There is an existing premises licence (PR0258) in which The Copas Partnership (“Copas”) are the registered bolder of the premises licence. Copas have agreed with the applicant that it should apply lbr its own premises licence Ibr a designated area within the Temple island Meadows section of the site during the Henley Royal Regatta. The Temple Island Meadows section of the site is shown in the area shaded yellow in the attached drawing marked “A”. Copas require the applicant to retain some flexibility in the designated area due to the nature of the greenfield site and a number of faculties that are sited annually according to sales and operational requirements. For the purposes of this application, the attached drawing marked “B is the designated area with flexibility of 90 metres towards the direction of residents and full flexibility towards the direction away from residents as the exact location within the TempLe Island Meadows section of the site could change subject to the metric limit set out above. The applicant has used the site for the last five years with some changes to the positioning. with no issues. A site layout plan will be included in the Event Safety Managemeni Plans each year. as further detailed in the attached Operating Schedule.

1. Describe the premises. for example the type of premises. its general situation and layout and any other information which could be relevant to the licensing objectives. Where your application includes off-supplies of alcohol and you intend to provide a place for consumption of these off-supplies, you must include a description of where the place will be and its proximity to the premises. 2, In terms of specific regulated entertainments please note that: • Plays: no licence is required for performances between 08:00 and 23.00 on any day. provided that the audience does not exceed 500. • Films: no licence is required for ‘not-for-profit’ film exhibition held in community premises between 08.00 and 23.00 on any day provided that the audience does not exceed 500 and the organiser (a) gets consent to the screening from a person who is responsible for the premises; and (b) ensures that each such screening abides by age classification ratings. • Indoor sporting events: no licence is required for performances between 08.00 and 23.00 on any day, provided that the audience does not exceed 1000. • Boxing or Wrestling Entertainment: no licence is required for a contest, exhibition or display of Greco-Roman wrestling, or freestyle wrestling between 08.00 and 23.00 on any day, provided that the audience does not exceed 1000. Applicants must demonstrate that they have an entitlement to work in the UK and are not subject to a condition preventing them from doing work relating to the carrying on of a licensable activity. They do this by providing with this application copies or scanned copies of the following documents (which do not need to be certified).

• A Registration Certificate or document certifying permanent residence issued by the Home Office to a national ofa European Economic Area country or Switzerland.
• A Permanent Residence Card issued by the Home Office to the family member of a national of a European Economic Area country or Switzerland.

• A current Immigration Status Document containing a photograph issued by the Home Office to the holder with an endorsement indicating that the named person may stay in the UK, and is allowed to work and is not subject to a condition preventing the holder from doing work relating to the carrying on of a licensable activity when produced in eombinafion with an official document giving the person’s permanentNational Insurance number and their name issued by a Government agency or a previous employer.
• A Certificate of Application, less than 6 months old, issued by the Home Office under regulation 17(3) or I 8A (2) of the Immigration (European Economic Area) Regulations
32 2006, to a person who is not a national of a European Economic Area stale or Switzerland but who is a family member of such a national or who has derivative rights of residence.

33 OPERATING SCHEDULE
I For all activities when Third Parties are nominated to take responsibility for the licensable activities under this Premises Licence, suitable details shall be recorded. Nomination of authority is given in writing, in a format which is displayed on site during the licensed activity, as set out by the Licensing Authority. Records are to be maintained by the licence holders, and kept fully up to date and available (or inspection by the Police and/or WBC licensing officer at all times.
2 Staff briefings and/or information packs provided to staff tailored to each relevant event, shall include the following (specific to the event): - An outline of the management structure - Health & safety procedures - Evacuation procedure - The location of fire safeh’ equipment - Licensing laws and underage sales training for bar staff.
3 Rect’rcb of all training shall be kept and available for inspec lion h\ Thames \‘alle\ Police or WBC licensing officer on request;
4 When attendance at an event may be over 600 persons (including staff and performers), Thames Valley Police shall be given a minimum of 11 days prior written notice.
5 During trading hours, a nominated individual with appropriate training and experience must be capable of being identified as being responsible for each particular bar area, that person preferably to be a personal licence holder.
6 The carrying on of licensable activities under this premises licence shall be limited to the whole period of the Henley Royal Regatta.
7 Occupancy levels for each of the areas to be used for licensable activity shall be pre determined in consultation with WBC and other responsible authorities by way of the Event Safety Management Plans (“ESMP”) and risk assessments for each facility within it (see ‘Customer Safety’ below) for each relevant event.
8 A Site Layout Plan will be included in the ESMP each year.
9 Use of the traffic access and egress will be by way of Gate A.
34 b) Prevention of Crime and Disorder
That the premises licence holder ensures that there be prior consultation with Thames Valley Police throughout the planning and operation of the Henley Royal Regatta;
2 Each event to be risk assessed for the need of door supervisors to promote the four ‘licensing objectives’, the risk assessment to be recorded and made available on request to Thames Valley Police or Wokingham Borough Council Licensing officers;
3 Door supervisors will be used and the following shall apply:
i) An adequate number of Security industry Authority (“SIA”) licensed door supervisors must be provided at the premises whenever regulated entertainment takes place. These licensed door supervisors shall be employed solely for the purpose of vetting, regulating, controlling and supervising patrons whilst entering and present on the premises and to ensure the maintenance of good order, customer safety and internal secu ritx;
ii) A register of door supervisors must be kept, recording the following details:
a) The name, and employer’s name of all door supervisors working at the premises; b) SIA registration number; c) Date and time that the door supervisor commenced duty; d) Any occurrence or incident of interest must be recorded giving names of the door supervisors involved; e) Date and time that the door supervisor finished work
These records shall be recorded by the Head of Security on duty during the event.
iii) The door supervisor register must be kept at the licensed premises and be available for inspection by Thames Valley Police or an authorised officer from Wokingham Borough Council and shall be retained for a period of six months following each event;
4 All glasses must be made of plastic or toughened glass.
The Chinawhite Enclosure shall be fenced and controlled with an occupancy level 5 as determined in accordance with clause 7 in the General section of this licence.
35 c) Customer Safety
Event Safety Management Plans (ESMPs) shall be prepared by the DPS and supplied as required for Henley Royal Regatta annually and for all relevant events if required in consultation with all the relevant authorities as set out by the Licensing Act 2003 and agreed with WBC.
2 ESMPs shall incorporate Risk Assessments for each aspect of any event where a risk to the promotion of one or more of the four licensing objective set out in the Licensing Act 2003 might reasonably be anticipated.
3 At all events to which there is an element of ‘employment’ a current certificate of electrical safety in a form prescribed in the Institute of Electrical Engineers Wiring Regulations, signed by a competent person, should be obtained for the electrical installation in connection with the premises (fixed and temporary structures).
4 At all events to which there is an element of ‘employment a current certificate of gas safety signed by a person competent under CORD, should be obtained for the gas installation in connection with the licence (hr fixed and temporar supplies).
5 Arrangements should be made for the first aid treatment of customers who are attending events in connection with the licence.
6 A current certificate showing that the marquee has been constructed safely signed by a competent person, should be submitted for the structures erected in connection with the licence.
7 A current certificate showing that the marquee and all hangings used in the marquee any soft furnishings used are of durably flame retarded fabric or inherently flame- retarded fabric and a certificate should be provided, signed by a competent person, for all such structures erected in connection with the licence.
d) Prevention of Public Nuisance
1. Litter clearance will be undertaken at all events.
2. All amplified speech, music or sound emitted from the premises should not be audible within the nearest noise sensitive premises with the windows open in a manner typical for ventilation before 11.OOHor after 23.OOHon any day, except for race commentaries at rowing events, but in any event not more than 30 minutes before the first race.
3. On not more than 2 days the Music Noise Level (“MNL”) should not exceed 65 dE
(A) measured over a 15 minute period at a 1 metre from the façade of the nearest noise sensitive premise, between the hours of 1LOOHand 23.OOH;on every other
36 night the MNL shall be adequately controlled so as to ensure that the MNL shall not at one metre from the façade of the nearest noise sensitive premises exceed the background noise level by more than 15 CIBAover a 15 minute period throughout the duration of the event. The “Background noise level” shall be taken as the prevailing sound level at a location, measured in terms of the L A90.T, on an equivalent day and at an equivalent time when no concerts or sound checks are taking place.
4. For activities arising out of and in connection with the setting up and dismantling of temporary structures, plus the delivering and assembling of equipment within the premises and similar associated activities, the sound shall be adequately controlled to ensure that, so far as is reasonably practicable, no undue disturbance is caused to the occupiers of residential premises in the vicinity. This will be made a condition of work of any employee, contractor or subcontractor on the premises.
5. The management should ensure that all persons including staff attending functions should leave the premises as quickly and safely as possible at the end of any event. This is with the exception of those involved with night security, necessary site staff and those camping on site and is subject to the ‘opening hours of the premises’ section earlier in H,is licence.
6, The Premise Licence Holder shall:
Provide details at the principal entrance to the Premises, in a conspicuous position, of the telephone number to ring in the event of any enquiry or complaint concerning the event;
ii. Ensure that a responsible person is available to receive and respond to complaints at all times the premises are open to customers;
iii. Make arrangements for details of the caller and the time, date, substance of the complaint and any steps taken at the time or proposed thereafter to address that complain, to be recorded;
iv. Arrange that periodic and regular observation shall be undertaken at or near the boundary to ensure compliance with the noise limits specified in conditions (d) (3) —(5)above and the observations entered into a Logbook which shall be made available for inspection at any time by an authorised officer. e) Protection of Children from Harm

This email is evidence submitted by the Remenham Farm Residents Association “RFRA” opposing the grant of a licence by Wokingham Borough Council “WBC” to Whitefield Limited “the Applicant” for the Chinawhite Enclosure at Temple Island Meadows “the Site”.
The RFRA is a group of 8 owner-occupiers of residential properties in Remenham Lane which lie within the Remenham Church Conservation Area and whose names/addresses/years in residence are given below:
Mr & Mrs Anthony West — Remenham Manor —48years Mr & Mrs David Law — Bamside Cottage —40 years Mr & Mrs John Halsall — Cherwell — 37 years Mr & Mrs Ron Emerson — The Reeds —24 years Mr & Mrs Michael Dudley - The Reach -21 years Mr & Mrs Nigel Gray — Remenham Farmhouse — 19 years Mr & Mrs Neil Brown — The Old Schoolhouse — 10 years Mr Michael Williams — Remenham Barn — 11 years
The objectives of the RFRA are:
Provide a representative interface with WBC and Premises Licence holders. Monitor and report on licensed activities and any associated public nuisance. Maintain the rural environment and secure the rights of ‘quiet enjoyment’.
The Site is the subject of restrictive covenants imposed by Viscount Hambleden in 1948, (the benefit of which is now vested in the National Trust), to protect the rural nature of the land. Over the years WBC has chosen to ignore these covenants when issuing Premises Licences.
The Site is situated wholly within the Parish of Remenharn which is a small rural community evidenced by the fact there are no public services such as mains water, mains sewerage, mains gas and no public transport whatsoever.
This rural aspect is ffirther reinforced by the low Background Noise Level “BNL” measured by WBC during May 2013 showing a level of 34.8dB LA9O at Remenham Manor, the closest residential property to the Site.

Furthermore during the months of July and August the following activities, all prefixed by ‘Henley’ yet nevertheless take place wholly within Remenham Parish and adjacent to Remenham Lane.
Henley Royal Regatta Henley Festival Henley Women’s Regatta Henley Oxford & Cambridge Lightweight Regatta Henley Swim Henley Veterans Regatta Henley Rewind South Music Festival
At a conservative estimate this involves the influx of at least 200,000 people mostly arriving by car and creating immense public nuisance and safety concerns on the access points along Remenham Lane, which is very narrow, in many places single track, and totally unsuited for such volumes of traffic.
We therefore wish to oppose the grant of a licence on the following grounds:
I Public Nuisance
An accepted definition of this is ‘where an activity matenally affects the reasonable comfort and convenience of life ofpeople’. In view of the already multiple activities noted above we consider that the issue of a further Licence on this site will constitute a public nuisance, both in respect of noise, quiet enjoyment and traffic. This view is reinforced by experience, where, despite repeated assurances by various organisers, noise and traffic issues have risen every year with the subsequent increase in public nuisance.
2 Cumulative Impact
Clause 10.2 of the WBC Licensing Policy recognises that the cumulative impact of licensable activities may have an adverse effect on the community in respect of public nuisance and we submit that this contemporaneous Licence is an uimecessary addition to the Site.

3. Is it really essential to have a separate licence?
The Applicant confirms they have operated successthlly under Premises Licence PR0258 for five years or so without any issues. Therefore why can the Applicant not continue with the existing arrangement which appears to have been acceptable to all parties?
Should WBC nevertheless agree to grant a Licence we would ask for the following changes to be made to the OPERATING SCHEDULE.

As you will see we have established a background level of 37.6 dB at Cherwell. Old Blades and UTRC have submitted a background level of 34dB that we have accepted.
We have asked, via Licensing, for results of Copas backgroud monitoirng and await their response. If nothing is heard we will impose the background level that we have established.
