TAKE NOTICE that The Corporation of The Township of St. Joseph intends to amend the Township's ZoningBy-law to implement provisions applying to the location, placement and use of shipping containers within the boundaries of The Township of St. Joseph.

The proposed Zoning By-law Amendment would define and permit Storage Containers, and establish requirements for the number, size,location and for the placement of a Storage Container on any properly within the Rural (RU), Highway Commercial (HC), Business Park (BP), Major Recreation (MR), Rural Industrial (MI), and Extractive Industrial (lvIX) Zones,including minimum setbacks and permitted uses.

The Council of the Corporation of The Township of St. Joseph will hold a public meeting to consider the proposed amendment on Wednesday, March 41 2020 beginning at 6:30 pm at the Township Administration Building, 1669 Arthur Street, Richards Landing, Ontario. Any person may attend the public meeting and/or make written or verbal representation either in support of, or in opposition to, the proposed amendment.

If a person or public body would otherwise have an ability to appeal the decision ofThe Township of St. Joseph to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to Township Council before the by-law is passed, the person or public body is not entitled to appeal the decision.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to The Township of St. Joseph before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

Subject: Go North Music Festival Requests

RECOMMENDATION

BE lT RESOLVED THAT the report from the Office Assistant / Healthy Living Coordinator regarding Go North Music Festival Requests be received; and

That Council authorizes staff to apply for the Heritage Fund, Northern Event Partnership Program for the 2020 Go North Festival; and

That Council authorizes the establishment of a fee structure for tickets, vendors and food booths as outlined in this report; and

That Council deems this concert to be an event of municipal significance to the community and supports the application for a Special Occasion Permit: and

That Council authorizes the exemption from the Noise By-Law to allow music to be amplified until 12:00am forthe Go North Music Festival on July 11,2020 as outlined in this report.

Background:

Northern Ontario Heritage Fund Grant Application: The Office Assistant / Healthy Living Coordinator has prepared an application for the Northern Ontario Heritage Fund, Northern Event Partnership Program grant. lf successful, this Grant will be used to fund a number of elements of the Go North Music Festival from performances, production, advertising and materials. The grant will be used to support the expansion and sustainability of the Go North music Festival. The NOHFC awards Northern Event Partnership grants to support events that positively impact the community through tourism and supporting the local economy. This grant is based on a percentage split. The contribution required by The Township of St. Joseph is70% of the complete budget. The amount requested from the NOHFC for The Go North Music Festival is applying for $8050.00 which represents 30% of eligible costs. The grant application is due March 23

q Fees

The Richards Landing Arts and Cultural Events Committee is in the process of planning the fourth annual "Go North Music Festival" July 1 1, 2020 at the Centennial Grounds, following the three year plan and being conservative with an expected audience of 600 guests. We have added an additional concert on the Friday night at the Old Town Hall to provide Friday night entertainment. The committee has secured sponsorship from Kresin Engineering, Brookfield Energy, Fred's Trailer Park, HVAC and has several other requests in process. Post event surveys from 2019 showed excellent response with most people indicating that they will return again in2020.

The fees for the Go North Music festival were determined using the council approved draft budget. ln order to have adequate revenue vs expenses these fees were developed by the Event Committee. All prices are HST included: Old Town Hall Early Bird $10, at the door $15. Early Bird Tickets $30, Advance Tickets $40, Door Tickets $50, student pricing, ages 13-18 $15, Tent Camping $20, Trailer Camping $30 per night and children 12 and under are free. The ticket and vending prices are in line with similar music festival events in Northern Ontario.

The vendor fees remain similar lo 2019: Artisan Vendor Booth fee $55 including HST, Food Vendor (no booth, such as a food truck) $1 15 including HST, Food Vendor Booth $170 including HST. Booth equipment owners have been made aware that booths containing their equipment will be rented for this Festival.

These fees are for this event only and are not included in the fees and charges by-law

Special Occasion Permit

The Go North Music Festival also intends to sell alcohol again in 2Q20. The Go North Music Festival requires council approval to apply for a Special Occasion Permit (SOP). The Liquor Control Board of Ontario also requires a resolution recognizing and approving this event as a significant community event.

Noise By-Law

The Go North Music Festival intends to end the main stage at approximately 1 1:30pm on July 11th. The Noise By-Law provides that amplified music shall not exceed/surpass 11pm. The Committee requests an exemption from the By-Law until midnight.

The campfire stage is planned to occur between the hours of 11:30pm and 2am. Music will not be amplified. lt is anticipated that acoustic campfire music will continue until 2am, but will not be a nuisance.

The Richards Landing Events and Cultural Committee requests Council to authorize an exemption from the Noise By Law for this date to facilitate an enjoyable festival and campground music experience for the campers. Public notice can be provided if council deems it preferable.

RECOMMENDATION:

BE lT RESOLVED THAT the report from the Clerk Administrator regarding the application to amend the Zoning By-law to reduce the shoreline setback from 30 m (100ft) to 15.24 m (50ft) for the Shoreline Residential property located a|2726 Canoe Point Road be received; and

That staff be authorized to initiate the public notification process for the proposed amendment to reduce the shoreline setback from 100 feet to 50 feet to permit the installation of the septic system in front of the residence.

Background

An application has been received to amend the Township's Zoning By-law to section 4.21.1 which states that all buildings or structures shall maintain a minimum 30 metre (100 foot) setback from the established high water mark.

The property currently contains a garage under construction, and a residential dwelling is proposed which precisely meets the 30 m shoreline setback. The application for the building permit for the residence has not yet been submitted.

Algoma Public Health previously approved the installation of the septic bed on the side of the residence outside of the shoreline setback, but discussions with the contractors have resulted in revising the plan as it was felt to be impractical and a potential encroachment of the neighbouring property.

Consideration should be given for the future addition of a deck to the front of the dwelling and the implications for structures in the front yard.

Financial lmplications

There is no financial impact to the municipality as a result of this application.

Summary / Options

The requested residential development is in keeping with the neighbouring properties

lz Council may approve the recommendation to schedule and circulate a notice of public meeting where council will consider an amendment to the Zoning By-law to reduce the shoreline setback to 15.24m to permit the installation of the septic bed and tank within the shoreline setback.

tb 6.REASONS FOR REQUESTING THE AMENDMENT

I am planning to begin construction of a home on the property in the spring of 2O2O and will require approval of a site plan to obtain a permit to construct.

Section 4.2L.7 of the Zoning By-law states that "where a vacant lot exists on the date this By-law was passed and is located between two existing dwellings that encroach into the required 30 metre setback in legal non-compliance, the minimum shoreline setback for the vacant lot shall be the average of the shoreline setbacks of the two abutting lots".

On July 2,20t9,1 applied for a permit to construct a garage on the vacant lot and submitted a site plan that also included the proposed location of the residence and septic system with a 15 metre shoreline setback that was consistent with the adjacent properties (Appendix A). I was advised by the Clerk Administrator that the site plan far 2720 Canoe Point Road includes a septic system located 15 metres from the high water mark but, because there was no record of a septic system at2732 Canoe Point Road, the average rule in Section 4.21.1 could not be applied. I was advised to meet with Gary Leith, Public Health lnspector with Algoma Public Health.

I met with Gary Leith onsite on July t2,20L9. He observed the locations of the dwellings and septic systems at both adjacent properties. We discussed several options and I was advised to submit a revised site plan that incorporated a 30 metre setback (Appendix B). I submitted the revised site plan on July 15, 2019. ln recent discussions with contractors Spencer Young and Brent Gilbertson I have been advised that the revised site plan is not practical because it does not allow any access for vehicles or equipment between the proposed residence and the shoreline at any time after excavation of the foundation and also because the septic bed mantle will actually extend beyond the 30 metre shoreline setback and encroach on the property at2732 Canoe Point Road.

I am therefore requesting an amendment to the Zoning By-law to allow a 15 metre shoreline setback that would support the original site plan.

Subject: Ghildren's Library Foundation

RECOMMENDATION:

BE lT RESOLVED THAT the information regarding further investigation of the porch and foundation of the Children's Library be received; and

That Council authorizes staff to prepare and circulate a tender for the investigation of the integrity of the foundation of the entire building, and to make recommendations for remediation of the foundation.

Background

Following an Engineer's report and recommendations on the foundation and structure of the porch on the Richards Landing Children's Library, Mayor Wildman and Councillor Adams conducted a further on site investigation of the foundation of the porch as well as the main building.

While some sections of the porch structure seem relatively level, some pieces are not and seem to slope away from the building to the east and south. With this in mind, we recommend an investigation of the foundation of both the porch and the main building to ensure there are no issues with their soundness, and whether it can be determined if either have either shifted at some point in the past, and if so, if there is any evidence that it continues to shift.

The section of the building foundation under the front of the building is a stone/mortar foundation as opposed to the poured cement around the porch and rest of the building. Our assumption is that the cement foundation was poured when the reading room was added and may just surround the stone foundation of the original building. The foundation itself may be okay but there are some areas of concern.

That next steps would be to engage an engineer to provide

1 An engineering report on the soundness of the building foundation and include whether the stone chimney has shifted or whether the building has.

2 Soundness of the rough stone wall portion of the building foundation on the front of the building under the porch, and whether shoring it up is necessary.

3. Soundness of the cement foundation under the porch - has it shifted?

Once we understand that the foundation is sound we would engage a contractor to:

zo 4 Replace deck and porch roof support posts and any other repairs needed to the porch structure.

L 1 THE CORPORATION OF THE TOWNSHIP OF ST. JOSEPH

BY-LAW 2020 -

A By-law under the provisions of Section 34 of the Planning Act, R.S.O. 1990, to amend By-law 20ll-34, as amended, of the Corporation of the Township of St. Joseph with respect to provisions applying to the location and use of shipping containers within the boundaries of the Township of St. Joseph.

WHEREAS The Ontario Building Code recognizes shipping containers as structures when used on land and provides that the construction or placement of any structure over l0 square meters (108 square feet) requires a Building Permit; and

WHEREAS The Corporation of the Township of St. Joseph has reviewed By-law 20ll-34, as amended, and deems it advisable to further amend said by-law to define and regulate the location and use of shipping containers;

NOW THEREFORE The Council of The Corporation of The Township of St. Joseph enacts as follows:

l. Section 3 - Definitions is hereby amended by the addition of the following:

"Shipping Containero' means an enclosed metal structure designed to facilitate the transportation of goods by several different means of transportation, and shall include, but is not limited to, intermodal shipping containers, transport truck trailer bodies, rail cars and straight truck boxes, but does not include any motor vehicle as defined herein.

2. Section 4 - General Provisions is hereby amended by the addition of a new Section 4.23 as follows:

I' " Shipping Containers

Shipping containers are permitted in the Rural (RU), Highway Commercial (HC), Business Park (BP), Major Recreation (MR), Rural Industrial (M1), and Extractive Industrial (MX) Zones; provided that:

a. Unless stated elsewhere in this By-law, shipping containers are only permitted for accessory storage pu{poses, and are limited in number to a maximum of four (4) in total on any one lot.

b. No shipping container shall be used for human habitation, home industry or any occupation or business, nor be attached to any such use;

c. No shipping container shall exceed a height of 3m (10 ft.) or a total length of 16.76m (s5 ft.);

Page 1 of 2 Z5 d. All shipping containers shall be screened from view from abutting properties;

e. Shipping containers shall comply with all minimum yard setbacks of the zone in which they are located unless specified otherwise in this by-law;

f. Notwithstanding clauses (d) and (e) of this section, a shipping container is permitted in the driveway of a residential property for the purpose of temporary loading or unloading of household items during the process of moving for a period not exceeding ten (10) days. Such temporary shipping containers shall not exceed a maximum height of 3.0m (10 ft.) and a maximum length of 6m (20 ft.), and no temporary shipping container shall encroach onto a public sidewalk or be located closer than 0.3m (1 ft.) from the curb or shoulder of a road in situations where no sidewalk exists, and no shipping container shall create a site line obstruction to traffic;

g. A shipping container shall not be located in a required parking area;

h. A shipping container shall be included in all calculations for the pulpose of determining maximum lot coverage;

i. A shipping container shall not be placed or used for the purpose of display or advertising, or as a component of a fence;

j. A shipping container shall not be used for the purpose of a commercial self-storage facility;

k. Notwithstanding any other provision of this By-law, a shipping container is permitted on a construction site being developed for a single structure or as a plan of subdivision/condominium for temporary storage of equipment and materials incidental to construction only, and for a temporary period not to exceed one year; and shall be removed from the site within 60 days of completing the work or project abandonment.

J This By-law shall come into force on the date it is passed by the Council of the Corporation of The Township of St. Joseph, subject to the provisions of the Planning Act, R.,S.O., 1990, as amended.
