IOWA STATE BAR ASSOCIATION 2016 Affirmative Legislative Program Updated 8/22/2016 Bill Subject Bill Description Bill Status No. HF 2014 Amendments to The Uniform Fraudulent Transfer Act was Signed by Governor 2400 Uniform Voidable approved by the Uniform Law Commission in Branstad on 3/30/16. Transactions Act 1984. It has not been revised or updated since its (Current IA Code original approval. Iowa adopted the Act, which is Chapter 684, presently found in IA Code Chapter 684. In 2014, “Fraudulent the Uniform Law Commission adopted Transfers”) amendments to update the Act, which are being proposed to update IA Code Chapter 684 as follows: • Change the name of the Act from “Uniform Fraudulent Transfer Act” to “Uniform Voidable Transactions Act”. • Choice of Law- Provide that a claim for relief is governed by the local law of the jurisdiction in which the debtor is located when the transfer is made or obligation is incurred. • Evidentiary Matters- Provide uniform rules on allocation of burden of proof and standards of proof relating to operation of the UVTA. • Delete the special definition of “Insolvency” for partnerships. • Revise provisions relating to defenses available to a transferee or obligee. • Clarifies that the UVTA applies to transactions in which a series organization engages. • Replace references to “writing” with “record”. There is an exemption in the law for licensed physicians and surgeons, nurses, chiropractors, dentists, dental hygienists, pharmacists or physical therapists that make dietetic or nutritional assessments, or give dietetic or nutritional advice in the normal practice of their profession or as otherwise authorized by law. However there is no such exemption for holistic nutrition professionals. The Iowa Academy of Dietetics and Nutrition will be holding a Lobbying Workshop along with meetings with key legislators. Recommendations We should politely disrupt the legislative day and urge policymakers to consider finding ways to open up the practice of nutrition. Specifically, we should call attention to parts of the law that are anticompetitive, and encourage them to investigate whether licensure of dietetics prevents competition, by creating a monopoly for a single profession.

More specifically, the State Roster lists the membership of active, policy-making boards and commissions established by state law, executive order of the Governor, or Iowa Court rule. The State Roster may also include advisory councils of a permanent nature whose members are appointed by the Governor, as well as other boards and commissions of interest to the public. The information included herein is furnished in part by state agencies, the Office of the Governor, the General Assembly, and the Supreme Court and reflects appointments generally reported prior to October 1, 2017. It has also been reported that the closing speaker made frequent use of profanity during his presentation and even suggested that students vandalize the property of those who might disagree with their views. In addition, there is evidence that public funds were involved in support of this conference, either directly or indirectly; and thus the concern expressed in this letter. I assure you, these reports are being taken seriously in the Legislature. Hopefully they are also being taken seriously by those who work most closely with Iowa’s students. Therefore, your response to the following questions is respectfully requested, at your earliest convenience. 1. Did faculty and/or staff from your district attend the conference? If so, how many? 2.
