Call to Order

The quarterly business meeting of the voting representatives was called to order by President Ray Allshouse on October 17, 2019 at 8:00 a.m.

The President presented the proposed Agenda for the October 17-18, 2019, Fall Business Meeting.

The President presented the proposed Minutes for the WABO Annual Business Meeting on July 18-19, 2019.

MOTION: It was moved and seconded that the Minutes be approved as amended. The motion carried.

President’s Report

President Ray Allshouse reported on a proposed bylaw change regarding geographical representation on the International Code Council (ICC) Board of Directors that will be presented at the 2019 ICC Annual Business Meeting. Ray informed members of resources available to attend the Public Comment Hearings and announced the Technical Code Committee will be working on a voting guide to help assist members.

Executive Board Report

President Ray Allshouse provided an update on the Western Pacific League of Building Officials (WPLBO) candidate’s forum held August 2019. Ray announced that WABO sent an endorsement to ICC for a new Eastern WA Chapter recognition. Ray informed the members that the Oregon Building Officials Association (OBOA) is working with WABO’s TCD committee on code issues that are relevant to both states.

First Vice President

Kurt Aldworth reported on the OBOA Annual Business Meeting that he attended in August and discussed their meeting format, keynote speakers and overall experience. Kurt highlighted a veteran who is benefiting from the Region II Military Families Program.

Second Vice President

Kurt Aldworth provided Lee Kranz’s report in his absence. An update was provided on the status of the 2018 Washington Custom Codes. Group 1 should be available mid-February and Group 2 will have an anticipated release date of April 2020. Kurt reported on topics that were discussed at the Senate Bill 5795 Workgroup.

2 Executive Director

Tara Jenkins announced the meeting logistics to the membership. Tara thanked Stacy Criswell and Clark County for their coordinated effort in bringing the Clark County Interactive Trailer to the Fall meeting. Tara provided an overview of the WAsafe seminar that was held at Vancouver City Hall.

GUEST REPORTS:

International Code Council

Ray Allshouse provided a report from ICC Board of Director, David Spencer, in his absence. Dave reported the following:

• July ICC acquired NTA, Inc., a provider of testing, inspection, compliance, engineering and off-site construction plan review services. • The Code Council has completed the 2025 strategic planning process. • ICC continues to sponsor the Board Director Shadow Program and Ben Leighton from the City of Spokane was chosen to attend. • The National Institute of Building Sciences (NIBS) released a 2018 Interim Report that found adoption of the 2018 International Codes (I-Codes) generates a national benefit of $11 for every $1 invested.

Kraig Stevenson encouraged members attending the ICC Annual Conference to download the app which will help you schedule your itinerary. Kraig reported that Region II will be meeting on Sunday prior to the Annual Business Meeting. Kraig announced the release of an independent study that outlines economic benefits for communities that adopt the IPC.

Region II

Gary Schenk announced that Region II will be awarded the Region of the Year Award at the 2019 ICC ABM. Gary reported that WABO sponsored the Military Families program which will be a great succession program for the building departments.

IABO

Gary Schenk reported that IABO discussed the proposed ICC Bylaw change that deals with geographical representation at their last meeting. IABO will not support the proposed change.

WPLBO

Gary Schenk announced the WPLBO candidates’ forum that was held in late August went well. The next meeting will be held in February 2020.

3 Labor and Industries

Kelly Mayo from Factory Assembled Structures reported on HB1486 and delegation of authority for inspection purposes only. Labor & Industries is also launching a new tiny home website on November 2, 2019. If you have any questions the best way to contact them is via e-mail at [email protected].

State Building Code Council

Micah Chappell reported the council is still working through the Washington State codes, Group 1 is mostly done. The working documents can be found on the Council website. The State Building Code Council has funding for a new staff position which Richard Brown will hire in 2020.

MyBuildingPermit.com

Tom Phillips provided an update on enhancements to the MBP software dashboards, Phase One release date is February 2020. Phase Two 2020 workplan will focus on mapping and customer permit status. MBP has added new jurisdictions so they can staff another programmer. Tom also announced MBP training opportunities can be found on their website.

Liaison Reports

State Electrical Board

John Brickey reported the 2020 NEC will go in effect on July 1, 2020. John announced on September 1, 2019 a rule change regarding marinas to adopt the 2020 NEC provisions for ground protection for marinas. John stated his term on the Electrical Board ends July 2020 and informed the membership another representative needs to be appointed.

Chief Electrical Inspector Steve Thornton reported that L & I track permits in 5-year increments. The workload has increased each year, and nothing is indicating a slowdown or decline. Steve announced the virtual inspection is getting ready to launch and stated they can process 13-14 inspections a day versus 11-12 in the field inspections.

Construction Underground Economy

Gary Schenk reported the committee is trying to address contractors that are not licensed in the state. Labor & Industries has a new project ‘Protect My Home’ encouraging homeowners to hire smart. The public assumes if they hire a licensed contractor that they know what they are doing, which is not always the case.

Washington Cities Electrical Code

Kurt Aldworth reported the committee meets four times a year. The Washington amendments will be voted on in December and will be available in July 2020. Kurt reported Chris Jensen from UL conducted a 4-hour seminar for them and they are looking at more training opportunities this Spring and Fall.

4 Department of Children,Youth & Families

Mary Kate McGee reported a new rule from the department making a push for daycares in R2 dwellings. Currently, family home daycares are R3 and the department does not understand the issues/concerns of home daycares in R2’s. Please e-mail Mary Kate McGee who will be attending meetings with the state regarding this issue.

Reports – Standing Committees

Education Committee – Todd Blevins announced the 2020 Annual Education Institute schedule is complete.

Government Relations – Tim Woodard announced the need for volunteers for the government relations subcommittee.

Technical Code - Micah Chappell stated the TCD committee went over code changes and proposals getting items wrapped up for ICC and SBCC.

Outreach Services – Stacy Criswell announced that the WABO Education and Events page is not just for WABO training. Stacy stated the committee discussed the need for an English is a second language checklist and will be working on top ten phrases and encouraged Google Translate. Stacy encouraged all first timers to reach out to him – networking is a valuable tool.

Certification & Registrations – Brian Smith stated the Mass Timber subcommittee has 40-50 written exam questions completed. The committee is optimistic the new category will be ready before the codes go into effect. Brain stated that tip sheets and suggestions are always welcomed.

Accreditation – Andy Higgins provided an update on the COAP program. The 3rd quarter of the third year will finish at the end of this year and the first year has kicked off again. The committee is looking at the learning objectives and trying to add value and remove duplication. The committee is looking for volunteers, please reach out to Andy Higgins if interested. The committee will be looking at state licensing and accreditation in the future. Andy announced that the ACO program became part of his committee and highly encourages the membership to apply.

Emergency Management - Ray Cockerham announced that a WAsafe class was held in Vancouver. The WAsafe committee is working on a WAserv registration manual that will assist responders in getting established on the state database. The WAsafe committee is also working on rules of engagement that will help train coordinators.

Finance - Angela Haupt provided the membership with an overview of WABO’s first quarter financials.

Washington Association of Building Officials 2020 Legislative Talking Points

1) SHB 1337 Assault / Code Enforcement – Support a. This bill will add assault on a code enforcement officer to the list of “Aggravating Circumstances” and allow for sentencing above the standard range. b. Code enforcement officers are the vessel to carry out the laws set by the legislature and should be provided with a greater degree of protection while conducting the duty prescribed to them.

2) SB 6464 Building Code Membership – Oppose a. The State Building Code is comprised of a diverse group of representatives from industry to building code officials. This system has led to many compromises between the different groups represented. b. The stake holders on the board represent a technical working group of individuals allowing the process to progress rapidly. c. All current bylaws and rules are set up on the current system. This change would incur countless hours of administrative changes and debate about how best to handle the new number of individuals. i. On many occasions a quorum is narrowly met. If this change progresses this would make it even harder to meet the quorum requirement, leading to delays of implementation.

3) SB 6222 Comm. Property / clean energy / resilience – Support a. This bill allows for a voluntary system that jurisdictions can implement to provide low cost financing that is collected with the tax assessment for very specific circumstances. b. WABO supports this legislation because it allows owners an optional financing mechanism to complete seismic upgrades to a structure helping to mitigate risk in our communities.

2020 Position Paper

Bill Details and Talking Point Status Sponsor Position

Adult family homes, 8 beds S Health & Long T Macri Concerns Allowing certain adult family homes to increase capacity to eight beds.

ESHB WABO still has some concerns on this legislation. The Sponsor did add language requiring a 1023 sprinkler system and a requirement to comply with all local codes, as we requested, but the fear is the type of sprinkler system is not described and the State Building Code still defines “Adult Family Home” as a maximum of 6 beds.

Mobile food fire safety H Approps Peterson Oppose Standardizing fire safety codes for mobile food establishments. SHB 1134 WABO opposes this bill due to a local control issue. It is unrealistic to believe a mobile food truck inspected in Spokane and then moved to has had no changes and then if the local jurisdiction wants to do an inspection they have to do it on their own dime.

School safety planning H Cap Budget Pollet Neutral HB Concerning comprehensive school safety planning. 1245 WABO supports seismic retrofitting existing public buildings; however, delegation of public funding for such endeavors should be decided by the legislature.

Assault/code enf. officers H Public Safety Barkis Support SHB Concerning assault on code enforcement officers. 1337 WABO supports added protection for code enforcement officers.

Prof. licensing/military H Hous, Com Dev Leavitt Oppose Concerning professional licensing requirements for service members and military spouses.

WABO has concerns about all professional licensing automatically being given reciprocity. Consumer HB protections, like those we are trying to work into contractors licensing, could be lost if the state the 2303 contractor came from had less protections in place.

Building code/projects H Local Govt Blake Oppose

HB 2608 Addressing project review and approval under the state building code.

WABO is opposing this legislation due to the possibility for it to be abused. The requirement to cite a code section with each correction upon request may be abused by applicants / contractors making blanket requests for all corrections written.

Energy code/residential H Local Govt Chapman Oppose Increasing housing access and affordability by decreasing construction costs associated with implementing HB the Washington state energy code for residential buildings. 2667 WABO does not support having different codes on different tracks. All codes were already delayed one year and getting off track with code development cycles does not benefit our members.

On-demand gasoline providers H Local Govt Griffey Oppose Standardizing fire safety requirements for mobile on-demand gasoline providers. HB 2783 WABO opposes this on the same local control issues as the Mobile Food Truck bill. These types of services have site specific requirements. Not allowing a local jurisdiction the ability to regulate these takes away the ability to make sure they are operating in all locations code compliantly.

State building code council S Local Governme Brown Oppose SB Concerning the state building code council. 5634 WABO does not support getting off cycle with the ICC. This bill would extend code cycles to 5 years vs 3 years.

SB Comm. property/clean energy S Environment, E Lovelett Support 6222 Concerning commercial property assessed clean energy and resilience. (HB 2405) WABO supports expanding opportunities to building owners to finance seismic resilience projects.

Project permit timelines S Local Governmen Fortunato Oppose SB Concerning permit timelines. 6461 WABO opposes an unfunded mandate to set additional limits on project permit timelines.

Building code membership S Local Governmen Wilson Oppose Concerning state building code council membership. SB 6464 WABO opposes legislation that increases the number of people on the State Building Code Board. An increase in number would then require all current rules to be revised. In addition the diversity currently represented on the board is a group of individuals with working knowledge of the codes allowing for an efficient process.

2020 WABO Legislative Positions

• Funding for State Building Code Council: The Washington State Building Code Council (SBCC) is mandated by state law to develop the construction codes used in Washington and that effort requires adequate funding to accomplish their mission. WABO supports continued adequate funding for the SBCC and clarification for consistent fee application by local jurisdictions. • Protect Local Authority: WABO supports protecting local authority to amend, adopt and administer construction codes. • Code Cycle: WABO supports keeping Washington consistent with the national model code adoption cycle. • Consumer Protection: WABO supports measures to protect the public from unqualified and illegal contractors, such as requiring contractor training and education and establishing minimum qualification standards for contractors and Building Officials. • Electrical Code: WABO supports legislation that provides jurisdictions with equal authority to develop and adopt the Washington State Electrical Code. • Unfunded Mandates: WABO recognizes that jurisdictions have limited fiscal capacity and opposes unfunded and under-funded mandates. • Seismic Retrofit: WABO supports legislation to assist building owners to retrofit existing seismically vulnerable buildings, in order to protect the public during an earthquake from collapsing structures, and to reduce the impact of seismic events by focusing on promoting economic resiliency of our communities. • IPC (International Plumbing Code): WABO supports legislation to reduce barriers for jurisdictions to use the International Plumbing Code. • Certification and Training: WABO supports improving the efficiency of the construction permit and inspection process with training and certification for code officials and code technicians. • Adult Family Homes: WABO may support expansion of residents in Adult Family Homes as long as they are evaluated for fire, life, safety and health standards, including sprinklers. • Accessory Dwelling Units: WABO supports efforts to create more affordable housing as long as that housing complies with minimum building codes to ensure a safe built environment.
