Equality Rights and Pay Equity: Déjá Vu in the Supreme Court of Canada Jonnette Watson Hamilton and Jennifer Koshan* ABSTRACT This comment analyzes the Supreme Court of Canada’s most recent decisions under the equality guarantee in the Canadian Charter of Rights and Freedoms. Quebec (Attorney General) v Alliance du personnel professionnel et technique de la santé et des services sociaux and Centrale des syndicats du Québec v Quebec (Attorney General) are companion pay equity decisions examining claims of sex discrimination under section 15(1) of the Charter and the Quebec government’s attempt to defend those claims under section 15(2) and section 1. The Court is badly split in its analysis, and the authors discuss the major points of disagreement as well as the majority’s clarification of the proper approach to sections 15(1) and (2). They also explore the implications of these cases for pay equity laws in Canada and for the future of equality rights claims. I. Available from: http://ssrn.com/abstract=2511239 Abstract Most of the recent appointees to the Supreme Court of Canada have participated in a new Canadian judicial nomination process initiated by the current Conservative government. As originally formulated in early policy platforms, the process was intended to mimic features of US Senate judicial confirmation hearings and so would highlight the distinction (popular in US political discourse) between ‘applying’ and ‘making’ law. This led to widespread fears that any new public process would politicize judicial appointments and functions at the Supreme Court. The process turned out to be much more tepid than anticipated and so raises questions about what Canadians may have learned as a consequence of this new nomination process. This paper undertakes a qualitative analysis of reporting of four nomination processes from a select number of Canadian newspapers. The main object is to determine the degree to which readers might have been alerted to the distinction between law and politics or, put another way, between judicial activism and restraint. It turns out that this framing was not dominant in the coverage and that, instead, distinctive Canadian political preoccupations, like language politics, got channeled through this new political opportunity structure. -

DENIAL OF JUSTICE: THE UNITED STATES’ FAILURE TO PROSECUTE SENIOR OFFICIALS FOR TORTURE1 Materials Submitted in Support of Hearing on Human Rights Situation of People Affected by the U.S. Rendition, Detention, and Interrogation Program before the Inter-American Commission on Human Rights 156th Ordinary Period of Sessions October 23, 2015 Key Facts and Arguments Officials at the highest levels of the United States government created, designed, authorized, and implemented a sophisticated, international criminal program of torture and cruel, inhuman, or degrading treatment or punishment. In August 2014, President Barack Obama conceded that the United States tortured people as part of its “War on Terror.” In December 2014, the Senate Select Committee on Intelligence released the Executive Summary of its report on the Central Intelligence Agency’s detention and interrogation program, providing further evidence of state- sanctioned torture. The Inter-American Commission on Human Rights and other human rights authorities have called on the United States to conduct an in-depth and independent investigation into all allegations of torture and other cruel, inhuman, or degrading treatment or punishment, and to prosecute and punish those responsible. To date, the United States has declined to prosecute any senior officials for these crimes. Moreover, the United States has taken active steps to shield these officials from liability.
