D’AVRAY Fellow of the British Academy Abstract: Papal law is known from the late 4th century (Siricius). There was demand for decretals and they were collected in private collections from the 5th century on. Charlemagne’s Admonitio generalis made papal legislation even better known and the Pseudo-Isidorian collections brought genuine decretals also to the wide audience that these partly forged collections reached. The papal reforms from the 11th century on gave rise to a new burst of papal decretals, and collections of them, culminating in the Liber Extra of 1234. The Council of Trent opened a new phase. The ‘Congregation of the Council’, set up to apply Trent’s non-dogmatic decrees, became a new source of papal law. Finally, in 1917, nearly a millennium and a half of papal law was codified by Cardinal Gasparri within two covers. Papal law was to a great extent ‘demand- driven’, which requires explanation. The theory proposed here is that Catholic Christianity was composed of a multitude of subsystems, not planned centrally and each with an evolving life of its own. Subsystems frequently interfered with the life of other subsystems, creating new entanglements. This constantly renewed complexity had the function (though not the purpose) of creating and recreating demand for papal law to sort out the entanglements between subsystems. For various reasons other religious systems have not generated the same demand: because the state plays a ‘papal’ role, or because the units are small, discrete and simple, or thanks to a clear simple blueprint, or because of conservatism combined with a tolerance of some inconsistency. -

June 24, 2017 – 4th Sunday After Pentecost | Nativity of the Holy Glorious Prophet, Forerunner and Baptist, John The Gospel (Luke. 1: 5) relates that the righteous parents of Saint John the Baptist, the Priest Zachariah and Elizabeth (September 5), lived in the ancient city of Hebron. They reached old age without having children, since Elizabeth was barren. Once, Saint Zachariah was serving in the Temple at Jerusalem and saw the Archangel Gabriel, standing on the right side of the altar of incense. He predicted that Saint Zachariah would father a son, who would announce the Savior, the Messiah, awaited by the Old Testament Church. Zachariah was troubled, and fear fell upon him. He had doubts that in old age it was possible to have a son, and he asked for a sign. It was given to him, and it was also a chastisement for his unbelief. Zachariah was struck speechless until the time of the fulfillment of the archangel’s words. Saint Elizabeth came to be with child, and fearing derision at being pregnant so late in life, she kept it secret for five months. -

It is argued here that these concepts are just as applicable to the analysis of historical doctrinal conflicts in Late Antiquity as they are to understanding modern conflicts. In the following, I apply social conflict theory to three conflicts involving the late antique papacy to see what new insights it can proffer. The first is Zosimus's involvement in the dispute over the hierarchy of Gallic bishops at the beginning of the fifth century. The second and longest case-study is Leo I's interven- tion in the Chalcedonian conflict over the natures of Christ. The final brief study is the disputed election of Symmachus at the end of the fifth century. The Selection of Bishops: Exploring Canonical Alternatives John Huels, OSM Richard R. Gaillardetz In this essay we will address an issue of church polity. While doctrinal disputes on questions related to justification, the filioque or sacramental theology have received more attention, it is the concrete questions of church polity which may constitute the greater obstacle to the achievement of full visible union among the Christian churches. With that in mind we will focus our attention on the concrete processes related to the selection of bishops. While this might seem a fairly secondary, administrative concern, in fact, the current procedures for the selection of bishops, insofar as they reinforce perceptions of the Catholic church as a monolithic, quasi-monarchical institution, play a highly symbolic role in ecumenical dialogue. A significant revision of these procedures might go a long way towards dispelling these perceptions. We recognize, of course, that not all Christian churches acknowledge the need for an episcopate which succeeds to the authority of the college of apostles. On the other hand, the last two decades have seen a growing convergence in ecumenical dialogue toward affirming the value of such an episcopate. The influential Lima document, Baptism, Eucharist and Ministry, affirmed the importance of episcopal ministry and called for those Christian traditions without an episcopate to reconsider their position on Selection of Bishops -- 2 this question.1 A revision of current canonical procedures within the Roman Catholic church, to the extent that they would clarify the nature of the episcopate as an apostolic service to the church, might help these traditions decide in favor of such an episcopate. -
Pope Cornelius
Pope Cornelius Pope Cornelius (died June 253) was the Bishop of Rome from 6 or 13 March 251 to his martyrdom in 253.[1] 1 Christian persecution Emperor Decius, who ruled from 249 to 251 AD, per- secuted Christians in the Roman Empire rather sporadi- cally and locally, but starting January in the year 250, he ordered all citizens to perform a religious sacrifice in the presence of commissioners, or else face death.[2] Many Christians refused and were martyred (possibly including the pope, St Fabian, on 20 January), while others partook in the sacrifices in order to save their own lives.[3] Two schools of thought arose after the persecution. One side, led by Novatian, who was a priest in the diocese of Rome, believed that those who had stopped practising Christian- ity during the persecution could not be accepted back into the church even if they repented. Under this philosophy, the only way to re-enter the church would be re-baptism. The opposing side, including Cornelius and Cyprian the Bishop of Carthage, did not believe in the need for re- baptism. Instead they thought that the sinners should only need to show contrition and true repentance to be wel- comed back into the church.[4] In hopes that Christian- ity would fade away, Decius prevented the election of a new pope. However, soon afterwards Decius was forced to leave the area to fight the invading Goths and while he was away the elections for pope were held.[3] In the 14 months without a pope, the leading candidate, Moses, had died under the persecution. -

Chapter 1 Rome, Hispania, and North Africa: The Case of the LIBELLATICI Bishops Martialis and Basilides One of the earliest cases that we have involving the bishop of Rome and bish- ops in Hispania transpired during the tenure of Cyprian of Carthage, who be- came embroiled in a row on the status of lapsed clergy during the pontificate of Pope Stephen I (254–257). The scene had already been set, so to speak, in the pontificate of Pope Cornelius (251–253), immediate predecessor of Stephen I. There had been a series of councils in Rome and Carthage to deal with the Novatian heresy, which is what set off the intense debate over requiring rebap- tism of heretics as a non-negotiable condition of coming back into commu- nion with the Church. I would like to begin with a brief sketch of Cornelius and Stephen I, their activities and positions during this time of intense persecution by the Emperors Decius and Diocletian. It was a moment when the faith of Christians was quite literally at times being tested by fire and by other heinous Roman methods of torture used against enemies of Emperor and Empire. Cornelius’s election was delayed by the persecution of Decius. A priest named Novatian contested his selection and had himself consecrated as bishop amidst accusations of lapsing from the faith during the persecution. This conflict led to intense debates be- tween those who defended either party, Cornelius or Novatian, over clergy that lapsed during persecution and later wanted to be reintegrated into the Church and resume their ministry. -

That is an extreme example of perfectionism, but it helps us appreciate the magnitude (and the hubris) of the goal Boethius set for himself in the Introduction to his translation of Aristotle’s De Interpretatione: translating, analyzing, and reconciling the complete opera of Plato and Aristotle.1 As “incom- parably the greatest scholar and intellect of his day,”2 Boethius may have had the ability and the energy his ambition required. But we will never know how much Boethius would have achieved as a philosopher if he had not suffered a premature death. In 523, less than a year after being named Magister Officiorum3 by King Theodoric, Boethius was charged with treason, hastily and possibly illegally tried, and executed in 526.4 Since the contemporary sources of information about the affair are vague and fragmented, the passage of nearly 1500 years has brought no consensus in explaining Boethius’ tragic fall from a brilliant intellectual and political career. Though disagreement still shrouds the details of every aspect of the case, from indictment to execution, I will argue that Theodoric was fully justified in perceiving Boethius as a traitor. Claims that age or emotional passion or military pressures diminished the King’s judgment are, in this instance, unacceptable. -

The monk had argued from Scriptural evidence that married women were equal in merit with widows and virgins; that they who had been baptised in fullness of faith could not be overthrown by the devil; that eating meats and drinking wine with thanksgiving was no less meritorious than abstention from these things; and that there was one reward in the kingdom of heaven for all those who had kept their baptismal vow. This paper is a reconstruction of Jovinian's arguments and motives from the evidence of Jerome's Against Jovinian.
