(a) A tender is invited for the work as mentioned in Appendix `A' to this Notice of tender. (b) The work is estimated to cost as indicated in aforesaid Appendix ‘A’. This estimate, however, is not a guarantee and is merely given as rough guide and if the work costs more or less, a tenderer will have no claim on that account. The tender shall be based as mentioned in aforesaid Appendix `A'. 2. The work is to be completed within the period as indicated in aforesaid Appendix ‘A’/ Notes to Schedule `A’ in accordance with the phasing, if any, indicated in the tender from the date of handing over the site, which may be one or about two weeks after the date of the acceptance of the tender. 3. Normally contractors, whose names are on the MES approved list for the area in which the work lies within whose financial category, the estimated amount would fall, may tender. In case where the tendered amount is in excess of the financial category of the contractor, the Accepting Officer reserves the right to accept the tender, in which event the tenderer would be required to lodge "Additional Security Deposit" as notified by the Accepting Officer in terms of conditions of contract. 3.1 Contractors, whose names are borne on the MES approved list of any MES formation and who have deposited Standing Security and have executed Standing Security Bond, may also tender without depositing Earnest Money Deposit alongwith the tender and if the Accepting Officer proposes to accept the tender, such tenderer would be required to deposit “Security Deposit" as notified by the Accepting Officer before acceptance of tender. In case, however the Accepting Officer subsequent to deposition of Security Deposit decides not to accept the tender for any reason, whatsoever, the amount deposited will be refunded to the tenderer. Not more than one tender shall be submitted by one contractor or one firm of contractors. 3.2 Under no circumstances will a father and his son(s) or other Close relations, who have business dealing with one another, will be allowed to tender for the same contract as separate competitors. Breach of this condition will render the tenders of both parties liable for rejection. 4. The Garrison Engineer (AF) Faridabad, Dabua Colony, Faridabad Haryana - 121005 will be the Accepting Officer, hereinafter referred to as such for the purpose of this contract. 5. Applications for the tender forms must be submitted to the Garrison Engineer (AF) Faridabad, Dabua Colony, Faridabad Haryana - 121005 so as to reach his office on or before the date as mentioned in aforesaid Appendix `A' and the same must also be uploaded on website www.defproc.gov.in. 5.1 Invitation for issue of tender does not constitute any guarantee for consideration and opening of price bid in cover No 2 which will be done only after opening and evaluation of technical bid/applications in cover No 1 even to enlisted contractors of appropriate class. Opening of price bid (Cover No 2) of tender will be decided by the Accepting Officer based on interalia past track record, financial position and experience of similar works executed by the applicants/contractor. The Accepting Officer shall consider applications (Cover No 1) received up to date of receipt of application/ extended date of receipt of applications for consideration and subsequent opening of cover No 2. The applicant/contractor will be informed regarding non-opening of cover No 2 of tender without assigning reasons. The applicant/contractor if he so desires, may appeal to the next higher Engineer Authority with copy to the Accepting Officer upto seven days prior to date of opening of price bid (cover No 2). The decision of the next higher authority shall be final. No applicant/ contractor shall be entitled for any compensation whatsoever for non consideration/opening of cover No 2. 6. (a) Tender forms and conditions of contract and other necessary documents will be uploaded in website as per the date given/mentioned in the aforesaid Appendix ‘A’. (b) The appropriate standing Security amount for this work shall be deposited by contractor as enlisted in the area in which the work lies for appropriate category mentioned in aforesaid Appendix `A'. (c) In case of contractor who has not executed the “Standing Security Bond" the tender shall be accompanied by "Earnest Money" for the amount referred to in the aforesaid Appendix ‘A' in the form of deposit at call receipt in favour of GE mentioned in the aforesaid Appendix ‘A’ by Scheduled Bank/or receipted treasury Challan the amount being credited to the revenue deposit of the GE (mentioned in Appx `A’) Contd……/- NIT NO: GE (FBD)/AF-42/2018-2019 Serial Page No.08 IAFW-2162 (Revised 1960) NOTICE OF TENDER (CONTD…./-) (d) A contractor who has executed the Standing Security bond but not for the appropriate category, as mentioned above, shall lodge with the Controller of Defence Accounts Concerned , additional security deposit as notified by the Accepting Officer within thirty days of the receipt by him of notification of the acceptance of the tender, failing which this sum will be recovered from first RAR payment or from the first final bill in case of term/running contract. However, in cases where any payment is made to the contractor within thirty days of receipt by him of notification of acceptance of tender the amount of additional Security deposit shall be recovered from such payment. GE will return the Earnest Money wherever applicable to all unsuccessful tenderers, by endorsing an authority on the deposit receipt for its refund, on production by the tenderer of a certificate of the Accepting Officer that the bonafide tender (vide condition 13 hereinafter) was received and all documents were returned. The GE will either return the Earnest Money to the successful tenderers, by endorsing an authority on the deposit receipt for its refund, on receipt of an equal amount of Security Deposit or will retain the same on account of Security deposit if such transaction is feasible. Copies of the drawings and other documents pertaining to the work (signed for the purpose of identification by the Accepting Officer or his accredited representatives) and samples of materials and stores to be supplied by the contractor will be open for inspection by the tenderer in the offices of GE as mentioned in the aforesaid Appendix `A' during office working hours. 7. The tenderers are advised to visit site by making prior appointment with the GE by giving sufficient time. 8. Tenderers shall be deemed to have full knowledge of all relevant documents, samples, site etc, whether he has inspected them or not. 9. Tenders can submit the tender (Cover No 1 & 2) upto the last date & time of submission of bid and the bid will be opened by Garrison Engineer (AF) Faridabad, Dabua Colony, Faridabad Haryana - 121005 on the date & time mentioned in appendix `A’ 10. Any tenderer which proposes any alternations to any of the conditions laid down or which proposes any other conditions of any description whatsoever is liable to be rejected. 11. The submission of tender by a tenderer implies that he has read this notice and the conditions of contract and has made himself aware of the scope and specification of work to be done and the conditions and the stores, tools and plants etc. which will be issued to him and local conditions and other factors having bearing on the execution of the work. 12. Tenderers must be in possession of copy of MES Schedule of Rates 2009 (Part –I) and 2010 (Part –II) including, errata/ amendments thereto. 13. Tenderers must be very careful to deliver and uploaded a bonafide tender, failing which the Accepting Officer, may at his absolute discretion, reserves the right of forfeiting a portion of earnest money, security deposit or security bond amount (not exceeding amount of cost of tender) deposited by the tenderer. A bonafide tender must satisfy each and every condition laid down in the Notice. 14. Accepting Officer does not bind himself to accept the lowest or any tender or to give any reasons for not doing so. 15. The Accepting Officer reserves the right to accept a tender submitted by a public sector undertaking giving a price preference over other tenders(s) which may be lowest, as are admissible under the Govt. Policy. No claim for any compensation or otherwise shall be admissible from such tenderers whose price bid (cover No 2) may be rejected on account of said policy. 16. This notice of tender shall form part of the contract. 17. The tenderer is required to upload a copy of Employee Provident Fund code No in addition to tender documents. The tenderer not in possession of this number shall be disqualified in ‘T’ bid evaluation and his financial bid (Cover No-2) shall not be opened. 18. The tenderer is required to upload a copy of Service tax registration No in addition to tender documents. The tenderer not in possession of this number shall be disqualified in ‘T’ bid evaluation and his financial bid (Cover No-2) shall not be opened. 19. For Category b (i) : The tenderer is required to have a valid electrical license from State Govt in their establishment and license is required to be uploaded in Cover -1 of the bid. The tenderer not in possession of valid electrical license shall be disqualified. In “T” bid evaluation and his Financial Bid (Cover No 2) shall not be opened .
