Questions for Oral Answers and Their Replies” 1 (14th Session) NATIONAL ASSEMBLY SECRETARIAT ———— “QUESTIONS FOR ORAL ANSWERS AND THEIR REPLIES” to be asked at a sitting of the National Assembly to be held on Friday, the 13th September, 2019 6. *Nawab Muhammad Yousuf Talpur: (Deferred during 13th Session) Will the Minister for Energy (Power Division) be pleased to state: (a) the method and manner through which present Chief Financial Officer (CFO), Hyderabad Electric Supply Company (HESCO) was elevated from BPS-17 to BPS-18 in 2013; (b) the date of meeting of promotion/induction board and its composition; (c) the length of service required for promotion from BPS-17 to BPS-18 and the length of service at her credited at that time; (d) whether her name was included in the seniority lists of officers of BPS-18 by Pakistan Electric Power Company (PEPCO); (e) the reasons for modifying criteria for appointment of CFO, HESCO in advertisement published on 13-01-2018 as compared to the advertisement of 21-06-2016; (f) whether modified criterian conditions were vetted by PEPCO and Power Division; (g) whether Audit Para No.91(7/2011 to 06/2012) is still outstanding against her; 2 (h) what were the basis for giving her hefty pay of Rs.500,000/- per month as CFO; and (i) the reasons for extension of her contract period from initial one year to three years within three/four months of her joining as CFO? Minister for Power Division (Mr. Omar Ayub Khan): (a) She was offered appointment as D.M (Tariff) in the light of approval of the BoD HESCO in its 90th meeting held on 02­3­2013 on regular basis in the office of F.D HESCO. (b) No promotion board was Constituted. However HR Committee of HESCO BoD thoroughly interviewed to examine her potential and expertise and BoD Finally approved her induction as DM (Tariff) through Agenda point No. 04 in its 90th meeting held on 02­3­2013. (c) Minimum 05 Years service required for promotion in BPS­17 to BPS­18. 09 Years 05 Months 18 Days Service at her credit. (d) No. (e) The BOD HESCO in its 119th meeting dated 04­6­2016 under Agenda item No. 05 approved the draft advertisement. which was prepared by Admin & HR Director, HESCO for appointment of Chief Executive Officer, Chief Financial Officer, Chief Internal Audit, Legal advisor and IT Consultant in HESCO and the same advertisement was published in the Newspapers on 21­6­2016. Later, on the directions of Ministry of Water and Power, the revised criteria for the post of Chief Executive Officer, Chief Financial Officer, Company Secretary and Head of Internal Audit was prepared and submitted by the Admin & HR Director, HESCO in its 124th BOD meeting dated 12­11­2016 for approval. Accordingly’ revised criteria was approved by BOD HESCO. However further process for appointments could not be finalized due to the absence of required No. of candidates. It is added here that under Agenda item No. 13 the permission for re­advertisement of post of CFO with revised age limit of 35 to 50 years on 3 initial contract of one year, was placed before BOD by the then Admin & HR Director HESCO in its 134th meeting dated 16­10­2017, subsequently the BOD HESCO accorded approval for re­advertisement of the post of CFO with revised age limit in 138th BOD meeting dated 02­01­2018 at Addl. Agenda item No. 02. Thereafter, the advertisement for the post of Chief Financial Officer and CIA was published in Newspapers on 13­01­2018). (f) Modification in criterion with regards to age limit of 35 to 50 years on initial contract for one year was sought by Admin & HR Director, HESCO, through BOD in its 134th meeting dated 16­10­2017, which was subsequently granted by the BOD in its 138th meeting dated 02­1­2018. (g) Audit Para is still unsettled. (h) The lump sum pay package amounting to Rs. 500,000/­ per month was assessed and allowed by the BoD HESCO. (i) The extention in contract was also made by the appointing authority i.e. BoD HESCO. 20. *Nawab Muhammad Yousuf Talpur: (Deferred during 13th Session) Will the Minister for Energy (Power Division) be pleased to state: (a) whether it is a fact that CEO of a DISCO is “Competent Authority” for BPS-18 officer; (b) whether it is a fact that M.D, PEPCO is an “Appellate Authority” for officers of BPS-18 of DISCOs; (c) whether M.D, PEPCO, in the capacity of Appellate Authority, suspended any officer of BPS-18 of any DISCO and if so, then to whom the suspended officer can prefer appeal under E&D Rules, 1978 of WAPDA; (d) the detail of such/similar orders issued during the last five years in each of the DISCOs by M.D, PEPCO; 4 (e) whether M.D, PEPCO can order for inquiry against any officer of BPS-18 of any DISCO through S&I Directorate of PEPCO in the event of having S&I Directorate of DISCO; if so, the details of such/similar cases during last five years in each of the DISCOs; and (f) what will be the role of BoD of a DISCO in whole of the such situations? Minister for Power Division (Mr. Omar Ayub Khan): (a) Yes, However, as per Rule­2 of the Pakistan WAPDA Employees (E&D) Rules, 1978, the definition of ‘competent authority’ is reproduced as under: “Competent Authority means the Authority or the appointing authority, or an officer to whom the appointing authority is subordinate, or an officer designated by the Authority to exercise powers of the competent authority”. (b) Yes, MD PEPCO is the ‘appellate authority’ for the penalties imposed upon the officers under WAPDA (E&D) Rules, 1978 by the CEOs of DISCOs as per delegation of Administrative Powers circulated on 24­02­2017. (c) As elaborated at part a, Rule­2 of the Pakistan WAPDA Employees (E&D) Rules, 1978, defines competent authority. Hence, any Authority to whom the competent authority is subordinate can also act as competent authority. MD, PEPCO, therefore, can place an officer of BPS­18 under suspension in the capacity of ‘competent authority’ and can take disciplinary action. In case, MD PEPCO penalizes an officer of BPS­18, the Chairman BoD, PEPCO i.e. Secretary Power Division will be the ‘appellate authority’ in that matter. (d) i. Mr. Ghulam Sarwar Dars, XEN HESCO ii. Mr. Jalal­ud­Din Abbassi, XEN HESCO. 5 (e) Yes, GM (S&I), PEPCO is working under MD, PEPCO and conducts enquiries against all employees of DISCOs when and where needed. The detail of five years regarding enquiries conducted against BPS­l8 officers of any DISCOs through S&I PEPCO is at Annex­A. (f) BoDs of DISCOs have its own prescribed role. The process to conduct inquiries and take disciplinary action under WAPDA (E&D) Rules, 1978 is the role of concerned competent authorities. Minister for Power Division (Mr. Omar Ayub Khan): (a) The comparison of overall revenue billed and collected during 2018­19 and July 2019 with previous year along with the additional revenue generated through electricity bills as a result of uninterrupted supply to consumers is attached as Annex­A and Annex­A­I. (b) An addition of 3,364 MW has been made in the national grid system during the tenure of the incumbent Government. The plants­wise detail is attached as Annex­B. (c) Anti­theft drive/campaign was started w.e.f. 13­10­2018. Company/region­wise progress upto 04­09­2019 is attached as Annex­C. (d) The primary reason of such theft is due to poor socio­economic condition of people and higher electricity tariff. Moreover, departmental corruption and connivance is also a major cause supplementing theft. 7 (e) A campaign to curb the menace of electricity theft has been launched since 13th October, 2018 in all distribution companies (DISCOs). Crackdown against electricity theft has been started across country and; FIRs are lodged against the persons involved in theft. Disciplinary action is initiated against the employees, if found involved in theft. Detection bills are charged and recovered. Surveillance teams are constituted by DISCOs to arrest people involved in theft of electricity. (Annexures have been placed in the National Assembly Library) 1.

    5th September, 2019 Khaleeq Kiani Under-fire govt beats retreat on GIDC amnesty ISLAMABAD: Surrendering to public outcry, Prime Minister Imran Khan finally decided on Wednesday to withdraw a controversial ordinance promulgated last week that offered Rs210 billion financial amnesty to big businesses. The government will also ask the Supreme Court of Pakistan to club all stay orders issued by various high courts and itself take an expedited decision in ongoing cases on the Gas Infrastructure Development Cess (GIDC). A day earlier, the federal cabinet had asked the ministry of law to amend the GIDC Ordinance of Aug 27, 2019 to include the condition of forensic audit before signing settlement agreement with these sectors namely fertiliser, general industry, IPPs, generation companies, K-Electric and CNG sector. However, the criticism continued to grow in the mainstream and social media, as well as from within the ruling party, compelling the government to reverse the whole initiative ab initio. “In view of the recent controversy, the prime minister, in the interest of transparency and good governance, has decided to withdraw the said ordinance”, said an announcement by the prime minister’s office. It said the prime minister also directed “the attorney general to move an application for urgent hearing in the Supreme Court, so that the matter is decided at the earliest, strictly in accordance with the law and the Constitution”. Chairing a meeting with representatives of 15 leading Chinese companies working on various CPEC and other projects in Pakistan, the prime minister said: “The project [CPEC] will not only help in translating all- weather Pak-China relations into mutually beneficial economic equation, but will also open new vistas of opportunities for the entire region.” The Chinese delegation included representatives of the Power China, Three Gorges Corporation, Huawei, Zong, China Gezh­ouba Corporation, China State Construction, China Harbour, Haier and the companies working on Neelum-Jhelum Power Plant Project, Port Qasim Power Plant, Orange Line Project and Matiari- Lahore Transmi­ssion Line Project. However, independent transformers of industrial / commercial connections are replaced on cost deposit basis, as the maintenance of such transformer is the liability of respective owner / consumer. (b) There is no such policy issued for collection of funds for repair of a general distribution transformer. Hence, if any employee of a DISCO is found guilty of such practice, severe action is taken against the delinquent officials.

Formally, all candidates were designated as independent, nonpartisan candidates, but in fact the election was a sweeping victory for the ruling party, the Pakistan Muslim League (PML). The election proclaimed itself to be grassroots democracy in action; however, in Pakistan the local landed elite are strong powerbrokers, and so even if elections are held, votes are affected by the influence of the local landowners. These local landowners used government decentralization to increase their power, and President Musharraf’s power base was also thereby strengthened. The earthquake that struck northern Pakistan on October 8 killed more than 73,000 people. International institutions, relief agencies from multiple countries, and domestic NGOs, etc., went to the scene of the dis- aster, where they continue their vigorous emergency support and recon- struction efforts. The massive damage in the area of Kashmir under Pakistani administration (Azad Kashmir) led to an improvement in the relations between Pakistan and India. While bus service across the Line of Control (LoC) had been already restored in April, five checkpoints on the LoC were opened up following the earthquake so that the LoC could be crossed even on foot.
