Legalbrief | your legal news hub Thursday 23 September 2021 Media storm over Malema's tender excesses A picture of unrestrained excess and cronyism is painted in three Sunday newspaper reports claiming ANC Youth League president Julius Malema's millionaire lifestyle is being bank-rolled by lucrative government contracts awarded to his companies, writes Legalbrief. The Sunday Times, City Press and Rapport all allege Malema has benefited substantially from several tenders - and that most of them stem from his home province Limpopo, where he wields significant influence. According to the Sunday Times, official tender and government documents show Malema was involved in more than 20 contracts, each worth between R500 000 and R39m between 2007 and 2008. One of Malema's businesses, SGL Engineering Projects, has profited from more than R130m worth of tenders in just two years. Among the tenders awarded to SGL, notes the report, was one by Roads Agency Limpopo, which has a budget of over R2bn, and which is headed by Sello Rasethaba, a close friend of Malema. Rasethaba was appointed last year shortly after Malema's ally, Limpopo Premier Cassel Mathale, took office. EFF STATEMENT ON SECOND NATIONAL PEOPLES ASSEMBLY, PARLIAMENT DEPLOYMENTS AND OTHER POLITICAL ISSUES Tuesday, 02 July, 2019 NATIONAL PEOPLE’S ASSEMBLY At its Special Meeting convened on the 1st of July, 2019, the Central Command Team resolved that the EFF Second National People’s Assembly will be convened on the 13 - 16 December, 2019 at the Expo Centre, Nasrec under the theme “Consolidating the Ground Towards Socialist Power”. The National People’s Assembly is an elective conference of the EFF, the highest decision-making body and, according to the EFF Constitution, takes place every five years. Accordingly, the CCT has adopted guidelines that pave the path towards the election of delegates from branches, including in regions, and provinces. These will be published on the EFF website for easy access. Within these guidelines are strict rules and deadlines for election of delegates, audit of branches, as well as conduct of all fighters and commissars on lobbying for leadership positions. Members and leaders of the EFF are therefore called upon to internalise these guidelines and participate in the lead up to this assembly with the highest discipline and determination. The Discussion Documents will also be published on the EFF website and they will be sent to branches, so that branches are not only ceased with matters of leadership but they also discuss the state of the nation in South Africa through the Discussion Documents of the EFF and provide what could be a sustainable solution to the challenges that are confronting the poor masses of our people on the ground. PARLIAMENT COMMITTEE DEPLOYMENTS Post 2019 General Elections, the EFF increased its seats from 31 to 53 Members of Parliament (MPs), with 44 in the National Assembly (NA) and 9 in the National Council of Provinces (NCOP).

Majola’s company LTE Consulting made regular headlines for its role in a water project in Giyani which failed to bring water, but cost taxpayers R3-billion. Majola also squeezed almost a billion from several projects it obtained from Gauteng’s department of human settlements. According to an analysis by News24, of that R1-billion, LTE received R224-million for projects it claimed it never worked on, while separately questions have been raised about how the company obtained one of the Gauteng tenders worth R200-million – see Mokonyane’s history with LTE alongside. Despite public outrage and official investigations, neither scandal has yet damaged Majola – though the Hawks raided LTE Consulting in November over an unrelated Covid-19 tender. Over three years between 2016 and 2019, Majola doled out over R3-million to a Malema- linked front company, and over R14-million to various ANC structures.

Committed to Unity: South Africa’s Adherence to Its 1994 Political Settlement Paul Graham IPS Paper 6 Abstract This paper reviews the commitment of the remaining power contenders and other political actors to the settlement which was reached between 1993 and 1996. Based on interviews with three key actors now in opposing political parties represented in the National Assembly, the paper makes the case for a continued commitment to, and consensus on, the ideals and principles of the 1996 Constitution. It provides evidence of schisms in the dominant power contender (the African National Congress) which have not led to a return in political violence post-settlement. The paper makes the point that, while some of this was the result of President Nelson Mandela’s presence, more must be ascribed to the constitutional arrangements and commitments of the primary political actors and the citizens of South Africa. © Berghof Foundation Operations GmbH – CINEP/PPP 2014.
