CAWV TO RELEASE JOBS STUDY TUESDAY, MARCH 3

An increase in highway funding would add millions to West Virginia’s economy, create thousands of jobs and enable the state to achieve economic growth, according to a study commissioned by the CAWV and APA of WV that will be released at a press conference Tuesday, March 3. The February 17 release date was canceled when members and the study’s author, Alison Premo Black, senior vice president and chief economist for the American Road and Transportation Builders Association, were not able to get to Charleston due to the winter storm. The ARTBA report will show an immediate boost to economic recovery by investing in West Virginia’s transportation infrastructure.

CAWV President Dan Flesher wants a large number of CAWV members to attend the press conference. It will be held Tuesday, March 3, at 12:00 p.m. in a conference room at the State Capitol (to be announced later). Members should be there by 11:30 p.m. Dr. Black will be presenting the report. We would like to have a good turnout of members since the press will be attending. Members will be encouraged to go see their legislators following the press conference. A copy of the report will be released to the press that morning. Plan now to attend the March 3 event.

GAS TAX REDUCTION BILL WOULD DROP WVDOH REVENUES BY 45 PERCENT

With three weeks left in this year’s 60-day legislative session, lawmakers are planning on working Saturday, and possibly Sunday, to get bills out of committee and to the floor for debate. The last day to introduce bills is Monday, February 23. Sunday, March 1, is the last day to get bills out of committee so they can be read three separate days. Wednesday, March 4, is the last day for a bill to pass in its house of origin. Saturday, March 14, is the last day of this year’s session.

A number of CAWV bills were discussed this week, many dealing with infrastructure funding. H.B. 2832, introduced today, reduces the retail gas tax from 20.5 cents per gallon to 20 cents per gallon and eliminates the variable tax on the wholesale price of gas, currently 14.1 cents per gallon. The effect would be to cut motor fuel revenues to the State Road Fund by about 50 percent. Last year, motor fuel taxes generated $440 million. At 20 cents per gallon, with each penny of retail gas tax generating about $12 million, revenue would be about $240 million, or a 45% drop. It is interesting to note the bill was not referred first to Roads and Transportation Committee. It has a single reference to Finance Committee. Also interesting is that the chairman of Roads and Transportation, , R-Mercer, is a sponsor of the bill, along with Dels. , , Larry Faircloth, Erikka Storch, , Mike Folk, Anna Border, Gary Howell, Roy Cooper and John Shott. The House Finance Committee passed a bill today to make a one-time $6 million transfer from the Racetrack Modernization Fund to the State Road Fund. The Governor’s bill to divert $11.5 million from the State Road Fund to help balance the general fund budget deficit, was on Second Reading in the Senate before it was sidelined to the Rules Committee.

Prevailing wage reform took center stage in the House Thursday in the House Chamber with a public hearing on S.B. 361 before the House Government Organization Committee. A number of contractors, including many CAWV members, and labor groups spoke in favor and opposition of repealing the state’s prevailing wage law. The committee is expected to take up the bill next week. Other labor related bills are being debated, including bills to prohibit government agencies from requiring a Project Labor Agreement (PLAs) as a condition of bidding work. S.B. 409 is being worked by a subcommittee of the Senate Labor Committee and H.B. 2377 is in House Government Organization Committee. On Thursday, Senate President Bill Cole indicated it appears the House will not have enough time to take up Right to Work legislation this year.

The Senate Finance Committee passed out H.B. 2213, the governor’s bill to divert $10 million from the WV Infrastructure and Jobs Development’s budget to help with the state’s budget problems. The bill only provides $30 million in excess lottery proceeds to the council for water and sewer projects. Last year, the governor cut the council’s budget 50 percent to help with the deficit. It was noted that the $10 million reduction, by not being able to match federal or local share funds, could affect $30 million to $40 million worth of water and sewer projects. This information will be communicated to Senate members.

CAWV CONGRESSIONAL FLY-IN SCHEDULED FOR APRIL 15

The 27th annual CAWV Congressional Fly-In will be held Wednesday, April 15. President Dan Flesher will lead the CAWV delegation to Washington, D. C. to meet with West Virginia’s congressional delegation on issues critical to the construction industry. “This will be a new venture in that West Virginia has two new representatives and a new senator,” President Flesher stated. Evan Jenkins is the new Third District Congressman who defeated Nick Rahall in the 2014 General Election. Newcomer Alex Mooney was the victor in the Second District Race to replace Shelley , who was successful in her bid to replace the retiring Sen. Jay Rockefeller. “It is important that our senators and representatives see us in their offices, meeting with them face-to-face, to discuss the issues that are important to our members,” said President Flesher. This year’s Fly-In will again be held in conjunction with the Transportation Construction Coalition (TCC) which will include hundreds of industry people who will urge Congress to complete action on a long-term transportation bill. AGC of America and ARTBA are co-chairs of TCC.

CAWV HOSTING BLOOD DRIVE AT EXPO IN MEMORY OF CYNTHIA SNYDER

The CAWV once again is sponsoring a blood drive in memory of Cynthia Snyder on March 25 and 26 at the Charleston Civic Center in conjunction with EXPO. Cynthia, who passed in 2011, was the wife of CAWV Past President Lee Snyder. The Cynthia Snyder Memorial Blood Drive will be held from 10:00 a.m. to 4:00 p.m. on March 25 and 9:00 a.m. to 3:00 p.m. on March 26. Over 110 generous donors resulted in 72 pints of blood last year. Registration for the CAWV State Meeting, being held March 25 at 7:30 a.m. at the Charleston Civic Center, is now open. SMALL BUSINESSES CAN ELIMINATE FILING FORM

Small businesses can now expense repairs without having to file a separate form this year. Please see the following supplied by Rollins, Cleavenger and Rollins.

Previously, the IRS enacted safe harbor regulations allowing businesses to elect to expense up to $500, and in some cases up to $5,000, per invoice under the new “tangible property repair” regulations. In order to take advantage of this safe harbor, businesses were required to file a Form 3115, along with certain other requirements. On February 13, 2015, the IRS announced in IR-2015-29 that small business owners were not required to file Form 3115 if they were choosing the simplified procedure for 2014.

Small businesses and sole proprietors with assets of less than $10,000,000, or average annual gross sales of $10,000,000 or less for the last three years, can now take advantage of not having to spend the time and money to file the Form 3115. Businesses will still need to file an election with its tax return and comply with other requirements in order to take advantage of the new rules. As each business is different, please consult with your tax advisor for additional information.

HUNTINGTON MAYOR UNVEILS $100M RIVERFRONT PROJECT

A 260-slip marina, boat repair and retail shop, boardwalk with shopping, and eventually even condominiums are part of a three-phase, $100 million investment for Harris Riverfront Park announced by Huntington Mayor Steve Williams. Williams unveiled the plan as part of his state of the city address. It’s a public/private venture with perhaps the unlikeliest of bedfellows in Huntington Marine Services, a company that had been embroiled in a legal battle with the city for the better part of two decades over the right to build a barge mooring facility in Westmoreland. The company assisted the city in removing the barge at Harris Riverfront Park which had been used as a stage for events in years past but had begun to leak and sink. Williams said during that time the company became optimistic about a development at the park. The mayor said the company had similar plans for a piece of riverfront property in Proctorville, Ohio, but had abandoned that project when anticipated federal funding fell through.

Mayor Williams said this new project will progress in three phases on a six- to 10-year timeline. Designs have yet to be unveiled, but the mayor said the length of the development will stretch well beyond 12th Street in the eastern direction and all the way down to 6th Street the opposite way. WINTER CONSTRUCTION SAFETY

Neither snow, ice, nor arctic wind will keep builders from building. This is a year-round industry that requires adaptations on the part of builders to accommodate the changing seasons. In most parts of the country, heating becomes a major issue for construction projects in the winter and portable heaters are generally the most viable solution. However, there are obvious safety concerns when using portable heaters and there is a potential for harm to the structure being built and the workers if they are not properly used. To avoid potential for heater-related mishaps, remind workers of these safety precautions:

 Have heaters inspected, tested and repaired if necessary by a qualified technician prior to heating season. Be sure to keep heater on a firm level surface, to keep it from tipping over.

 Do not use heaters in an area where they may easily ignite combustible materials (e.g., paint, paper or plywood). Do not place heater directly on plywood floor. Position it on a 4-foot by 4-foot square of fire-resistant drywall or cement board.

 Protect all hoses from physical damage and exposure to excessive heat. Avoid running hoses through all doorways, as a closed door will pinch the hose, thereby causing potential damage to the hose and improper gas flow to the heater. If a hose runs through a window, make sure to put a block on the sill to prevent the window from closing on and pinching the hose.

 Do not operate heater in an unventilated area. Always crack a few windows (on the second floor, or where possible) to evacuate excess accumulation of fumes and heat.

 Do not use site heaters in a manner for which they are not intended (e.g., cooking or warming/drying clothes).
