2020/01/05 MINUTES OF THE LAST MEETING

The Minutes of the meeting held on 28th November 2019 were approved on the motion of Mr B Moreland and seconded by Mr J Milne.

2020/01/06 DECLARATIONS OF INTEREST

There were no declarations of interest.

2020/01/07 CO-OPTING A NEW MEMBER

The Chairman welcomed Mr Andrew Hall having invited him to become a co-opted Member. In accordance with procedure, the Chairman moved that he be appointed and this was seconded by Mr E Smith. Mr A Hall was happy to accept and the Members welcomed his attendance.

2020/01/08 MATTERS ARISING

8.1 2018/328/VCON – Section 42 application to vary the terms of condition 2 of the planning permission 2014/109/VCON Temporary Residential Accommodation, Sella Ness Industrial Estate, Graven, Mossbank, , ZE2 9UP – E-mail received from the Scottish Government and they have granted planning permission for this temporary accommodation until November 2025. Members are very disappointed with this decision and are questioning how long this can be called temporary with growing concerns about the negative impact this will have on local businesses in the north mainland.

8.2 School Transport Issue – The Chairman explained that the SIC are going to be meeting next week to discuss the bus contracts. He will find out if the Mossbank bus service can be re-instated to accommodate the school children.

8.3 Sparl Road, Voe – Deteriorating State – The Chairman said that there might be something happening with this at the end of the year.

8.4 Digital Highlands and Islands – Broadband Rollout – The Chairman said it may be 2023 before this comes to Shetland.

8.5 Defribillator Locations – Scottish Ambulance Service – The Chairman said people are to contact Mr M Duncan, SIC Community Planning and Development if they know of any new defribillators in the area and he shall liaise with the Scottish Ambulance Service. There is a big issue with defribillators not working properly, batteries need replacing sometimes and these are expensive.

8.6 High School – Children dropping litter into the burn near the school – ongoing.

8.7 Mossbank Play Park – Mr Magnus Malcolmson will be gathering costings for various works which will hopefully take place during 2020/2021 with a Mossbank toddler swing being one of these projects.

8.8 Da Knowe and Scarvataing Brigs and Little Ayre car park in – The Chairman said the new SIC Capital Programme should be discussed shortly and he will see if getting the brigs and car park in Muckle Roe improved are included.

8.9 House Numbers in Skelladale – sign – Mr N Hutcheson, SIC Roads Service has been going to put up a sign at Skelladale where the road branches since October 2018. The numbering in Skelladale is a bit random due to the houses being built at different times but this would reduce the options by half. Members reported this still hasn’t been done. The Clerk is to contact Mr N Hutcheson again. Clerk to progress.

8.10 Road Sign and white line road markers to Brae near Graven – ongoing.

8.11 Community Councils By-Elections – There are still three vacancies within .

8.12 Cattle grid barrier at Sandside – The Chairman confirmed the barrier has been fixed.

8.13 Shetland Community Benefit Fund – Mr B Moreland reported nothing much is happening with this at present until the money comes forward.

8.14 The Local Government Boundary Commission – Review of Electoral Arrangements – Delting Community Council organised a meeting in Voe on 16th December 2019 regarding the proposal for Voe to go with Nesting and Lunnasting. Members of the public were keen for Voe to remain within Delting. Following this, a letter has been received from Mr J Riise, SIC Corporate Services, he states that the SIC accepts the status quo remain for the Shetland North area. The Chairman said that the Boundary Commission have not made their decision as yet.

8.15 Public Toilets in Brae – Ms R Fraser said that the toilets will re-open in Brae.

8.16 Delting Boating Club – Bin for Dog Waste – The Clerk contacted Mr Brydon Sinclair, SIC Environmental Health to see if he can arrange a general litter bin or a dog waste bag dispenser to be placed outside the Delting Boating Club. He has responded, Environmental Health will check if they have any of the dog litter bag dispensers in their store and see about getting signage put up. If anyone wants to log complaints about dog fouling in the area, they can e-mail [email protected]. They might be able to relocate the bin near the old public toilet block, as its usage has decreased since the toilets were closed, to the Boating Club. Mr Billy Mycock, Environmental Health is going to ask the Neighbourhood Support Workers to keep an eye on that area more often.

8.17 Memorial Bench Request – The Chairman is dealing with this.

8.18 Ditching in Muckle Roe – ongoing.

8.19 Road Gritting in Muckle Roe – Ms J Dennison reported that gritting has been much better. The Chairman said the gritters have been shifted around to ensure the Muckle Roe road is getting gritted recognising the number of children using the road to travel to school. One downside is that the Mossbank road is getting gritted around 8am now.

8.20 Passing Place Signs in Muckle Roe – Members said there is more traffic on the Muckle Roe road with many none local vehicles and signage is needed. The Clerk received an e-mail from Ms J Johnson expressing her concerns with regards to the safety on the Muckle Roe road. The problem is getting worse and she has suggested getting arrows on the road to keep people to the left at all the blind corners. There have been near misses on the road with people not keeping to the left. She feels these arrows on the road would improve the safety. The Clerk is to invite Mr N Hutcheson, SIC Roads Service to the next Community Council meeting to discuss this. Clerk to progress.

8.21 Participatory Budgetting – ongoing.

2020/01/09 POLICE REPORT

The police reports for November and December 2019 were received.

In November there were 29 incidents recorded for Delting. 1 fraud – ongoing enquiries. 8 drivers charged with road traffic offences. 1 road traffic collision – no injuries. 1 assault – inquiries ongoing. 1 extortion – inquiries ongoing.

In December there were 22 incidents recorded for Delting 1 theft. 1 assault 1 theft by housebreaking. 1 vandalism. 1 driver charged for drink driving.

2020/01/10 PLANNING APPLICATIONS

2020/001/PPF – Erect dwellinghouse with garage and air source heat pump, west of Glengarth, Scatsta, Brae, Shetland, ZE2 9QP by Mr Stuart Henry – no objections.

2020/01/11 COMMUNITY WORK

Ms R Fraser told Members that Ms Anna Arnott is the new Community Worker for Delting and she will be starting her post next month.

2020/01/12 CORRESPONDENCE

12.1 TOTAL E&P UK Ltd – documentary at Mareel – this took place on 16th January. Members were unable to attend this.

12.2 Certificate of Employers’ Liability Insurance – this was valid from 21st December 2019 until the 20th December 2020.

12.3 Mossbank Hall – Grant Award – e-mail received from Ms J Grant, Secretary stating they are unable to raise the rest of the money required to purchase a dishwasher for the hall and can no longer accept the grant from the Community Council. They were awarded £1,500 for a new dishwasher on 29th June 2019. This was broken down as £1,000 from the Community Development Fund and £500 from the Community Council. If the money from the CDF is not spent by the end of March, the SIC can take the money back. Members are disappointed that the Mossbank Hall cannot raise the rest of the money for a dishwasher. The Clerk is to write to Ms J Grant. Clerk to progress.

Members discussed alternative ways to spend the money. The Clerk is to check with Mr M Duncan, SIC Community Planning and Development if the CDF £1,000 can go towards the Mossbank School’s polycrub. The Chairman will contact the Mossbank School about this. The £500 could go towards Mr S Laurenson clearing the burn at the head of Brae voe again before the end of March. Clerk to progress.

12.4 Voluntary Action Shetland – Invoice – They have sent the invoice for £25.00 for the annual membership. Payment approved.

12.5 Climate and biodiversity emergency – Letter received from Mr Philip Smith who is proposing planting trees on the open spaces at Moorfield Esate, Brae in recognition of the Climate and Biodiversity Emergency.

He has been in contact with Mr Paul Goddard of the Woodland team at Shetland Amenity Trust (S.A.T) and they can supply 100 trees for the initial stage of planting. These trees will be a mixture of Shetland native and others, e.g. Common Alder, Downy Birch, Alaskan Willow, Black Cotton Wood, Aspen and some Sitka Spruce for shelter. They require £1 per tree to cover expenses.

S.A.T is involved in the more woods croft woodland grant project on behalf of Woodland Trust , there is a large demand for trees with the Amenity trust growing approximately 6000 a year at present and it is possible for a community to get free trees from the woodland trust. These could be swapped with the Amenity trust trees, as these are Shetland grown which are tougher. The trees will be maintained by himself and his daughter at no cost to Delting Community Council.

Members have no objections to his proposal as long as SIC Housing have approved this. Mr J Milne said that Mr A Hall is testament to growing trees as he has grown 8000. The Clerk is to send a grant application form to Mr P Smith asking him to complete and return along with confirmation that the SIC have given him approval to plant trees in this area. Clerk to progress.

12.6 Viking Energy – Invitation – Letter received from the Viking Energy Project Team. They are inviting the Viking Wind Farm community liaison representatives to meet members of the project team on Tuesday 25th February at 7pm in the Whiteness and Hall. The main item will be the arrangements for building the Kergord access track that they are required to provide to meet a timetable set by SSEN Transmission, which needs access to construct its electricity convertor station at Upper Kergord. The Chairman is planning to attend this meeting.

12.7 Memorial Inspections – SIC Burial Services – E-mail received from Ms Yvonne Scott, SIC Estate Operations. All local authorities in Scotland have been instructed to carry out regular safety checks of memorials within their burial grounds. Over the coming months, SIC staff will be carrying out safety assessments at cemeteries and churchyards across the isles. Any memorial which fails will have a green safety notice placed next to it. If it is judged to be dangerous, it will need to be fixed.

12.8 Community Council – Draft Complaints Procedure – E-mail received from Mr M Duncan, SIC Community Planning and Development. This is scheduled to be considered at the ASCC meeting on 10th March and the deadline for feedback is 28th February. Members have no comments to make regarding this.

12.9 Review of Parliamentary Polling Districts and Places – Consultation – This was a review on the current polling district and polling place arrangements for the whole of Shetland. E-mail forwarded onto DCC as the closing date for comments was 6th January 2020.

12.10 Consultation on draft Sectoral Marine Plan for Offshore Wind Energy – this aims to identify the most sustainable plan options for further commercial-scale offshore wind development in Scottish inshore and offshore waters. There is going to be a consultation event at the Town Hall, Lerwick on Thursday 27th February. There is going to be an open information session from 13:00-17:30 and a presentation with a questions and answers session from 18:30-20:00 (Refreshments from 18:00). Any comments are required by 25th March 2020. The consultation is online at https://consult.gov.scot/marine-scotland/draft-sectoral-marine-plan-for-offshore-wind/ The Chairman said there is a possibility that offshore floating windfarms could end up in Shetland.

13.1 Funding information from Mr M Duncan, SIC Community Planning and Development

The Triangle Trust’s Development Grant programme focuses on the different stages of strengthening an organisation’s resilience. They are currently inviting applications from not-for-profit organisations working solely with carers within the UK. Grants may provide funds towards the core costs of organisations who have a strategic commitment to increasing their resilience. Grants should strengthen the organisation by further improving their future resilience. This might be a short piece of work needing investment over a few months or a more significant programme of work requiring dedicated support for up to three years. Scottish Natural Heritage has launched a new fund to celebrate the “Year of Coasts and Waters”. Plunge In! The Coasts and Waters Community Fund creates new opportunities for communities to connect with their coasts, seas and freshwaters. The fund offers grants between £2,000 – £10,000 for a wide range of imaginative projects for people and communities to engage in their own way. Nature Reserve Travel Grants of up to £500 are also available to allow groups of young people to connect with our coasts and waters by visiting one of Scotland’s many stunning national or local nature reserves. The Postcode lottery programmes are now open for bids.

Not for profit community groups and clubs can apply for between £500 - £2,000 and registered charities can apply for between £500 - £20,000 for a range of projects.

2020/01/16 ANY OTHER CURRENT BUSINESS

16.1 Streetlights in Maidenfield, Mossbank – Mr E Smith stated that the streetlights have now got LEDs and are still switched off at midnight every night. He had reported a light out at Maidenfield to the Council and this has not been fixed. The Chairman will look into this.

16.2 Kirkyard, Muckle Roe – The Chairman said the road to the kirkyard is full of potholes again. Ms J Dennison said the grass is long with a lot of weeds in the kirkyard and one of the gates needs a new catch. The Chairman will speak to Mr Kenneth Mackenzie, SIC Burial Services about this.

16.3 Security Light at the Sella Ness junction – Mr J Milne reported that whilst driving along the Sella Ness road and turning left at the junction, there is a very bright security light which is blinding to the driver. The Chairman will speak to Mr A McKimm about this and see if the light can be angled down.

The Chairman said that the challenge for Viking Energy and SSE is the contract of difference price that matches or betters offshore wind. The contract of difference bid will be in early 2019 and a decision taken in the latter part of 2019. At the present time, a planning application for the converter station at Upper Kergord and then a planning application for the road from Sandwater to Upper Kergord. If this goes through, the work could then begin in 2020 Apr 2018. Discussed Jun 2018. The Chairman said this is likely to be back if the finances are in the right place Sept 2018. The Chairman said that Viking Energy have been granted planning permission for the bigger turbines Feb 2019. Discussed Apr 2019. The Chairman said that the windfarm is still viable here without the Scottish Government subsidy and SSE can do this without borrowing money. The market is paying £38/MWh. They may want to walk away from the contract of difference and get the revised business plan to Ofgem. The transmission charges for each unit is horrendous here and it would be far better if the charges were the same as the charges in the north of Scotland. There is a high chance this will still go ahead Oct 2019.

The Chairman said that there have been more layers identified in the old kirkyard in Voe. A new kirkyard will be needed in Voe and Laxobiggin within the next 5-7 years. The Land Equisition 2017/18 – trying to get this in the Capital Programme Nov 2016. Discussed Feb 2017. A meeting with the Voe Community is needed sometime after the summer Apr 2017. The Chairman said that Anita Jamieson is going to attend the ASCC to speak about the Local Plan Sept 2014. The Chairman said that there is going to be a Consultation on HNDA – Housing Need & Demand Assessment May 2015. Ms Anita Jamieson is working on the Housing Need & Demand Assessment and this will be coming out soon. There will be more discussions with the community within the next 12 months. There is a need for more houses in Delting Aug 2015. The Housing Needs Demands Assessment (HNDA) will be coming out and, following that, the Local Housing Policy Oct 2015. The HNDA will be getting finalised before the summer recess Mar 2016. The HNDA is with the Scottish Government at the moment. The grant rate for Hjatland Housing Association is being increased. The SIC are giving £10,000 top up for some houses. This will be easier for Hjatland to build more houses Jun 2016.

3 Local Housing Policy – continued – The Local Housing Strategy will be in place before the end of the current Council. A bulk of the housing will be in the central mainland Sept 2016. The Chairman said that HNDA was sent to the Scottish Government which sets out evidence of housing demand both in the private and social sector. Questions were received, completed and returned. The Housing Strategy will hopefully be in place before the end of this Council in May 2017. This identifies the land for private housing and the social housing too Nov 2016. Ms Anita Jamieson has got the policies for Council housing in Shetland. A final version will be coming out Feb 2017. The Chairman hopes more young people get employment at Voe Terminal and more houses are built in Delting Apr 2017. Discussed Jun 2017. The HNDA will be coming out soon Sept 2017. The Strategic Housing Involvement Plan is going to the Development Committee next week Nov 2017. The Chairman will be able to give an update in the Summer. At the moment, Shetland should be building 60-70 new houses per year, but they are building approximately 20 less than this. Most new houses will be in Lerwick, but some will be in Brae Feb 2018. The Chairman said in Shetland there will be little done in the next few years for Hjatland SIC housing in Delting. More effort for insulation and reduce fuel poverty in next few years for social housing. In Delting more effort will be to build private sector housing. There are a lot of empty rented properties in Brae and some houses on the market Apr 2018. The HNDA has not been approved yet Jun 2018. The Chairman will continue to fight for housing in Delting Sept 2018. The Chairman said that the Scottish Government are trying to get starter homes which will make it easier for first time home owners. This is the best chance for something happening in Delting Feb 2019. Discussed Apr 2019. The Chairman reported that the SIC are waiting for the Scottish Government to approve the HNDA but realistically the bulk of the effort is going to be in Lerwick over the next while. If is going longer term, Enquest and Total may want to domicile staff which may encourage more low carbon, high insulated homes in Delting Jun 2019. The Chairman said by Spring 2020 the future of Sullom Voe Terminal will be clearer Oct 2019. The Chairman reported that at present the bulk of the housing (300 houses) is going to the Staney Hill in Lerwick. The likelihood of Delting getting new houses is slight unless the industry want to domicile the workforce in Shetland Jan 2020.

5 Reducing Speed Limits in Delting – The Chairman said that many places all over Shetland want the speed limit reduced to either 30mph or 40mph Oct 2019. This will be raised with Mr N Hutcheson, SIC Roads Service at the February meeting Jan 2020.

6 Local Energy Plan for Brae - The Chairman said that the final report is out Jun 2018.

7 Enquest attending one of the Community Councils meetings – They have been invited to attend a meeting Apr 2018. The Chairman said that Enquest need to sort out the site before attending a DCC meeting Oct 2019.

8 Brae Health Centre – Drinking Fountain - The Clerk received an e-mail from Mr Lawson Bisset, Head of Estates and Facilities, NHS Shetland. They are in discussion with the practice, their technical advisor and infection control in order to see how best to practically comply with our request May 2019.

9 Burraness Council Houses in Mossbank needing painting - A letter has been received from Mr Grant Gilfillan, SIC Housing Services. He confirms that due to an oversite in contract documentation the re-painting of these properties is now overdue. He will follow this up by including the re-painting of these properties in next years’ planned maintenance works Aug 2019.

10 Trees in Brae – Mr Billy Mycock, Antisocial Behaviour Co-ordinator got back in touch with the Clerk to say that he has spoken to the Head Teacher at Brae High School and they are not aware of branches being broken off the trees near the school since the schools have come back after the summer holidays. He is going to be at the school in September and will have a look and if there is any damage, he will arrange to do something Sep 2019.

11 Review of Streetlighting Reduction Policy – Wethersta Industrial Estate - SIC Roads Service has been instructed by the Environment and Transport committee “to consult with residents and others, as appropriate, with a commitment to reinstate the lights should that be the overall wishes of those affected residents”. The results of this consultation are then to be reported back to the Environment and Transport committee for a decision. Members are content for the SIC to contact the occupiers of the units at Wethersta Industrial Estate Aug 2019. DCC returned the survey stating they do not want to see the streetlighting reinstated at Wethersta Oct 2019.
