ABSENTEE BIDS An Absentee Bid form may be obtained by contacting the Auction Coordinator, Mary Lewis, by email at [email protected] or (615) 356-3031. If you wish to place an Absentee Bid, you may do so by submitting this bid to Mary Lewis prior to 6:00 p.m. on Monday, May 28, 2007. An Absentee Bid authorizes the 2007 Swan Ball to bid for you on one or more lots up to the maximum dollar amount you specify. The 2007 Swan Ball will purchase the lot of your choice for the lowest possible bid and never more than the amount you have authorized. Absentee Bids are a binding agreement to purchase. LIVE AUCTION AND LOGGIA AUCTION Lot 1 through 58 in the catalog will be auctioned by live bidding. Lot 59 through 81 will be auctioned in the Loggia on a silent bid basis. These lots will be closed and sold approximately 15 minutes after the conclusion of the Live Auction. SUCCESSFUL BIDS AND PAYMENTS We encourage buyers to pay for their purchase(s) the evening of the Auction. Conditions of sale require that bidder pay for their purchase(s) no later than June 15, 2007. After each lot is auctioned, the high bidder will sign a binding agreement to purchase their lot. Likewise, Absentee Bidder will be required to sign a binding Auction agreement to purchase their lot at the time they submit their bids to the Swan Ball Representative. In the event of any dispute between bidders, the Auctioneer shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the lot in dispute. If any dispute arises after the sale, the Swan Ball’s records shall be conclusive in all respects. All sales are final and are nontransferable for resale. Payment may be made by check, Visa, MasterCard or American Express. Please make checks payable to Cheekwood, The 2007 Swan Ball. Credit card sales after May 30, 2007 are subject to an additional 2% processing fee. All sales are final. Items may be removed from the Auction only by exhibiting a paid receipt. BUYER’S RESPONSIBILITIES Trips are sold as described in the catalog. All trips are to be taken during the time specified in the trip description. Special invitations are subject to the schedules of the hosts who have extended them and may not be available if trips are changed. When private homes are included, the property must be used only as and when specified, and returned in the condition in which it was donated. No long distance phone calls may be made from the residence. Private home trips are not transferable without the prior written consent of the donor. Any extensions or date changes are subject to availability and will be made at the buyer’s expense. Date changes may result in the loss of trip components and additional fees may be incurred by the buyer. Swan Ball trips cannot be exchanged for other destinations. There is no residual cash value of any component of any trip or item. If ticketed events are cancelled, tickets are not refundable or transferable. The Swan Ball reserves the right to make substitutions of equal value if circumstances pertaining to any portion of any component of the trip change due to events beyond the control of the Swan Ball. Taxes, ground transportation (including rental cars), international fees, internal air, gratuities and amenities are not included unless indicated. The Buyer is responsible for clarifying questions about any component of the trip prior to departure. Trip Coordinators will be listed in the buyer’s packet. Please book your trip as early as possible to avoid disappointment regarding availability. TRIP INSURANCE AND CANCELLATIONS Trip insurance is the responsibility of the buyer. The Swan Ball agrees to makes its best effort to deliver a trip as sold. In the case that a trip must be canceled or changed for reasons beyond the control of the Swan Ball, the Buyer agrees to select a comparably priced trip or a refund of the purchase price minus any expenses by the Ball. Cancellations due to a decision of the Buyer are not the responsibility of the Swan Ball and no refund will be made to the Buyer. Cancellation policies of each donor are binding. AIR TRAVEL AND ACCOMMODATIONS American Airlines tickets are coach class unless otherwise specified. Air travel is based strictly upon availability of promotional seating, which may affect your preferred schedule and limit the number of buyers who can fly together on the same flight. Accommodations are subject to availability. Accommodations are based on double occupancy. No AAdvantage miles can be earned from promotional tickets and no stopovers are allowed. You may not use your own AAdvantage miles to upgrade. Your trip will be planned with normal airline connections. Trips using American Airlines tickets must be taken by June 10, 2008 unless otherwise specified. Once tickets are issued, changes made to American Airlines tickets will incur an administrative charge of $100 per person. The Swan Ball is not responsible for any expenses incurred or inconvenience experienced due to the late arrival of a regularly schedule flight that causes a missed connection. Peak reservation demand days for international travel are Friday, Saturday and Sunday between the months of April and November each year. Although these dates are not blacked out, availability will be very limited. Business/First Class is guaranteed where stated on overseas flights; however, American Airlines cannot guarantee Business/First Class service from Nashville to points of international departure. Private air is subject to availability as determined by the donor and restrictions will apply in all cases. Due to weight and space restrictions, all oversize luggage including golf clubs, skis and large suitcases may have to be shipped separately at the expense of the buyer. Values are based on regular retail rates. Values by donor are exclusive of any promotions, discounts or specials.
