To help inform the discussion, please find attached a copy of a recent Phoenix Center paper entitled A Retrospective Analysis of Vertical Mergers in Multichannel Video Programming Distribution Markets: The Comcast-NBCU Merger. In this paper, Phoenix Center Chief Economist Dr. George S. Ford presents a retrospective analysis of the price effects of the Comcast-NBCU merger. In particular, Dr. Ford conducts an econometric analysis of data on the prices paid for programming by multichannel video programing distributors (“MVPDs”) before and after the transaction and finds no evidence that Comcast’s programming prices rose after the merger. The analysis covers general interest programming, news channels, and national and regional sports networks. Given these results, Dr. Ford concludes that there is either a lack of a net positive effect on incentives to raise programming prices above competitive levels following the vertical merger or that the behavioral remedies placed on the Comcast-NBCU merger were effective.

It provides a service area map that delineates the technical service area of WMDE in relation to the communities served by CoxCom’s cable systems in Fairfax County, VA (the “CoxCom Cable Communities”). NOISE-LIMITED SERVICE CONTOUR The technical service area of WMDE is defined by the noise-limited service contour where its signal strength is predicted to exceed the noise-limited service level.1 For VHF stations that operate on Channels 2 – 6 the noise-limited level is 28 dBu and the minimum field strength for principal community coverage compliance is 35 dBu.2 The map included as Figure 1 depicts the 28 dBu and 35 dBu service contours of WMDE, as determined using the standard F(50,90) propagation curves based on the licensed parameters in FCC File No. 0000001038.3 LONGLEY-RICE FIELD STRENGTH 1 The Commission treats a digital station’s noise-limited service contour as the functional equivalent of an analog station’s Grade B contour. INTRODUCTION 1. CoxCom, LLC, (the “Petitioner” or “Cox”), filed the above-captioned Petition seeking to modify the television market of WMDE (Channel 5) (Facility ID No. 189357), Dover, Delaware (“WMDE” or the “Station”) and exclude the cable communities that Cox serves in Fairfax County, Virginia (the “Communities”).1 The Petitioner states that Nielsen recently assigned the Station, but not its city of license, to the Washington, DC (Hagerstown, MD) Designated Market Area (“DMA”) at the Station’s request.2 The Petition is opposed by Western Pacific Broadcast, LLC (“Western Pacific”), the licensee of WMDE. Cox filed a Reply. Western Pacific later filed a Submission for the Record. Cox filed a Motion for Leave to File Reply to Unauthorized Pleading and a Reply to Unauthorized Pleading.3 For the reasons stated below, we grant Cox’s Petition. II. BACKGROUND 2. Auto Show TV Special Airs Saturday on NBC 4 The 2021 Washington, D.C. Auto Show Special is airing this weekend, showcasing new vehicles from several major automakers in a fast-paced half-hour television showcase. The show will air at 12 p.m. on Saturday on NBC 4, and will also air four other times on Telemundo 44 and NBC Sports Washington over the course of the weekend. In addition to the flagship airing at 12 p.m. on Saturday on NBC 4, the program will also air at 6 a.m. on both Saturday and Sunday on Telemundo 44, and at 11 a.m. Saturday, and 11:30 a.m. Sunday on NBC Sports Washington, meaning the show will reach cable viewers across the Mid-Atlantic. The TV special is hosted by Kimatni Rawlins of Automotive Rhythms, the organization that puts together the show’s ever-popular ART-of- Motion exhibit. Late last month, Rawlins and the NBC 4 production team traveled to the Walter E. Washington Convention Center to film several segments for the show, including an interview with Genevieve Cullen of the Electric Drive Transportation Association. Rawlins and Cullen discussed many of the exciting new developments in electrification that are on the market, or coming soon, while educating viewers on some of the high-level details of how EVs are built and operate.
