Due to the current Coronavirus pandemic, the Parish Council met virtually via Zoom

P29/20 TO APPROVE AND SIGN THE MINUTES OF THE MEETING OF THE PLANNING COMMITTEE HELD ON 20th MAY 2020 It was resolved to approve the minutes of the meeting held on the 20th May 2020 were confirmed and accepted as a true record of the meeting, proposed by Cllr John Boyes seconded by Cllr Joanna Battle and carried.

P30/20 TO RECEIVE QUESTIONS FROM MEMBERS OF THE PUBLIC This meeting was advertised as a virtual meeting with the details of how the public could participate on the agenda. No questions were asked.

P31/20 TO RECEIVE ANY UPDATES REGARDING ACTIONS FROM THE LAST MEETING OR ANY OTHER GENERAL UPDATES FOR INFORMATION ONLY The replacement light in Valley Close has been installed. The requested shield is not Clerk in place and the electrical safety certificate has not yet been received. This light needs to be added to the HCC inventory list and management contract.

The Community Centre Car park has been fitted and is currently on a timer to turn off at 10.15pm.

Conversations continue with the freeholder of the Co-operative store about the two Clerk lights at the front of the shop which do not work.

The Clerk has been approached regarding the area of the land to the rear of Clerk Blackthorn Green and St Vigor Way in regard to dumping of foliage.

The Clerk has submitted a series of applications for approval of works to Parish Council owned trees under tree preservation orders.

A request has been made from a resident requested that the Parish Council ask City Council to place a tree preservation order on the trees in gardens at the end of Vears Lane from 1 Dove Cottages to Bramblewood. Clerk Parish Councillor supported the Parish Council writing to Winchester City Council to ask them to protect this area of land with tree preservations orders. If an order is considered, a full public consultation period will take place as part of the process.

Knights Brown the contractor working on the school, has written to give an update on the school development. Unfortunately, due to the current pandemic the site had to close for short period of time, we are now back on site & working towards completion of mid July 2020.

P32/20 TO RECEIVE A 3-MINUTE PRESENTATION FROM KATE CHAPMAN, SENIOR PLANNER, GILLINGS PLANNING ON PROPOSALS TO REPLACE THE QUEENS HEAD PUBLIC HOUSE WITH A CARE HOME Kate Chapman talked the Parish Council through the live pre-application that is taking place with Winchester City Council regarding change of use of the Queens Head pub on Portsmouth Road to a 60-bed care home. Pre application talks with Winchester City Council have indicated that a change of use in principle is acceptable. Kate talked to the Parish Council about how the proposed design had evolved. The team will now be working toward a high-quality design and it is hoped that an application will be submitted later in the year.

A member of Frontier estates team highlighted that the Queens Head has struggled with viability and finds it hard to compete with the next door Fishers Pond which benefits from the lake aspect to the rear of the building.

P36/20 TO CONSIDER THE REPRESENTATION ON THE FOLLOWING PLANNING APPLICATIONS AND ANY OTHERS WHICH MAY BE RECEIVED AFTER THE AGENDA IS PUBLISHED

20/01087/TPO Trellissick Upper Moors Road SO50 6HW, Light crown raise The committee agreed that as the tree on Upper Moors Road is highly visible and has high amenity value. The committee asked the Clerk to e-mail the tree officer in relation to the proposed re-trenching to understand what this means. The Clerk to feedback any comment from the tree officer prior to a representation.

The Committee has no concern over the proposals to the tree in the rear garden as the final wounds of the tree are small at 150mm, proposed by Cllr Glasspool and carried.

20/00960/HOU 22 Oak Tree Close 5m Single storey extension The Committee noted the potential impact to the rear garden and how this application may affect the neighbouring properties. The Clerk to drop letter to the neighbours to ask for any comments and feedback to the Planning Committee prior to a representation. Proposed by Cllr Hill, seconded by Cllr Glasspool and carried. Comments close on the 6th July.

20/00829/HOU 18 Hack Drive Amended plans The amended plan shows an increase in the height of the rear fence. Neighbours will be notified about the proposed fence height and will have the opportunity to comment, therefore the Committees previous comment remains unchanged. Proposed by Cllr Maggie Hill, seconded by Cllr John Boyes and carried.

P37/20 TO PROVIDE ANY UPDATE AFTER THE PARISH COUNCILS DECISION TO NOT ACCEPT THE TERMS OFFERED BY TAYLOR WIMPEY TO ACCEPT OWNERSHIP OF STRATTON’S COPSE Cllr Jackie Porter, Winchester City Council Councillor has had a virtual meeting with representatives from Taylor Wimpey.

Cllr’s Izard, Hill and Veck received an update from Cllr Porter via Zoom. Taylor Wimpey’s have indicated that they would be willing to remove the Ash trees from the woodland prior to the land transfer if terms of a transfer can be agreed.

The Parish Council indicated that they wanted a guarantee income to take on the woodland. The mast income has been reduced due to Taylor Wimpey renegotiating the lease for the mast in the development due to the additional houses built in this area. Taylor Wimpey indicated that the Parish Council did not object to the additional houses which they do not, but the Parish had no indication that this would affect the mast income or prior notice that this change in the lease agreement would affect potential revenue.

The Parish Council had received in writing confirmation from Stuart Dunbar-Dempsey that public open space of this size would normally attract a commuted sum of £256,000, but WCC considered that management of a woodland would reduce this figure to £137,500. This was fed back to Cllr Porter.

Taylor Wimpey have indicated that as the Parish Councils preferred supplier of the boardwalk is £30,000 more than the original supplier. As such Taylor Wimpey expected any negotiated commuted sum to be reduced by £30,000. The Parish Council stated that they would not agree to a reduced sum on this basis, as the boardwalk originally offered was not fit for purpose in the council’s opinion.

As management of the woodland is not within the scope of the pre-existing management company, Taylor Wimpey do not have a desire to set up a new agreement to manage the woodland.

The Council reiterated that financial agreement was not the only matter to be resolved and other matters specifically detailed in the S106 have not been agreed such as the access, fencing and concerns over water from the site draining in the ditches and then overflowing into the SINC woodland.

Cllr Porter will continue discussions with Taylor Wimpey

P38/20 TO UPDATE ON THE PRE-SUBMISSION CONSULTATION ON THE VILLAGE DESIGN STATEMENT The Clerk has only received 5 replies to the pre-submission consultation of the village design statement.

It was agreed to redraft a document to encourage participation for the information system and direct e-mail village groups, organisations, and the PTA of the school to directly appeal for participation. The Clerk to ask the CCCC if she can print the document and place in the Centre porch windows and signpost people to view it.

It will also to be advertised on the village noticeboards.

P39/20 TO DISCUSS THE POOR SURFACE OF FOOTPATH 15 AND UPDATE ON CONVERSATIONS WITH COUNTY COUNCIL IN THIS REGARD The surface of footpath 15 was discussed at length. Even after such a dry Spring wellington boots are required to walk the lower section of the footpath.

A discussion took place on whether the water main could be leaking and if water coming from Sandyfields could be adding the issue. The Clerk has written to Southern Water asking them to investigate.

It was agreed that this footpath is extremely valuable to leave the village and walk into the South Downs National Park. The Clerk to continue talking to Hampshire Rights of Way in respect of remedial works such as ditch works.

P40/20 TO REVIEW AND UPDATE IF REQUIRED THE PLANNING COMMITTEE TERMS OF REFERENCE AND RECOMMEND ANY CHANGED TO FULL COUNCIL FOR ADOPTION The terms of reference for this committee were discussed and it resolved to that the proposed changes are recommended to the Parish Council for adoption as attached to these minutes, proposed by Cllr Maggie Hill and carried.

P41/20 TO CONSIDER ANY MATTERS FOR THE AGENDA FOR THE NEXT MEETING Communication from HCC regarding village Bus Shelters and bridleway 13

P42/20 TO RESOLVE TO CLOSE THE MEETING TO MEMBERS OF THE PUBLIC TO DISCUSS UPDATE ON ENFORCEMENT ACTION IN THE VILLAGE AND ALLEGED BREACHES OF PLANNING POLICY No public were present, no resolution was made.

P43/20 CONFIDENTIAL SESSION TO DISCUSS ANY REPORTS OF ALLEGED BREACH OF PLANNING WITHIN THE PARISH TO RECEIVE ANY UPDATES FROM WINCHESTER CITY COUNCIL ON PLANNING, DEVELOPMENT AND CONTROL ENFORCEMENT WITHIN THE PARISH A report received from Parish Council on alleged breach of planning permission was discussed by the Committee which will be forwarded to Winchester City Council.

A report has been received from a resident regarding alleged breach of a planning condition on Piping Road. The Parish Council have no concerns about this alleged breach, and this will not be reported to Winchester City Council.

Structure of the Committee

The Planning Committee is constituted as a Standing Committee of Colden Common Parish Council.

The Committee composition shall be a minimum of six Councillors as voting members with three members of the Planning Committee constituting a quorum.

The Chairman and Vice-Chairman to be elected annually by the Committee.

The Chairman shall have the casting vote in the case of an equality of votes and may exercise his casting vote whether or not he gave an original vote.

Delegated authority

1.0 Planning Matters

1. Record of all planning applications, the responses and eventual results shall be noted in the minutes of meetings.

2. The Committee has delegated executive powers to consider all planning applications pertaining to Colden Common Parish and to respond to Winchester City Council Planning Authority.

3. In the event of WCC being unable to permit an extension to the expiry date for comments on an application, the Parish Clerk shall under delegation powers make an

representation on behalf of the Parish Council after seeking comments via e-mail from members of the Planning Committee and submitting a majority view as per normal voting procedures.

4. The Village Design Statement shall have prominent consideration on any comments made on the applications.

5. The Planning Committee may make general enquiries about applications to assist with fair determination of applications. The Committee has an obligation to ensure that relevant parties are given an adequate hearing – applicants, as well as objectors, will have the opportunity to speak at meetings in accordance with the Parish Council Standing Orders.

6. The Planning Committee have delegated powers to represent the Council on all planning applications. All agendas will be distributed to the Full Council and any two Parish Councillors may request any application be deferred for a meeting of the Full Parish Council for determination.

7. Where an on-site meeting is arranged, it will be subject to the prior approval of the Chairman or Vice-Chairman. A Committee member will then present findings to the Committee.

8. Where an application is subject to an appeal, the Committee is authorised to make written representation and the Chair or Vice Chair of the Planning Committee will attend the hearing or nominate another Councillor as representative in accordance with our communications policy.

9. To comment on any development outside the Parish settlement boundary which may have an impact on Colden Common.

10. The Committee will consider all matters relating to the preservation of trees and report accordingly to the Planning Authority.

11. To comment on drainage problems, in consultation with the Highway Authority and Southern Water

12. To make representation to the higher tier authorities on behalf of Colden Common to secure Section 106 funding and / or Community Infrastructure Levy investment where possible

13. To take the necessary action to refer enforcement matters to the relevant tier authority and to pursue such matters until a resolution has been reached.

14. To comment on matters relating to the provision of Gypsy and Traveller sites

15. To liase with the Southern Down National Park authority

16. All correspondence shall be conducted through the Clerk of the Parish Council.

17. The Committee will recommend to the Full Council new road names to submit to Winchester City Council

18. The Committee has delegated authority to work with the City Council Local Plan 2036, keeping the Full Council informed. Any decisions in relation to preferred sites (if appropriate) will be approved by Full Council.

19. The Committee will lead the review of the Parish Council village design statement, the final document to be approved by Full Council prior to submission for adoption.

2.0 Highways, Lighting and Transport

20. The Committee has delegated powers to manage all matters in respect of Highways, lighting, rights of way, speed watch, speed limit reminders and the car park at the Community Centre.

21. To consider the effects of developments on the public transport system.

22. To review and comment on car parking areas in order to ease the congestion in the village in consultation with the higher tier authorities and other interested bodies.

23. To actively liaise with the relevant departments at the higher tier authorities in all matters related to planning and highway issues and cycleway matters

24. To consider and formulate a response if appropriate on highway and transportation consultations and information documents from relevant authorities and organisations.

25. Minutes of all meetings are to be kept by the Clerk and forwarded by e-mail to members of the Parish Council.

26. The Committee will schedule a monthly meeting to review applications as required.

27. All members to attend a planning training session within a year of appointment and further training at least every four years.
