    Confidential May 31, 2016 Relations between the United States and the Russian Federation today are tense with disagreements, the origin of which lie in the international satisfaction granted by US lawmakers to a fugitive criminal accused of tax fraud in Russia, a former US citizen - William Browder who in 1998 renounced US citizenship for tax reasons. In December 2012, after a massive three-year lobbying campaign, the United States passed Sergei Magnitsky Rule of Law Accountability Act of 2012 setting forth the never-existent story of a "lawyer" Sergey Magnitsky, who allegedly exposed corruption crimes and embezzlement from the Russian treasury, for which he was arrested, tortured and beaten to death in November 2009. This Act was in fact the beginning of a new round of the Cold War between the United States and Russia, putting on the scales the interests of a group of scammers and interstate relations. At the root of the Act is the story of Sergey Magnitsky, monstrous in its depth, which no one ever even took the trouble of verifying. According to open sources, the lob hying of the decision against Russia began in 2006, immediately after Browder was banned entry into Russia, several senators and public figures were involved in the process. In 2008, Browder officially announced a lobbying company on the issues between Hermitage Capital and Russia, and after the death of Magnitsky (synchronized with the need to focus attention on the problems of Hermitage Capital) - the lobbying campaign became known as the Magnitsky Act. In the course of the internal investigation into the reasons for providing political support to Browder in the United States, it was found that from the very beginning of the Hermitage Capital activities in Russia, spearheaded by its chief consultant Browder, the company's largest investor was Ziff Brothers Investments (a group of companies headed by three brothers - Dick, Robert, Daniel, billionaires from New York with serious ties in Washington.

The case had been at the center of a major international political controversy. Prevezon, which is owned by a Kremlin-connected Russian businessman named Denis Katsyv, was accused by the US government of using laundered money from a 2007 Russian tax fraud to buy millions of dollars’ worth of Manhattan real estate. The fraud, which was discovered by a Russian accountant named Sergei Magnitsky, involved companies owned by Hermitage Capital Management, a Moscow-based hedge fund run by the American-born British financier William Browder. Introduction It is borne in upon me by several recent events… that try as I may, try as many others may, you will never succeed in establishing in American opinion a balanced & sensible view of Russia.2 George F. Kennan, writing at the end of 1986, predicted that negative perceptions of Russia would last long past the point of their relevance. Now, thirty years later, we see the unfortunate consequence of policymakers unthinkingly recapitulating Cold War tropes: a relationship with Russia which is strained to the point of snapping. True, the antagonism between Russia and the United States has deep historical roots, but its persistence belies deeper issues of political psychology and changing definitions of national interest and foreign policy priorities. This becomes evident through an examination of cooperative and hostile periods in the U.S.-Russian relationship. The demonization of Russia as, at worst, evil, or at best, a pitiable, backward nation, began in earnest during the fierce ideological competition of the Cold War, though differences between the two nations had been building in the decades prior. In addition to being institutionalized in policy, Russophobia has seeped into popular culture and has remained there, virtually unquestioned, ever since. To be sure, the Russian government is propagating a steady stream of anti-American propaganda as well, and though neither side bears complete responsibility for the deterioration in relations, the United States would be wise to rethink its approach to Russia and analyze the extent to which our own behavior has driven Russia’s decision-making.

Washington, DC 20530 Dear Mr. Boente: Over the past few years, the Committee has repeatedly contacted the Department of Justice to raise concerns about the Department’s lack of enforcement of the Foreign Agents Registration Act (“FARA”). I write regarding the Department’s response to the alleged failure of pro-Russia lobbyists to register under FARA. In July of 2016, Mr. William Browder filed a formal FARA complaint with the Justice Department regarding Fusion GPS, Rinat Akhmetshin, and their associates.1 His complaint alleged that lobbyists working for Russian interests in a campaign to oppose the pending Global Magnitsky Act failed to register under FARA and the Lobbying Disclosure Act of 1995. The Committee needs to understand what actions the Justice Department has taken in response to the information in Mr. Browder’s complaint. The issue is of particular concern to the Committee given that when Fusion GPS reportedly was acting as an unregistered agent of Russian interests, it appears to have been simultaneously overseeing the creation of the unsubstantiated dossier of allegations of a conspiracy between the Trump campaign and the Russians. Mr. Browder is the CEO of Hermitage Capital Management (“Hermitage”), an investment firm that at one time was the largest foreign portfolio investor in Russia. According to the Justice Department, in 2007, Russian government officials and members of organized crime engaged in corporate identity theft, stealing the corporate identities of three Hermitage companies and using them to fraudulently obtain $230 million.2 The $230 million was then extensively laundered into accounts outside of Russia.
