This assessment was to consider how these systems are consistent with the objectives of the European Union Treaty and European Transport Policy. In addition, recommendations were sought on how to improve such systems. Information and data about the vignette systems was sought from Austria, Bulgaria, the Czech Republic, Hungary, Romania, Slovakia and Slovenia. Analysis in this report is based primarily on this information. Scope of the Vignettes Vignette systems are a form of road charging that sells set periods of access to a defined road network based on time. W hilst not directly related to usage, the economic assumption is that charges for vignettes will reflect the average amount of usage undertaken on the charged network in that set period of time. Vignette systems have been in operation for some years in EU M ember States. The key objectives M ember States cite in having such systems are to help recover the costs of road infrastructure, including funding ongoing improvements and maintenance of the charged infrastructure. Requirements of Vignette Systems No specific EU legislation exists to guide the development of private vehicle vignettes, although heavy vehicle vignettes are regulated by Directive 1999/62/EC (≈the Eurovignette Directive∆). However, the vignette systems for private vehicles still need to be compliant with the EU Treaty and EU jurisprudence, in particular the principles of non-discrimination and proportionality. Definitions of non-discrimination and proportionality It is a core principle of membership of the European Union that M ember States must not discriminate against EU citizens from other M ember States, as this would hinder the free movement of people and goods across the EU. W hilst M ember States do not explicitly discriminate between foreign and national motorists with vignettes, they may do so implicitly through price or procedures that disproportionately impact upon foreign motorists. Forms of discrimination can be economic (charging excessively for short term users compared to long term users), social (not providing adequate information through signage in foreign languages at border areas) and technical (not providing adequate payment options suitable for foreign motorists). Proportionality is a principle derived from European Court of Justice jurisprudence that a measure taken by a public body should be in proportion to what is essential to achieve the particular objective. For vignettes, the key application of this principle is that vignette price schedules should be proportionate to the degree of road usage and relative administrative costs.     Court of Justice of the European Union PRESS RELEASE No 75/19 Luxembourg, 18 June 2019 Judgment in Case C-591/17 Press and Information Austria v Germany The German vignette for the use by passenger vehicles of federal roads is contrary to EU law The charge is discriminatory since the economic burden of the charge falls, de facto, solely on the owners and drivers of vehicles registered in other Member States From 2015, Germany has put in place a legal framework for the introduction of a charge for the use by passenger vehicles of federal roads, including motorways: the ‘infrastructure use charge’. By that charge, Germany intends to move in part from a system of financing by means of taxation to a system of financing based on the ‘user pays’ and ‘polluter pays’ principles. The revenue from that charge will be entirely allocated to financing the road infrastructure, the amount of which will be calculated on the basis of cylinder capacity, the type of engine and the emission standard of the vehicle. Every owner of a vehicle registered in Germany will have to pay the charge, in the form of an annual vignette, of no more than €130. For vehicles registered abroad, payment of the charge will be required (of the owner or the driver) for use of the German motorways. In that regard, a 10 day vignette is available costing between €2.50 and € 25, a 2 month period costing between €7 and €50 and annual vignettes are available, at no more than a maximum of €130. In parallel, Germany has provided that, from the revenue from the infrastructure use charge, the owners of vehicles registered in Germany will qualify for relief from the motor vehicle tax to an amount that is at least equivalent to the amount of the charge that they will have had to pay.

    Comparative Analysis of Road Financing Approaches in Europe and the United States Juan Gomez and José Manuel Vassallo Abstract: Road infrastructure has a remarkable economic and social impact on society. This is why road financing has always drawn the attention of policymakers, especially when resources available for government spending become scarce. Nations exhibit differing approaches to dealing with road transportation financing. In the United States, the current system of road funding has been called into question because some regard it as insufficient to meet the amounts now required for road expenditures, By contrast, in most European countries, road charges are very high, but these revenues are not allocated for the funding of roads. This paper analyzes the balance between charging for the use of and expenditure on the road sector in the United States and compares the American policy with those of several European countries (Germany, United Kingdom, France, Spain, and Switzerland). To that end, a methodology is defined to calculate the annual amount of fee charges levied on light and heavy vehicles in the selected countries in order to compare those charges with annual road expenditures. The results show that road charges in America are noticeably lower than those paid in Europe. Additionally, the research concludes that in Europe, road-generated revenues exceed road expenditures in all the countries studied, so road charges actually subsidize other policies. By contrast, in the United States, the public sector subsidizes the road system in order to maintain the current level of expenditure. At the same time there is a broad consensus that users should be made to bear more of the costs, in conjunction with an increase in absolute terms in the funds availablei. Fees in the form of a toll are a viable additional option to financing through taxes. What is more, funds saved by reducing environmentally harmful subsidies can flow into transport infrastructureii. If the legislature should opt to increase user funding through tolls, it should choose the distance-based variant. A distance-based toll can help to secure the long-term financing of transport infrastructure. Unlike a vignette this would be consistent with the polluter-pays principle and could contribute to making mobility in Germany more sustainable. Table 1 shows the vehicles for which a toll is currently charged in Germany, to what extent and on which roads.
