Implementation of the Directive 2011/77/EU: Copyright Term of Protection STUDY Requested by the JURI committee Implementation of the Directive 2011/77/EU: copyright term of protection LEGAL AFFAIRS Policy Department for Citizens' Rights and Constitutional Affairs Directorate General for Internal Policies of the Union PE 604.957 - April 2018 EN Implementation of the Directive 2011/77/EU: copyright term of protection STUDY Abstract The objective of this study, commissioned by the European Parliament’s Policy Department for Citizens’ Rights and Constitutional Affairs at the request of the JURI Committee, is to examine the current status quo of implementation of the Directive, and to carry out an in-depth review of the practices in selected Member States. The study provides a brief overview of the international framework concerning the term of protection for performers and phonogram producers, and analyses the main objectives and provisions of the Term Extension Directive. It explores in-depth the implementation and practices in seven selected Member States, and identifies best practices that can serve as a model for other EU Member States. In addition, the long term effects of the Directive are considered, both within the EU (in relation to relevant EU policies) and outside the EU (in relation to its main trading partners). For that purpose, the Study provides a brief overview of the background of the term extension. At the international level, several legal instruments regulate the duration of protection for performers and/or phonogram producers, including the Rome Convention, the Phonograms Convention, the WIPO Performances and Phonograms Treaty (WPPT) and the TRIPS Agreement. The protection term set forth in these treaties varies between 20 and 50 years (counting from the performance, fixation or publication, depending on the instrument). These treaties only apply to performances fixed in phonograms, and do not address audio-visual performances. At the EU level, the Impact Assessment accompanying the Proposal for a Term of Protection Directive clarifies that the specific policy objectives underpinning EU intervention must contribute to enhancing the welfare of performers and the competitiveness of the EU music industry, and to increase the available music repertoire. Regarding performers, the Commission considered that they needed extended protection to secure income at the end of their lifetimes, and that certain mechanisms were required to strengthen their position in contracts with phonogram producers. In what concerns producers, the Commission noted their decreasing revenues and their disadvantage vis-à-vis their US counterparts. The different provisions in the Term of Protection Directive 2011 were adopted with the aim of addressing these concerns. The central measure of the Directive is the extension of the protection term for performers and phonogram producers. For the former, if the performance is fixed in a phonogram lawfully published or lawfully communicated to the public within 50 years, the rights shall expire 70 years from the date on which such event took place (whichever is the earliest). For the latter, if the phonogram is lawfully published within 50 years, their rights shall expire 70 years from the date of such event.     15th Anniversary of " All You Need Is Luv " article posted on May 8th 2009 In 1994, LUV' gave their public what they had been waiting for years: a studio album with new material. Actually their last to date. What a beautiful gift but it turned out to be a failure! It could have been succesfull with a better promotion and management. At the time, some songs were close to hit potential but the horrible CD design as well as a bad distribution deal killed everything. Album history In 1993, the original trio ( José , Patty and Marga ) made a wonderful comeback. Their "Luv' Gold " compilation sold honorably in the Netherlands and Flanders (Belgium). They regularly toured the club and gay circuit (not only in Benelux but also in Germany and Denmark) and made appearances on TV. The press also paid attention to their reunion. After that, the fans were hoping for an album with new songs. It happened in early 1994 with the release of the " All You Need Is Luv " CD (named after a cover version of The Beatles classic " All You Need Is Love "). All the ingredients to have a hit record again were put together but the album suffered from a bad strategy. * Recording : Experienced and talented producers worked on the project: Piet Souer and Martin Duiser assisted by Koen van Baal supervised the recording sessions. Souer is familiar to the admirers of the group as Hans van Hemert and him wrote the whole Luv' repertoire in their heyday. Duiser was an acclaimed artist because of the world famous Stars on 45 records.

Auden, de componist Benjamin Britten en hun beider biograaf, Humphrey Carpenter. De repetitie verloopt verre van vlekkeloos. De regisseur heeft tot ergernis van de bij de repetitie aanwezige auteur van het stuk een aantal passages geschrapt. Twee toneelspelers zijn niet komen opdagen en er bestaat verwarring over de aanwijzingen in de tekst. Vooral de acteur die de biograaf speelt, heeft het moeilijk. Hij vindt dat hij een veel te kleine rol heeft. Hij klaagt dat hij niet veel meer is dan een ‘ding’, en verzint van alles om zijn personage meer cachet te geven. In de tweede act komt hij op in vrouwenkleren en met een tuba om zijn hals. Daarmee wil hij Carpenters veelzijdigheid tot uitdrukking brengen. Als dat niet helpt probeert hij zichzelf, zijn collega's en de auteur ervan te overtuigen dat hij op het toneel moet blijven, ook als hij geen tekst heeft: ‘Ik spreek niet. Mijn aanwezigheid spreekt. Dat helpt, denk ik. Dat helpt jullie toch?’ The Habit of Art kan als een literaire catalogus van biografie-problemen worden gezien, of als een beknopte geschiedenis van het genre. In zijn verantwoording laat Bennett weten dat hij Carpenter niet helemaal tot zijn recht heeft laten komen, of beter, niet zoals diens weduwe dat graag had gezien.

José Hoebee appeared in a parody of Patty Brard 's wedding with The Mask (see news posted on April 30th and April 25th 2009). source: Kijk Onderzoek Irene Moors as Patty Brard on "TV Kantine" 1 Hans van Hemert to launch a new LUV' act? news posted on May 4th 2009 A strange issue has been discussed in the Dutch media since April 29th. Record producer Hans van Hemert would launch a new LUV' act without the original members. He would recruit younger singers. The maestro, who conceived the whole LUV' concept, has the right to do it as he holds the copyright on the name of the formation. However, he hasn't confirmed the news yet on his website. According to De Telegraaf , the ladies are not amused. Patty Brard has told the newspaper that Hans might be angry because of the divas success without him. Van Hemert has complained about what he has considered as "small royalties" for the latest compilations and the DVD whereas the trio has been well paid for their performances between 2006 and 2008. Moreover, Marga Scheide (who has been part of all the trio's line-ups) also owns the copyright on the group's name. Does it mean that there will be lawsuits like Boney M. (whose legal rights to the name have been a matter of controversy between Frank Farian and the band members)? Hopefully not....

Line-up : José Hoebee-Van Den Wijdeven (1977-81, 1993-94) Marga Scheide (1977-81, 1989-92, 1993-94) Patty Brard (1977-80, 1993-94) Ria Thielsch (1980-81) Diana Van Berlo (1989-92) Michelle Gold (1989-90) Carina Lemoine (1990-92) BIOGRAPHY 1976 : Luv' is founded by producers Hans van Hemert , Piet Souer and manager Han Meijer . Van Hemert 's idea is that of three fresh, spontaneous and good looking girls who sing cheerful and simple disco songs. He wants the band to consist of a redhead, a blonde and dark- haired girl, so that everyone can relate to them. They already have a song so all they have to do is find the right girls to sing on it. Souer and Van Hemert know of three girls who would be perfect: Marga Scheide , Patty Brard and José Van Den Wijdeven . 1977 : The single My Man is released and gets fairly good reviews. Its successor, Dream, Dream , on the other hand does not and it seems 1 this will be the end of Luv' . 1978 : U.O. Me is Luv 's breakthrough and reaches the number three spot in the Dutch charts. Not long after that both You're The Greatest Lover and Trojan Horse reach the number one spot. Both singles and the album With Luv' become platinum in the Netherlands.
