Edición CIDOB Barcelona. 2 Abstract Español: En este estudio se pretende analizar las políticas públicas de comunicación en México, en especial las creadas e implementadas a partir de la Reforma en Telecomunicaciones de 2013 y su impacto hasta diciembre de 2018 cuando concluyó el sexenio presidencial del gobierno que motivó esta transformación. Es pertinente estudiar dichas políticas debido a que su legislación ha sufrido una transformación con el objetivo de impactar en el proceso de desarrollo económico y social mexicano. A partir del año 2012, luego de la victoria y regreso a la Presidencia de la República del Partido Revolucionario Institucional –quien hasta el año 2000 había gobernado 70 años ininterrumpidamente– se concretó un acuerdo entre las principales fuerzas políticas, PRD (izquierda), PAN (derecha) y PRI (Gobierno), para impulsar reformas estructurales necesarias para el desarrollo del país; ese acuerdo se denominó Pacto por México. Entre estas reformas estructurales se incluían ámbitos como el energético, laboral, educativo, hacendaria, financiera, político-electoral, competencia económica y en las telecomunicaciones. Por políticas de comunicación entenderemos la interpretación que hacen van Cuilenburg y McQuail en su artículo “Media Policy Paradigm Shifts: Towards a New Communications Policy Paradigm”, donde señalan que, debido a la convergencia digital de los distintos medios de comunicación y las telecomunicaciones, aunada con un ambiente político de libre mercado y transformaciones tecnológicas, se ha actualizado y redefinido el concepto de las políticas de comunicación. Estas han sido guiadas hacia la interacción de regular los mercados económicos de las industrias de comunicación, a la vez de fomentar el desarrollo de la sociedad y el mejoramiento de la democracia. En cuanto a la Reforma en materia de Telecomunicaciones, se busca describir y analizar los procesos de gestación y de formulación de las políticas públicas de comunicación, así como la incidencia de estas políticas en los temas de regulación de monopolios en telecomunicaciones y radiodifusión; implantación de la Televisión Digital Terrestre; otorgamiento de concesiones; medios públicos y comunitarios; derechos de los usuarios y de las audiencias; así como de la disminución de la brecha digital. Políticas Públicas, Telecomunicaciones, Políticas de Comunicación, Reforma en Telecomunicaciones, México 3 English: This study aims to analyze the public communications policy in Mexico, especially those created and implemented after the Telecommunications Reform of 2013 and its impact until December 2018, when the government that motivated this transformation ended. It is thus relevant to study these policies since their legislation has suffered a transformation that seeks to impact both the economical and social development process. As of 2012, after the return of the Institutional Revolutionary Party to the presidency of the Republic —which up until the year 2000 had ruled uninterruptedly for 70 years— an agreement between the main political forces, the Democratic Revolution Party (left), the National Action Party (right) and the Institutional Revolutionary Party (government) was concretized in order to push forward the necessary structural reforms for the development of Mexico. Such an agreement was called Pact for Mexico. Among these structural reforms, different spheres, such as, energy, labor, education, financial, political-electoral, economic competitiveness, and telecommunications were also included. Based on the definition by Van Cuilenburg and McQuail in their article, “Media Policy Paradigm Shifts: Towards a New Communications Policy Paradigm”, we understand Communication Policy as an integrated policy where due to digital convergence of the different media and telecommunications, coupled with a political environment of free market and technological transformations, the concept of communications policy has been updated and redefined towards the interaction of regulating the economic markets of the communication industries, while promoting the development of society and the improvement of democracy. As for the Reform in matters of Telecommunications, this study aims to describe and analyze the processes of gestation and formulation of public communications policy, as well as analyze the impact of these policies on the issues of monopoly regulation in telecommunications and broadcasting; implementation of Digital Terrestrial Television; granting of concessions; public and community media; rights of users and audiences; as well as the reduction of the digital divide. Time noted that the president — “assisted by a group of young technocrats (including) Finance Minister Luis Videgaray and Pemex chief Emilio Lozoya” — was making history by breaking Mexico’s eight-decade state monopoly over the energy industry. “And the oil reform might not even be Peña Nieto’s most important victory,” the magazine said. There was “evidence” that Peña Nieto was about to “challenge Mexico’s entrenched powers.” While most investors focused on the deep regulatory changes under way, leading Mexican civil society organizations were looking at another critical promise in the Pacto por Mexico: fighting endemic corruption. “For centuries, corruption has been one of the central elements of the Mexican state (and) a constant in shaping the political system,” said Jorge Buendía, a prominent pollster and political analyst. A powerful governor from the 1960s to the 1980s allegedly once said that in Mexico “a poor politician is a poor politician.”2 And by the time Peña Nieto came to power, most in the country believed that things hadn’t really changed.

Life after Dictatorship: Authoritarian Successor Parties Worldwide, New York: Cambridge University Press. Between 1929 and 2000, Mexico was an authoritarian regime. During this time, elections were held regularly, but because of fraud, coercion, and the massive abuse of state resources, the Institutional Revolutionary Party (PRI) won virtually every election. By 2000, however, the regime came to an end when the PRI lost the presidency. Mexico became a democracy, and the PRI made the transition from authoritarian ruling party to authoritarian successor party. Yet the PRI did not disappear. It continued to be the largest party in Congress and in the states, and it was voted back into the presidency in 2012. This electoral performance has made the PRI one of the world’s most resilient authoritarian successor parties. What explains its resilience? I argue that three main factors explain the PRI’s resilience in the aftermath of the transition: 1) the PRI’s control over government resources at the subnational level, 2) the post-2000 democratic governments’ failure to dismantle key institutions inherited from the authoritarian regime, and 3) voters’ dissatisfaction with the mediocre performance of the PRI’s competitors. Although security issues have recently dominated the U.S. relationship with Mexico, analysts predict that bilateral relations may shift toward economic matters now that President Enrique Peña Nieto has taken office. Peña Nieto of the Institutional Revolutionary Party (PRI) defeated leftist Party of the Democratic Revolution (PRD) candidate Andrés Manuel López Obrador and Josefina Vázquez Mota of the conservative National Action Party (PAN) in Mexico’s July 1, 2012 presidential election. As a result, the PRI, which controlled Mexico from 1929 to 2000, retook the presidency on December 1, 2012. Some analysts have raised concerns regarding the PRI’s return to power, but President Peña Nieto has pledged to govern democratically and to forge cross-party alliances. The outgoing PAN government of Felipe Calderón pursued an aggressive anticrime strategy and increased security cooperation with the United States. Those efforts helped Mexico arrest or kill record numbers of drug kingpins, but 60,000 people may have died as a result of organized crime- related violence during the Calderón Administration. Flores-Macías Cornell University [email protected] (forthcoming with changes in the Journal of Democracy, April 2016) After Enrique Peña Nieto of the Institutional Revolutionary Party (PRI) won the presidency in Mexico’s July 2012 election, both domestic and international media began heralding the prospect of “Mexico’s Moment.” Expectations of heightened development and lowered crime ran so high that some observers even started calling Mexico the “Aztec Tiger,” evoking the economic dynamism famously associated with South Korea and Taiwan. At first, these expectations seemed as if they might be realized. Reforms made early progress, and the economy seemed on its way out of stagnation and into a new day of much- needed growth and development. Peña Nieto’s administration crafted the Pact for Mexico—a formal agreement signed by the PRI and its rivals, the center-right National Action Party (PAN) and the left-of-center Party of the Democratic Revolution (PRD)—to advance a common reform agenda. The state’s traditional monopoly control of the oil sector was ended, and the way cleared for private competition—a major political feat given Mexicans’ historical opposition to private involvement in this major part of the economy. The first year of Peña Nieto’s presidency saw fiscal, telecommunications, anti-trust, banking, education, and electoral reforms adopted as well. The return to the presidency of the PRI, which had been Mexico’s ruling party for seven decades until voters gave the presidency to the PAN in 2000, seemed to be going smoothly.

Mexico is a top trade partner and the third-largest crude oil supplier to the United States. Mexico’s state oil company, Petroleos Mexicanos (Pemex) remains an important source of government revenue even as it is struggling to counter declining oil production and reserves. Due to an inability to meet rising demand, Mexico has also significantly increased natural gas imports from the United States. Still, gas shortages have hindered the country’s economic performance. On December 20, 2013, Mexican President Enrique Peña Nieto signed historic constitutional reforms related to Mexico’s energy sector aimed at reversing oil and gas production declines. On August 11, 2014, secondary laws to implement those reforms officially opened Mexico’s oil, natural gas, and power sectors to private investment. As a result, Pemex can now partner with international companies that have the experience and capital required for exploring Mexico’s vast deep water and shale resources. Leftist parties and others remain opposed to the reforms. The energy reforms transform Pemex into a “productive state enterprise” with more autonomy and a lower tax burden than before, but make it subject to competition with private investors.

U.S.-Mexican relations have been strengthened through cooperative management of the 2,000- mile shared border, the North American Free Trade Agreement (NAFTA), and security cooperation under the Mérida Initiative. They have been tested over the past year, however, by President Donald J. Trump’s proposed shifts in U.S. immigration and trade policies. President Enrique Peña Nieto of the centrist Institutional Revolutionary Party (PRI) assumed the Mexican presidency for a six-year term on December 1, 2012. During his first year in office, Peña Nieto shepherded economic, political, justice-sector, education, and energy reforms through the Mexican Congress. He has since struggled to implement those structural reforms and to address human rights abuses, corruption, and impunity. Violence in Mexico is reaching historic levels, hurting Peña Nieto’s already historically low approval ratings (19% in May 2017) and diminishing the PRI’s chances in the 2018 elections.   • Unmasked: López Obrador & the End of Make-Believe
    ACKNOWLEDGMENTS This volume began to take shape in my mind when Andrés Manuel López Obrador effectively assumed control of Mexico’s government on July 1, 2018, the eve of his triumph in the presidential elections. His mandate was absolute and unequivocal, and the problems that he intends to attack are the central problems of Mexico. My differences with him are not his intended objectives, particularly his desire to address any number of Mexico’s ancestral evils such as inequality, poverty, and lack of growth—the nodal issues of the country—but rather his intended means of addressing them, as well as his propensity to evade political reality and the realities of globalization. It has been clear from the start that he does not recognize that there are limits to his capacity to act and modify the national reality. That reality must change so that Mexico can break with a past that has not improved the population’s well-being—however, such change does not necessarily entail completely wiping away everything that exists, as the new president claims. If he continues on his chosen path—one guided by obsessions, incidents, and agendas that are incompatible with the vision that he has expressed repeatedly in his speeches and books—López Obrador will end up against the wall, as so many of his predecessors have ended. As long as Mexico remains integrated with international commercial and financial circuits, there is no way to avoid the tangible and inevitable realities of the way financial markets work or the investment decisions made by both domestic and foreign entrepreneurs and investors.
