Appendix 3 the Act Makes No Provision for the Publication of a Sex Appendix 3 Preliminary Equalities Impact Assessment Template (to be considered in conjunction with the EIA Guidance) Name of proposal Adoption of Sex Establishment Policy Questions 1: Why is this assessment being undertaken? (see guidance for examples) A Sex Establishment Policy has been produced to enable the Authority to carry out its Licensing responsibilities with regard to Schedule 3 Local Government (Miscellaneous Provisions) Act 1982 as amended by section 27 Policing and Crime Act 2009 This Equalities Impact Assessment has been conducted to consider the impact that this policy might have on equalities groups and to identify mitigating actions to address any disproportionately negative impact. Question 2: What is being proposed? The Act makes no provision for the publication of a sex licensing policy, The Licensing Authority are entitled to formulate extra-statutory licensing policies, the main benefits of a policy being recognised as bringing transparency, accountability, certainty, consistency and the promotion of good standards. The Provision of Services Regulations 2009 require authorisation procedures to be clear, made public in advance and secure that applications are dealt with objectively and impartially. The policy ensure that all these objectives are achieved. STEP Two: Assessing the impact on specific groups To understand the impact that any change may have it is important to know as much as possible about those likely to be affected. (ie significant impact identified in relation to an group – give details) The policy is most likely to negatively impact on religion or belief as these types of premises may be considered offensive, and children as access to such premises could be harmful. Both have been addressed within the policy as above STEP Three: Understanding and mitigating impact Question 7; Have you identified and looked to mitigate the impact? During the consultation, participants were asked if they considered the policy would sufficiently address issues around the licensing of Sex Establishments with regard to amongst other things locality and community and if they considered the policy could have any potential negative impact and if so how it could be mitigated. Overall In consultation, there was a minimal response, those received were generally supportive of the Policy and only contained suggestions of minor alterations in wording. No negative responses were received and as such their has been no action required. The policy will be review in one year to allow for the new equality duty and then every three years unless it is thought appropriate to review earlier. The consultation commenced in December 2010 for 12 weeks and concluded on the 11 th March 2011.
