Executive Engineer Municipal Corporation Panchkula Pinjore & Kalka Zone

1. Eligibility Criterion: A) The contractors enlisted/ Registered with Haryana PWD(B&R) / HUDA /CPWD / HSAMB or any other Govt. departments upto the estimated value of tender are eligible to submit their tenders. In addition to Enlistment stated above, the contractor has to submit certificate/documents regarding satisfactory completion of 01 work of Similar Nature. B) As tenders are open tenders, contractors /agencies not registered with Municipal Corporation, Panchkula will have to get registered with Municipal Corporation, Panchkula before allotment of work.

3. Bid documents can be downloaded online from the portal https://etenders.hry.nic.in by the Agencies/ Contractor/ L&C ( Societies)registered on the Portal. The bids to be submitted online are required to be digitally signed. For further details, terms and conditions please visit the website https://etenders.hry.nic.in.

4. The details of the Bid Document Cost / EMD are required to be uploaded at the time of online submission; the bidders are therefore required to keep the scanned copies of prequalification and other documents of the above mentioned documents ready.

5. The tender shall be submitted online by the tenderer in the following three separate covers online:- a. Fee: Scanned copy of Bid Document Cost / EMD. b. Prequal /Technical: The cover shall contain scanned copies of the prequalification documents, technical parameter / technical bid c. Financial: This cover contains contract schedule of rates (BOQ) to be submitted online by the bidder.

Note 1: Physical submission of Documents - Online Bidders will also required to physically submit the Bid Document cost / EMD and other document related to prequalification, technical parameter / Technical bid etc. Above envelopes (as applicable) shall be kept in a bigger outer envelopes, which shall be sealed and submitted in the office of Municipal Corporation, Panchkula as per Scheduled dates . ( In O/o Municipal Engineer )

Note 2: The Municipal Corporation, Panchkula has the right to verify the authenticity of the documents submitted by the bidder online as well as physically.

Note 3:- The price bids are to be submitted mandatory online.

6. Opening of Bid:- In the first instance, the cover of all the Bidders containing the Bid Document Cost / EMD shall be opened online as well as physically. If the Bid Document Cost / EMD is found proper and in order then the cover containing prequalification / Technical Bid shall be opened. The Financial cover shall be opened only of those tenderers who meet the Pre- Qualification / Technical Bid criteria as per these Bid documents.

1. Conditional Tenders and tenders without earnest money are likely to be rejected. 2. Interested bidders can purchase the tender document online from website www.etenders.hry.nic.in . 3. The Commissioner, Municipal Corporation, Panchkula reserves the right to reject or accept any tender in full or part even without assigning any reason. 4. Earnest Money and tender form fee can be deposited in the account of Executive Officer, Municipal Corporation, Panchkula through RTGS in Indian Overseas Bank, Panchkula A/C No. 141901000003550 IFSC Code IOBA0001419 and copy of receipt obtained thereof be submitted online along with the bid. 5. The agency has to do the work strictly as per specification and further during the inspection of work/testing at any time in future by any Govt. Department/agency ,if any deficiency in the work is noticed the agency “personally’ will be responsible instead of any Municipal official. The agency is liable to pay for any recovery if found against agency due to deficiency in the work executed by that agency. Moreover the agency will bear the loses personally without any excuses. 6. In case of any dispute the orders of the Worthy Deputy Commissioner, Panchkula will be final. 7. The Final payment of agency will be made after receiving the sample report and inspection of monitoring committee. 8. The quantity of work can be increased/decreased. 9. In case of tender receipt/opening date happens to be holiday, the tender shall be received on the next working day on the same timing. 10. No material will be supplied by the department. 11. The contractors/agencies have his own tiles, kerb and channel manufacturing unit will be given preference. 12. The amount 10% of the work done will be obtained for three years as warrantee for any default/damage observed in the work besides any kind of any disaster or 10% bank guarantee is required as security for 3 years from the date of completion of work. 13. If at the time of submission of E-tenders ,any error occurs due to the technical reason of the website Municipal Corporation, Panchkula will not be responsible. 14. Agencies should note that online tenders will be submitted at the foresaid website www.etenders.hry.nic.in as per the detail /instructions uploaded therein. 15. No bitumen escalation shall be given for job mix formula in bituminous work. 16. The executing agency will be held responsible for any fault/damage observed in the work for three years from the date of completion and the defects will be got rectified by the agency free of cost for three years from the date of completion of work. 17. The contractor/agency has to declare and enclose the documents related to annual turnover more than one Crore rupees for tenders up to ten Lakhs along with PAN/TIN No., address proof and bank solvency. 18. Further information can be obtained and schedule of quantities ,the detailed plans and specifications can be seen in the office during the office hours. 19. Tender should be quoted at a percentage above or below the rate in the details of estimate in the enclosed scheduled and the contractor should state the period within which he agrees to carry out the work. 20. Each tendered shall give proof to the entire satisfaction of the Executive Engineer concerned that he has in his possession Haryana P.W.D. specification latest addition failing which his tender shall be liable to be rejected. 21. Rate should be quoted in Hindi or English ,otherwise the tender can be rejected. 22. The successful tendered shall have to sign an affidavit to the effect that he has no relation or connection with the firm contractor blacklisted by M.C. PKL Corporation PKL Of India, from time to time. 23. The earnest money deposited for the tender will not be returned to the contractors/firms till the acceptance of tender or three months, whichever is later. 24. Sales/Works Tax and Income Tax will be deducted from the bills of contractors as per the instruction of the Govt. 25. The quality control tests will be got done by the department and the material for such tests will be supplied by the contractor free of cost. In case the material is not found up to the requirement ,the same will be rejected . Costs of such tests will also be borne by the contractor. 26. The final payment of agency will be made after receiving the sample report and inspection of monitoring committee. 27. Any items of work not provided in the contract schedule of rates, If required to be executed will be paid as per the Haryana P.W.D. schedule of rates 1988,together with the ceiling premium exhibited in the NIT for various chapters subject to “premium or discount tenderd by the contractor ,where the item exist in the Haryana P.W.D. schedule of rates 1988. The Deptt. Reserves the option to take away any item of work of any part therof at any time during the currency of contractor with due notice to the contractor without liability of compensation. 28. In case of Bituminous work bitumen/emulsion will be arranged by the contractor from approved refinery i.e. Panipat/Matura refinery only. The contractor shall submit original bill/voucher of refinery while claiming the payment for the work done. 29. The agency has to got inspected the bed of the street /road to the Engineer in charge before laying lean concrete/any sort of layer. 30. The agency has to use 43 grade O.P.C. cement bag. 31. Contractor is required to provide cautionary measurement/sign boards etc. during execution of work and he is fully responsible for any loss /compensation in case of accident, misshapen at the site of work. 32. In case of Bituminous works, every payment will be done after the satisfactory report of the 3rd party i.e. N.I.T.T.T.R. Sec-26,Chandigarh. 33. The agency has to cut and give it a rectangular shape before filling the pot holes on the road and make the measurement of all the patches with concerned J.E. for office record with photographs. 34. The contractor has to start the work immediately and make an agreement with the Municipal Corporation, Panchkula within a week after receipt of the work order. It is responsiblty of the contractor. 35. The agency has to complete the work as per specification and within the stipulated time period. 36. The contractor will be bound to follow all the conditions written in the tender form MW4,D.N.I.T. and tender notice. 37. For metaled road works contractor should have his own hot mix plant and all the machineries as per morth specifications. 38. No work will be executed in night hours. 39. Before starting the work the agency has to provide the samples of all the materials to be used in the execution of the work with the name of quarry for the design mix purpose for metalled road works. 40. The executing agency will be held responsible for any fault observed in the work for three years for the date of completion and the defects will be got rectified by the agency free of cost. 41. LED Street light is warranty for 2 year,T-5,28 watt street light fittings warranty one year extended warranty beyond 2 year for LED and T-5 fitting to be quoted by the firm. 42. The amount 10% of the work done will be detained fir two year as warranty of LED light or 10% bank guarantee is required for LED street lightning work as security for 2 year warranty. 43. If any dispute or difference of any kind whatsoever shall arise between the M.C. authorized representative of M.C. and the contractor in connection with or arising out of the contract, or the execution of the work i.e. (i) whether before its commencement or during the progress of the work or after its completion (ii) and whether before or after the termination, abandonment or breach of the contract, it shall in the first instance be referred to for being settled by the Executive Engineer-in-charge of the work at the time and Engineer-in-charge shall within a period of sixty days after being requested in writing made by the contractor to do so convey his decision to the contractor and subject to arbitration as hereinafter provided, such decision in respect of every matter so referred, shall be final and binding upon the contractor. In case the work is already in progress ,the contractor will proceed with the execution of works on receipt of the decision by the Executive Engineer-in-charge as aforesaid, with all due to diligence whether M.C. or authorized representative of M.C. or contractor requires arbitration as hereinafter provided for, or not if the Executive Engineer-in-charge of work has conveyed his decision to the contractor and no claim to arbitration has been field with him by the contractor within a period of sixty days from the receipt of the letter communicating and will not be subject matter of arbitration at all. If the Executive Engineer-in-charge of the work fails to convey his decision within a period of sixty days after being requested as aforesaid the contractor may within further sixty days of the expiry of first sixty days, after being requested, from the date on which request has been made to the Executive Engineer-in-charge request the Commissioner M.C. Panchkula that the matters in dispute be relevant to arbitration, as hereinafter provided.
