The Council of The District Municipality of Muskoka met in the Council Chamber, District Administration Building at 7:00 p.m. on Monday, April 18, 2016.

a) Scott Young, Executive Director Muskoka Conservancy Re: Introduction and Overview

THAT the request by Scott Young for leave to make a delegation/deputation with respect to the Muskoka Conservancy be granted.

Carried.

In answer to a question regarding the protection of Muskoka’s shorelines against phragmites, Mr. Young advised that the Muskoka Conservancy is going to be reestablishing partnerships with community groups and agencies on issues such as this and that they are very happy to see that the District is taking a lead role in dealing with the invasive plant. He said that the Muskoka Conservancy would be happy to work with any groups with common interests in preserving Muskoka’s environment.

Councillor Harding highlighted the minutes of the March 23, 2016 meeting of the Engineering & Public Works Committee.

Chair Klinck introduced the following motion:

THAT all recommendations contained in the minutes of the Engineering & Public Works Committee meeting No. PW-3-2016 held on March 23, 2016 BE ADOPTED.”

Councillors Aitchison and Young spoke out against the Committee decision to support the staff recommendation to deny the speed limit reduction on South Portage Road due to the discrepancies between operating and posted speeds; accident history and extenuating circumstances and also suggested that the Speed Limit Review Process Policy would require further analysis.

Through a written request, Councillors Aitchison and Young requested that Resolution No. R34/2016-PW be removed from the minutes to be considered separately. The motion is as follows:

WHEREAS Muskoka District Council adopted Policy PW-001-2016 (District Road Speed Limit Review Process) on February 16, 2016 which outlines the process to assess posted speed limits on District roads;

NOW THEREFORE BE IT RESOLVED THAT the request to lower the posted speed limit along Muskoka Road 9 (South Portage Road) between Muskoka Road 2 (Brunel Road) and Jo-Lee Point Road BE DENIED;

AND THAT staff be directed to request additional speed limit enforcement through the OPP.”

THE TOWN OF BRACEBRIDGE provided a resolution, which was passed at its March 15, 2016 Council meeting regarding the Town’s intent to pursue pulverization, base stabilization and asphalt work planned on Westvale Drive, McCrank Drive, Daniel Drive and Catharine Crescent in the Town of Bracebridge. 9. THE REGIONAL MUNICIPALITY OF PEEL provided Resolution No. 2016-144, which was passed at its February 25, 2016 Council meeting, regarding Ambulance Communications and Dispatch Services Advocacy. 10. HYDRO ONE advised of an investment of an additional $20 million this year towards improving service reliability for its customers in the District of Muskoka and Parry Sound. (Received April 1, 2016) (Referred to the Public Works department)

12. THE MINISTRY OF MUNICIPAL AFFAIRS AND HOUSING advised that the Province would be introducing legislation to Modernize Municipal Elections. (Received April 4, 2016) (Referred to the District Chair and CAO)

13. MINISTER McMEEKIN advised that the proposed Municipal Elections Modernization Act, 20016 was introduced in the Legislature April 4, 2016. (Received April 4, 2016) (Referred to the District Chair and CAO)

14. THE TOWN OF TILLSONBURG provided a resolution, which was passed at its March 29, 2016 Council meeting, regarding its support for the Zero Waste Initiative. (Received April 5, 2016) (Referred to the District Chair, CAO and Public Works department)

15. THE TOWN OF HUNTSVILLE provided a copy of Resolution No. 62-16 and accompanying Report No. MAYOR-2016-1, which was passed at its March 29, 2016 Council meeting, regarding healthcare in Muskoka. 16. LAURIE SCOTT, MPP HALIBURTON-KAWARTHA LAKES-BROCK requested support for and passage of a Council Resolution to call on the provincial government to take immediate steps to combat human trafficking in Ontario and to raise public awareness of this horrid crime. 17. TOWNSHIP OF PERRY provided a copy of a resolution passed at its April 6, 2016 meeting regarding its support for Town of Huntsville Mayor Scott Aitchison’s letter to the Minister of Health & Long-Term Care regarding a Muskoka Algonquin Healthcare Improvement Plan. MOTIONS

a) Distribution of Policing Costs

The following motion was proposed by Councillors B. Young and D. Furniss for Council’s consideration:

“Moved by B. Young and seconded by D. Furniss 77/2016

WHEREAS The District Municipality of Muskoka must distribute the cost of policing;

AND WHEREAS in prior years, these costs have been included in the general levy and allocated based upon weighted assessment;

AND WHEREAS it is well known that use of this methodology leads to an extremely prejudicial allocation of costs to the Townships far exceeding the known, actual Policing Costs, as provided in the OPP Annual Billing Statements for each municipality;

NOW THEREFORE BE IT RESOLVED THAT a Special Service Area By-law for OPP billing BE PREPARED in accordance with section 326 of the Municipal Act;

AND THAT the amount to be charged to each special service area levy be calculated by applying the percentage allocation by municipality as calculated from the billing statements provided by the OPP, to the District’s 2016 phase-in amount for OPP costs, excluding Court Security and Prisoner Transportation costs and grants;

AND THAT the Council of the District of Muskoka repeals By-law 2016-10 and DIRECTS STAFF to

prepare a new Tax Rate By-law which reflects the change to the OPP billing methodology, as proposed, for Council’s consideration at its May 16, 2016 meeting.”

Chair Klinck gave the mover and seconder an opportunity to speak to the motion.

Councillor Young advised Council that through his research, of the three municipalities across Ontario that do not use the OPP funding formula, the District of Muskoka is the only municipality that imposes costs to lower-tiers without their unanimous support and that the other two (Wellington; and Stormont and Dundas-Glengarry) pool the total cost of policing and put it on the tax levy, with the unanimous consent of its lower-tiers.

Councillor Furniss advised that prior to 2014 it was unknown what the costs for policing were until AMO demanded that there be accountability and transparency in this regard. He advised that the District of Muskoka saw the largest increase in Ontario and that the Townships pay 2/3 of the cost and use less than 1/3 of the service. He suggested that the allocation of policing costs follow the same methodology as solid waste.

Councillors responded with various comments for and against the proposed motion such as taxation based on weighted assessment; the actual calls for service and associated costs; solid waste methodology for cost allocation by municipality; the availability of services to all municipalities based on need regardless of location; Town/Township borders that receive the same level of service; and the basis for all services provided by the upper-tier being based on weighted assessment.

Councillor D. Smith suggested that the larger issue of governance needs to be reviewed and he and Councillor Terziano requested that the motion be referred to a Committee of the Whole Council meeting and that a larger discussion on governance should also occur. The following motion was then considered and defeated:

THAT Resolution No. 77/2016 be referred to a Committee of the Whole Council meeting to be called by the District Chair in order to further discuss the resolution and other matters of District governance.

Defeated.

Councillors discussed the need to start working better as a body and that perhaps the issue of policing allocation could be further discussed through the Policing Review Committee and review this again for the 2017 tax year.

Chair Klinck then called the vote on the main motion and a recorded vote was requested:

Defeated. b) Muskoka River Water Management Plan Ministry of Natural Resources and Forestry

Chair Klinck advised that the motion as proposed by Councillors P. Harding and P. Donaldson for Council’s consideration was amended slightly after the agenda was posted in order to include Seguin Township to the list of municipalities to be circulated.

Councillor Harding highlighted the proposed motion and displayed pictures of properties that had recently incurred damages due to water levels and shifting ice. He stated that the Muskoka River Water Management Plan does not currently work in today’s environment.

WHEREAS during the Spring of 2013, the District of Muskoka encountered severe flooding across the entire Muskoka River Watershed causing significant damage to municipal infrastructure and to personal property;

AND WHEREAS during the spring of 2016, Muskoka is experiencing water levels close to, if not exceeding, those seen during the 2013 “hundred year flood” which once again has caused significant uninsured damage to property;

AND WHEREAS the management of the Muskoka River Watershed is governed by the Province of Ontario, through the Ministry of Natural Resources and Forestry (MNRF) under the Muskoka River Water Management Plan (MRWMP), a plan established in 2006, updating the 1997 MNR Dam Operation Manual, updating the 1969 amendment to the 1940 Hackner-Holden Agreement;

AND WHEREAS the MRWMP according to the MNRF was due to be updated in 2016;

AND WHEREAS in April of 2016 the Township of Muskoka Lakes (“the Township”) received correspondence from the MNRF stating that while the MNRF is reviewing its Lakes and River Improvement Act, the Province will not be proceeding with amendment requests to the MRWMP, except in limited circumstances;

AND WHEREAS the Township was advised by Provincial staff that a 5-year extension of the current MRWMP is proposed, instead of the expected 2016 MRWMP update;

AND WHEREAS the Township passed the attached resolution C-16-15/11/13 on November 15, 2013 requesting the MNRF conduct an impact study of the high and low water zones contained within the MRWMP including identifying the physical limitations to the water flows including the overall benefits to lowering those zones during the periods of October – May annually;

AND WHEREAS the District of Muskoka further supported the Township of Muskoka Lakes resolution C-16-15/11/13 on November 18, 2013 at its regular Council Meeting through the attached resolution;

AND WHEREAS the Province, particularly through the Ministry of Environment and Climate Change (MOECC), recognizes that climate change is having significant impacts and cost implications for the people of Ontario as it devastates communities; damages homes, businesses, and crops; and affects municipal infrastructure not able to manage significant variations in weather, including record rain falls over short periods of time;

THEREFORE BE IT RESOLVED THAT the District of Muskoka requests the Province to immediately initiate a full review of the MRWMP to be completed by 2021 so that it may accurately address Ontario’s changing climate and the associated impacts on municipal and personal property;

AND THAT the provincial public consultation include, but not be limited to, all Municipalities impacted by the Muskoka Watershed; Muskoka Watershed Council; First Nations and Métis peoples; area lake associations and appropriate

community groups; and all those with personal, commercial or industrial interests who rely on the appropriate provincial management of the District of Muskoka’s shared natural environment and water system;

AND THAT through this consultation, the Province address the recommendations contained within the Township of Muskoka Lakes Resolution C-16- 15/11/13 to identify the limitations within the Muskoka River Watershed as well as prepare an impact study which considers the lowering of the MRWMP’s identified low water zones during the winter months;

AND THAT a copy of this resolution be circulated for support to all Municipalities impacted by the Muskoka Watershed; including but not limited to the Township of the Archipelago, Seguin Township and the County of Simcoe; the Right Honourable Justin Trudeau, Prime Minister of Canada; Ontario Premier Kathleen Wynne; Minister Bill Mauro, MNRF; Minister Glen Murray, MOECC; MP Tony Clement; and MPP Norm Miller.

UNFINISHED BUSINESS

a) Muskoka District Council Composition Report No. 5(2016)-1

Councillors discussed the report and there was a general discussion surrounding the optimum number of Councillors and several Councillors suggested that the total number could be reduced.

Councillor Young suggested that the Townships of Georgian Bay and Lake of Bays have its votes increased by one each to even the number of votes per municipality without increasing the number of Councillors. He also advised that he would have his Clerks’ department prepare a package to be sent out to each area municipality on how to move this forward.

Council requested that a report be prepared for the next Council meeting on the process that is undertaken at other Regional municipalities for electing or appointing its Chairs and what the costs might be associated with running for the position should the position be elected at large in the future. Staff was also asked to provide some additional clarity on the triple majority legislative requirement relative to any changes to District Council’s composition.

Councillor Giaschi-Pacini left the meeting at 10:05 p.m.

b) Strategic Priorities Review and Update Report No. 5(2016)-2

Chair Klinck provided a brief update on the next steps that will be taken in seeking agency and public comments on the draft Strategic Priorities document.

THAT the revised draft Strategic Priorities document dated April 2016 BE RECEIVED by Muskoka District Council;

AND THAT public and agency comments on the draft Strategic Priorities document BE INVITED to be received prior to June 20, 2016.

Carried. d) Temporary Closure of Muskoka Road 3 (Main Street) for the Muskoka Maple Festival Event in the Town of Huntsville Report No. 5(2016)-4

THAT The District Municipality of Muskoka BE AUTHORIZED to enter into an agreement, subject to the satisfaction of the District Solicitor, with the Huntsville/Lake of Bays Chamber of Commerce for the temporary closure of Muskoka Road 3 (Main Street) in the Town of Huntsville, between Centre Street and Muskoka Road 2 (Brunel Road) from 6:00 a.m. to 6:00 p.m. on April 23, 2016, for the Muskoka Maple Festival;

AND THAT the Commissioner of Engineering and Public Works BE AUTHORIZED to execute the agreement.

Carried. e) Proposed Central Ontario Alliance

Chair Klinck advised that the concept of establishing the alliance stemmed from the previous Provincial Liberal Government removing Muskoka from Northern Ontario. He added that through recent discussions with many municipal and agency colleagues; a decision was made to establish a “Central Ontario” alliance in order to focus efforts on common interests such as Health Units, hospitals, health hubs, schools, and economic development initiatives. He advised that he had already reached out to the County of Simcoe and City of Barrie and would be contacting the City of Orillia and that there was an interest in the concept of forming a group to fill the hole that currently exists tying these geographic areas together.

Councillor Aitchison added that some of these discussions have already occurred specifically surrounding healthcare and the lack of sufficient acute care funding and that he fully supports the concept of establishing the alliance with our municipal neighbours.

THAT staff, the District Chair and Muskoka Mayors be authorized to engage neighbouring municipalities in discussions surrounding the concept of establishing "Central Ontario" as a prosperous market area and brand in the eyes of the Provincial and Federal Governments.
