Five code essay exams test on the Louisiana Civil Code and the Louisiana Code of Civil Procedure. The Multistate Bar Exam (MBE) is not used. Subjects Tested Code Subject Essays: Civil Code I (Persons, Community Property, Property and Acquisitive Prescription); Civil Code II (Successions, Donations and Trusts); Civil Code III (Liberative Prescription, Obligations, Contracts, Security Rights, Sales, Leases and other Civil Code Book III topics); Louisiana Code of Civil Procedure; Torts. Non-Code Subject Essays: Business Entities and Negotiable Instruments; Constitutional Law; Criminal Law, Procedure and Evidence; Federal Jurisdiction and Procedure. Bar Exam Dates The Louisiana Bar Exam is administered on a Monday, Wednesday and Friday in a week of February and July. 2010 Exam Locations/Dates Kenner (New Orleans area): February 8, 10, 12 Baton Rouge, Kenner (New Orleans area): July 26, 28, 30 Filing Fees and Deadlines Please refer to Louisiana Supreme Court Rule XVII. For detailed information about filing dates and fees, contact the Louisiana Committee on Bar Admissions at 800-314-1530. UW Law School: Academic Enhancement Program (AEP) Source: www.barbri.com Exam fee: $550 Grading and Results A passing score is 70% (seven separate essay exams, including four code subject essays, must be passed). Results are generally released in mid-April for the February exam and mid to late October for the July exam. Reciprocity Admission on Motion: Louisiana does not provide for admission on motion. Its purpose is to provide SULC students with general information about preparing for a bar exam generally and the Louisiana bar exam specifically. While the booklet will not answer every question that a student may have regarding bar preparation, it will supply sufficient foundational information regarding the subject and identify various resources which may be consulted for additional information. Therefore, this booklet is purely informational. Students should accept the full responsibility of adequately preparing themselves for a bar exam. SULC’s Class of 2015 recognized the need to collectively work towards fully informing the entire Law Center on the necessary actions required when preparing for and taking a bar exam. The class also recognized that most lawyers – with rare exceptions (see Wisconsin) – must pass a bar exam in order to practice law.

LICENSURE IN LOUISIANA Since Louisiana does not provide reciprocity for out-of-state attorneys, there are only two ways that out-of-state attorneys can practice in Louisiana. LA. SUP. CT. R. XVII § 11. Out- of-state attorneys must either seek admission to the Louisiana Bar or through pro hac vice admission. The Louisiana Supreme Court (“the Court”) has promulgated rules governing the admission of attorneys into the Louisiana State Bar and pro hac vice admission (“the Rules”). See LA. SUP. CT. R. XVII. A. Admission to the Louisiana Bar Pursuant to the Rules, “the Court’s constitutional authority to regulate the admission of qualified applicants to the Bar [of Louisiana] shall be administered by the Committee on Bar Admissions of the Supreme Court of Louisiana.” Id. at § 1. 1. CIVIL CODE I LOUISIANA STATE BAR EXAMINATION July 21, 2008 Question I. (25 Points) In 2000, Tom died, survived by his widow, Katie, and a child by a prior marriage, Susie, who was age thirty-three (33) at the time of Tom’s death. Under the terms of Tom’s will, Tom left all his property to Susie, subject to a usufruct in favor of Katie until Susie reached age 40. One of the assets of Tom’s estate was the former family home located in Donaldsonville, Louisiana, and which was Tom’s separate property by way of inheritance from his father. In 2003, Katie decided to build a swimming pool in the back yard of the property and she requested Susie’s consent to do so. The swimming pool cost $15,000 to build. Katie’s property appraiser advised her at the time that the addition of the pool increased the market value of the property by $20,000. In 2004, a portion of the roof of the house was damaged as the result of a severe thunderstorm during the hurricane season. Katie asked Susie, as the property owner, to repair or replace the damaged portion of the roof. Susie refused to undertake any work on the roof, despite Katie’s repeated requests. Eventually, Katie replaced the damaged part of the roof at her own expense. The replacement cost was $5,000. Shortly before Tom died, he had installed premium wall-to-wall carpet in the den and the master bedroom. Katie had two dogs that lived with her in the house and they have seriously damaged the carpeting.
