Association to study a particular charge, to contact me or the TADC office so that we can transmit this information to the Legislative Committee. With the March 4 primary elections finally over, the dust is settling and everyone has a much clearer picture of what the general election will hold this November. A comprehensive report on election results follows this message. TADC’s 26th Annual Trial Academy is coming up April 4-5, 2008, in Dallas at the Omni Hotel at Park West. This is one of TADC’s premier programs. If you have a new attorney in your firm with little or no courtroom experience, I would strongly urge you to send them to the Trial Academy.
