(2) Níl feidhm ag fo-alt (1) maidir leis na nithe seo a leanas— (a) na reachtanna a shonraítear i Sceideal 1, (b) aon reacht a shonraítear i Sceideal 1 a ghabhann leis an Acht um Athchóiriú an Dlí Reachtúil, 2009 agus atá i bhfeidhm díreach roimh an Acht seo a rith, (c) aon reacht a shonraítear i Sceideal 1 a ghabhann leis an Acht um Athchóiriú an Dlí Reachtúil, 2007 agus atá i bhfeidhm díreach roimh an Acht seo a rith, nó (d) gan dochar d’alt 27 den Acht Léiriúcháin, 2005 agus d’alt 6, aon chosaint, nó aon ní idirthréimhseach nó leanúnach, dá bhforáiltear i leith reachta a aisghaireadh le haon achtachán, nó faoi aon achtachán, a ritheadh roimh an Acht seo a rith. Aisghairmeacha 3.—(1) Ar mhaithe le háis tagartha, leagtar amach i Sceideal 2 sonracha. liosta d’Achtanna a achtaíodh roimh an 6 Nollaig 1922 is Achtanna— (a) nach raibh aisghairthe go hiomlán roimh an Acht seo a rith, agus (b) nach ndéantar iad a chosaint de bhua mhíreanna (a) go (c) d’alt 2(2), agus, chun críocha an fho-ailt seo, folaíonn “aisghairthe go hiomlán” reacht lena mbaineann alt 2(2)(d). Department of History Faculty of Arts Université d’Ottawa\ University of Ottawa © Maxime Dagenais, Ottawa, Canada, 2011 ii ABSTRACT “LE CONSEIL SPÉCIAL EST MORT, VIVE LE CONSEIL SPÉCIAL!” THE SPECIAL COUNCILS OF LOWER CANADA, 1838-1841 Maxime Dagenais Supervisor: University of Ottawa, 2011 Professor Peter Bischoff Although the 1837-38 Rebellions and the Union of the Canadas have received much attention from historians, the Special Council—a political body that bridged two constitutions—remains largely unexplored in comparison. This dissertation considers its time as the legislature of Lower Canada. More specifically, it examines its social, political and economic impact on the colony and its inhabitants. Based on the works of previous historians and on various primary sources, this dissertation first demonstrates that the Special Council proved to be very important to Lower Canada, but more specifically, to British merchants and Tories. After years of frustration for this group, the era of the Special Council represented what could be called a “catching up” period regarding their social, commercial and economic interests in the colony. This first section ends with an evaluation of the legacy of the Special Council, and posits the theory that the period was revolutionary as it produced several ordinances that changed the colony’s social, economic and political culture This first section will also set the stage for the most important matter considered in this dissertation as it emphasizes the Special Council’s authoritarianism.

The following pages will, I hope, throw a long-required light on . the history of the most central county in Ireland. I have endeavoured to explain its ancient and modern formation; and no effort of mine has been spared to describe that transition stage when the land of Longford or Annaly passed away from the ancient to the planter owners. At very considerable expense I have secured an accurate copy of the Patent Rolls of James I., showing, as will be found on perusal, who the ancient owners of every townland in Longford County were, and to whom these lands were conveyed by Royal Letters Patent. If the reader is at all of an inquiring turn of mind, it will be very easy for him to fill up the space of two hundred and sixty years with the names of any old families in these townlands, and he lias as accurate an idea as I can give of who are, and who are not, the " old stock " in Longford County to-day. I am aware that many people, from whom better should be expected, have uot hesitated to describe my previous publications on this subject as an attempt to laudato the O'Farrells, as they say, "because I am a Farrell myself." Such an idea can only be harboured by the ignorant.
