Council Vice President Jenkins called the meeting to order at 9:30 a.m., a quorum being present.

Pursuant to Statutes Section 13D.021, the meeting was held by electronic means and Council Members participated remotely due to the local public health emergency (novel coronavirus pandemic) declared on March 16, 2020.

On direction by Council President Bender, Mayor Jacob Frey’s report relating to the local public health emergency resulting from imminent health conditions caused by the presence of the Coronavirus Disease (COVID-19) was received and filed, as set forth in Legislative File No. 2020-00405.

Jenkins moved to adopt Resolution 2021R-001 entitled “Approving and extending the Mayor’s Declaration of Local Public Health Emergency resulting from imminent health conditions caused by the presence of the Coronavirus Disease (COVID-19),” adopted March 19, 2020, ratifying and extending Mayoral Regulation 2020-020 setting rules for third-party food delivery platforms and services and 2020-021 allowing City employees access to leave when they are unable to work for specified COVID-19 reasons.

Amending Resolution 2020R-075 entitled “Approving and extending the Mayor’s Declaration of Local Public Health Emergency resulting from imminent health conditions caused by the presence of the Coronavirus Disease (COVID-19),” adopted March 19, 2020.

Whereas, the City of Minneapolis, Minnesota, has a current local public health emergency resulting from imminent health conditions caused by presence of the Coronavirus Disease (COVID-19); and

Whereas, pursuant to the provisions set forth in Minnesota Statutes, Chapter 12.29, and the Minneapolis Code of Ordinances, Section 128.50, Mayor Frey declared a state of local public health emergency within the City of Minneapolis on Monday, March 16, 2020, to be and remain in force and effect beginning that date and continuing for as long as the State of Minnesota peacetime emergency declaration remains in effect, which declaration of local public health emergency was ratified and continued by the City Council pursuant to Resolution No. 2020R-075; and

Whereas, subsequent to adoption of Resolution No. 2020R-075, Mayor Frey proclaimed Emergency Regulation 2020-20, setting rules for third-party food delivery platforms and services; and

Whereas, subsequent to adoption of Resolution No. 2020R-075, Mayor Frey proclaimed Emergency Regulation 2020-21, allowing City employees access to leave when they are unable to work for specified COVID-19 reasons; and

Whereas, the City Council now desires to account for these subsequent actions and to provide further and additional provisions by amending Resolution No. 2020R-075;

Now, Therefore, Be It Resolved by The City Council of The City of Minneapolis:

That in accordance with Section 128.50 of the Minneapolis Code of Ordinances (Declaration of Emergency), the City Council does hereby ratify the state of local public health emergency proclaimed by Mayor Frey on Monday, March 16, 2020, pertaining to the City of Minneapolis and all its residents.

That the declared state of local public health emergency shall continue and does hereby remain in force and in effect for the same time period as the peacetime emergency declaration issued by Governor Walz for the State of Minnesota, or until such time as the City Council, by official action, may further extend or terminate the declared state of local public health emergency for the City of Minneapolis.

That meetings of the City Council and its Committees, and of the boards and commissions of the City, shall be conducted by telephonic or other electronic means until further action and direction by the City Council, and staff are directed to provide public notice on the ways in which such meetings may be accessed and monitored from remote locations, as authorized pursuant to Minnesota Statutes, Section 13D.021.

That pursuant to Minneapolis Code of Ordinances, Section 128.80, the Mayor’s Emergency Regulations Nos. 2020-1, 2020-2, 2020-5, 2020-6, 2020-7, 2020-8, 2020-9, 2020-12, 2020-13, 2020-14, 2020-17, 2020- 18, and 2020-19, 2020-20, and 2020-21 are hereby ratified and shall be extended throughout the duration of the declared state of local public health emergency, until such time as they may be renewed by further action of the Mayor, or until such time as the City Council, by official action, may further extend or terminate said emergency regulations.

Be It Further Resolved that the City Council hereby directs the City Clerk to publish and post this resolution ratifying the declared state of local public health emergency in the City of Minneapolis, including posting on the City’s website and official bulletin boards.

PROCLAMATION OF THE MAYOR Emergency Regulation No. 2020-20

Whereas, on March 16, 2020, I declared a local public health emergency related to the COVID-19 pandemic in the City of Minneapolis and assumed executive responsibilities attendant thereto; and Whereas the COVID-19 pandemic and resultant local and state emergency regulations and executive orders continue to restrict the operational options and capacities of licensed food establishments within the city, thereby increasing the need for take-out meal services; and Whereas, the necessary public health operating restrictions within the city have had severe and ongoing financial impacts on all food service establishments within the city; and

Whereas, while some restaurants may receive take-out orders directly, there are many third-party food delivery platforms and other services that operate through websites and/or mobile phone applications used by consumers to quickly and easily order pick-up and delivery meals from local restaurants; and Whereas, in many instances the third-party food delivery platforms and services, without the local restaurant’s knowledge or consent, will purport to sell meals from the local restaurant to consumers, and sometimes charge exorbitant fees to the already struggling local restaurants during the time of the declared emergency and the operational restrictions attendant thereto; and Whereas, the fees charged by a third-party food delivery platform should be capped for the period that the local public health emergency results in necessary restrictions on the operations of licensed food establishments to avoid further harm to such valuable and important establishments in the city; and Whereas, pursuant to the authority granted to me pursuant to Minnesota Statutes, Ch. 12.29, and Minneapolis Code of Ordinances, Sections 128.50 and 128.60, I am authorized to promulgate emergency regulations to protect the public health, safety, and welfare during this declared emergency; and Whereas, it is a priority that race and equity be of paramount consideration in enacting and carrying out emergency regulations during the COVID-19 pandemic; and Whereas, to aid in these efforts, pursuant to the emergency authorities vested in the Mayor pursuant to the emergency declaration to make and issue rules and regulations on matters reasonably related to the protection of life and property as affected by such emergency and adopt additional protections for the preservation of public health and safety; NOW, THEREFORE, I, Jacob Frey, Mayor of the City of Minneapolis, do hereby order the following emergency regulation: 1. A third-party food delivery platform shall not perform any service for or disclose any information about a licensed food establishment without the consent of the licensed food establishment. 2. A third-party delivery food platform shall not charge any additional fee to a licensed food establishment that the licensed food establishment has not voluntarily agreed to pay. 3. No person shall cause a third-party food delivery platform to charge a licensed food establishment a commission fee for the use of the platform's services for delivery or pick-up that exceeds fifteen percent (15%) of the purchase price per online order. The provisions of this emergency regulation shall not limit the ability of any licensed food establishment to choose to pay a higher commission or supplemental fee to access additional advertising or other products and services offered by any third-party food delivery platform. 4. No person shall cause a third-party food delivery platform to reduce the compensation rate paid to a delivery service driver or request that a delivery service driver accept lower compensation in the future or garnish gratuities in order to comply with the terms of this emergency regulation. 5. At the time a final price is disclosed to a customer for the intended purchase and delivery of food from a licensed food establishment through a third-party food delivery platform and before that transaction is completed by the customer, the third-party food delivery platform shall disclose to the customer, in plain language and in a conspicuous manner, any commission, fee, or any other monetary payment charged to the customer by the third-party food delivery platform. 6. After a transaction occurs for the purchase and delivery of food from a licensed food establishment through a third-party food delivery platform, the third-party food delivery platform shall provide an electronic or printed receipt to the customer. The receipt shall disclose, in plain and simple language and in a conspicuous manner: (i) the menu price of the food; (ii) any sales or other tax applied to the

transaction; (iii) any delivery charge or service fee, imposed on and collected from the customer by the third-party food delivery platform and by the covered establishment, in addition to the menu price of the food; (iv) any tip/gratuity that will be paid to the person delivering the food, and not to the third-party food delivery platform, that was added into the transaction when it occurred, and (v) any commission associated with the transaction as referenced in paragraph 3 of this emergency regulation, not including any agreed-upon higher commission or fee for access to additional advertising or other products or services. 7. No third-party food delivery platform may charge any fee from a licensed food establishment for a telephone order if a telephone call between such licensed food establishment and a customer does not result in an actual transaction during such telephone call. 8. Subject to any rules and regulations or guidance that may be issued by the licensing official, any licensed food establishment or delivery service driver may submit a complaint of a violation of this section to the licensing official. Any such complaint shall be made in writing to the licensing official and shall include all information relied upon by the licensed food establishment. 9. The licensing official shall investigate written complaints, shall notify any third-party food delivery platform alleged to have violated this emergency regulation of any complaint, and shall provide a summary of findings regarding any such complaint to both the complainant and the third-party delivery platform. Third-party food delivery platforms shall maintain books and records sufficient for the licensing official to conduct an investigation and issue an assessment. Such books and records shall be made available to the licensing official upon demand. 10. If the licensing official determines a violation of this emergency regulation has occurred, the third- party food delivery platform may be subject to the administrative enforcement and hearing process of Chapter 2 of the Minneapolis Code of Ordinances, each day a violation of this emergency regulation occurs. For purposes of this emergency regulation, the continuation of a violation shall be a separate violation for each day the licensing official determines a third-party food delivery platform has violated this article. The licensing official shall be authorized to enforce the terms of this emergency regulation through the issuance of written notices and warnings and/or through the issuance of administrative citations or referral for misdemeanor prosecution or any other legal or equitable relief authorized by law.

Definitions: 1. "Licensed food establishment" shall have the meaning provided pursuant to the Minnesota State Food Code and the Minneapolis Code of Ordinances. 2. "Licensing official" means the licensing official of the business licensing division or that individual’s delegees. 3. "Online order" means an order placed by a customer through a platform provided by the third-party food delivery platform for delivery or pickup within the city. 4. “Person” shall have the meaning provided pursuant to MCO § 3.60. 5. "Purchase price" means the menu price of an online order, excluding taxes, gratuities, or any other fees that may make up the total cost to the customer of an online order. 6. "Telephone order" means an order placed by a customer to a licensed food establishment through a telephone call forwarded by a call system provided by a third-party food delivery platform for delivery or pickup within the city.

7. "Third-party food delivery platform" means any person, website, mobile application, or other internet service that offers or arranges for the sale of food and beverages prepared by, and the same-day delivery or same-day pickup of food and beverages from, licensed food establishments.

Additional Terms: 1. This Order is effective at 12:00 a.m. (CST) December 23, 2020, and continuing until further notice or until it is extended, rescinded, superseded, or amended, or until the declaration of the local public health emergency expires. 2. A violation of this Emergency Regulation may be enforced by the issuance of notices, warning letter(s), administrative citation(s), and/or misdemeanor prosecution or any other legal or equitable relief authorized by law. Minn. Stat. § 12.45; MCO § 1.30 and MCO § 259.250. A violation shall be considered an offense subject to administrative enforcement pursuant to MCO § 2.40.

PROCLAMATION OF THE MAYOR Emergency Regulation No. 2020-21

Whereas, on March 16, 2020, I declared a local public health emergency related to the COVID-19 pandemic in the City of Minneapolis and assumed executive responsibilities attendant thereto; and Whereas, the Families First Coronavirus Response Act (FFCRA) and City of Minneapolis Emergency Regulation No. 2020-18 (amending Emergency Regulations 2020-6 and 2020-14) providing leave for absences due to illness, quarantine, and school and place of care closure as a result of COVID-19 expire as of December 31, 2020; Whereas, the COVID-19 pandemic and resultant local and state emergency regulations and executive orders continue to have ongoing impacts upon employees’ capacity and ability to perform work; and Whereas, additional emergency leave is needed to be made available to City employees during this continuing declared local public health emergency; Whereas, this regulation will allow City employees access to leave when employees are unable to work for specified COVID-19 reasons. Whereas, pursuant to the authority granted pursuant to Minnesota Statutes, Ch. 12.29, and Minneapolis Code of Ordinances, Sections 128.50 and 128.60, I am authorized to promulgate emergency regulations to protect the public health, safety, and welfare during this declared emergency, including providing emergency leave to City employees. Whereas, to aid in these efforts, pursuant to the emergency authorities vested in the Mayor to make and issue rules and regulations on matters reasonably related to the protection of life and property as affected by such emergency and adopt additional protections for the preservation of public health and safety; NOW, THEREFORE, I, Jacob Frey, Mayor of the City of Minneapolis, do hereby order the following emergency regulation: 1. The City will provide eligible full-time employees with 80 hours of 2021 COVID-19 Emergency Sick Leave in accordance with the provisions of this emergency regulation.

2. The City will provide eligible part-time or intermittent employees a prorated amount of 2021 COVID-19 Emergency Sick Leave hours based upon the employee’s standard hours as listed in COMET job data as of January 1, 2021. 3. Temporary, seasonal, permit and outside trades employees are not eligible for the 2021 COVID-19 Emergency Sick Leave. 4. The 2021 COVID-19 Emergency Sick Leave can be used in one-hour increments. 5. Employees can use the 2021 COVID Emergency Sick Leave to be absent from work due to any of the following six circumstances: (1) The employee is subject to a Federal, State, or local quarantine or isolation order related to COVID- 19 and unable to work remotely. (2) The employee has been advised by a health care provider to self-quarantine due to concerns related to COVID-19. (3) The employee is experiencing symptoms of COVID-19 and seeking a medical diagnosis. (4) The employee is caring for the child of such employee if the school or place of care of the child has been closed, or the childcare provider of such child is unavailable, due to COVID–19 precautions. (5) The employee is experiencing any other substantially similar condition specified by the Secretary of Health and Human Services in consultation with the Secretary of the Treasury and the Secretary of Labor. (6) The employee has received the COVID vaccine and experiences illness following receipt of the vaccine. 6. The 2021 COVID-19 Emergency Sick Leave will be paid at 100% the respective employee's regular base wage. The 2021 COVID-19 Emergency Sick Leave pay does not include overtime, shift pay, supplemental pay and/or other additional pay and is based on the employee’s certified (Zero) record in COMET. 7. The 2021 COVID-19 Emergency Sick Leave is a separate type of leave above and beyond normal accrued leave and shall not be counted against sick, personal, vacation, or comp time, or time awarded as a result of 2020 Emergency Responder leave. 8. Employees shall use 2021 COVID-19 Emergency Sick Leave for COVID-19 related absences as indicated in paragraph 5 above prior to using other leave types including sick, vacation, comp time, time awarded as a result of 2020 Emergency Responder leave, or Injured on Duty (IOD) pay. Additional Terms: 1. This Order shall become effective beginning at 12:00 a.m. (CST) on January 1, 2021. 2. If Federal or State law is enacted to address this subject, this Emergency Regulation will be made null and void and the City will follow the law as it is enacted.

COUNCIL ACTION 2021A-0002 The Minneapolis City Council hereby: 1. Directs staff to include a summary of public comments in the 2020 Consolidated Plan Action Plan Amendment. 2. Authorizes submittal of an Amendment to the 2020 Consolidated Plan Action Plan to the U.S. Department of Housing and Urban Development (HUD) outlining uses of Housing Opportunities for Persons With AIDS (HOPWA-CV) funding and programming recommendations, as set forth in Legislative File 2020-01235. 3. Accepts a HOPWA-CV grant from HUD in the amount of $252,199, to address COVID-19 response actions for eligible HOPWA persons. 4. Authorizes a grant agreement with HUD to receive HOPWA-CV funding. 5. Authorizes agreements with Clare Housing, JustUs Health and Hennepin County to implement HOPWA-CV programming. 6. Passage of Resolution 2021R-002 approving appropriation of funds to the Finance and Property Services Department.

Honoring Robin Hutcheson for her service and dedication to the City of Minneapolis.

Whereas, Robin Hutcheson began her employment with the City of Minneapolis on August 29, 2016, and has led the Public Works Department with her core values of collaboration, partnership, and communication dedicated to prioritizing equity and diversity in the department’s workforce, project prioritization, design and engagement; and

Whereas, with her forward-thinking leadership skills, genuine support of the over 1000 Public Works employees, and a drive toward results, Ms. Hutcheson has led the Department with pride, always showing up and successfully delivering; and

Whereas, Ms. Hutcheson is a leader in transformative transportation infrastructure and systems with an emphasis on equity, safety and preparing for change who led with a vision of leveraging public right of way investments with a focus on City goals, including resiliency, climate change, mobility, and economic vitality; and

Whereas, Ms. Hutcheson led the department through several significant completed and on-going projects and initiatives including Nicollet Mall, Hennepin Avenue, 10th Ave Bridge and Water Main, Peavey Plaza, Samatar Crossing, St. Anthony Parkway bridge, Fridley Water Plant Rehabilitation, proactive sidewalk inspections, 20-year Streets Funding Plan implementation, curb-protected bike lanes, lower speed limits,

bus only lanes, Vision Zero, and the Transportation Action Plan, all of which will continue to have significant positive impact on the City for many years to come; and

Whereas, Ms. Hutcheson expertly led the department through major events including the Super Bowl, NCAA Final Four, and X Games as well as nineteen Snow Emergencies and the 2019 winter parking restrictions; and

Whereas, Ms. Hutcheson led the department through the challenges and changing needs due to the pandemic, including employee protections, Stay Healthy Streets, restaurant pick up zones, and uninterrupted basic services; and

Whereas, Ms. Hutcheson directed the Public Works team through the clean-up following civil unrest, created a Public Works Equity Committee, led the renaming of 38th and Chicago to George Perry Floyd Jr Place, as well as beginning the important work surrounding the future of the intersection; and

Whereas, Ms. Hutcheson is widely respected by a broad array of local, national and international partners and stakeholders, and regularly sought out for advice on transportation, mobility and sustainability issues; and

Whereas, Ms. Hutcheson made significant strides leading a data-driven environment while prioritizing equity and access in the department and City-wide work and the roll out of Mobility Hubs, scooters, dockless and e-bikes; and

Whereas, Ms. Hutcheson served as a role model and mentor for staff at all levels, especially women aspiring to leadership positions and created opportunities for employees to build on their leadership skills through programs like Every Day Leadership; and

Whereas, Ms. Hutcheson serves as the President on the Board of Directors of the National Association of City Transportation Officials, in addition to sponsoring a FUSE fellowship, serving on the Executive Committee for the Center for Transportation Studies, and the board of the Open Mobility Foundation which have all served to increase creative capacity, expand expertise, and bring best practices to Minneapolis; and

Whereas, Ms. Hutcheson has demonstrated true care and commitment for the residents, businesses, and visitors of Minneapolis and has used her leadership of the Public Works Department to make positive advancements, and by empowering her team and serving as a partner with other City departments, earning the trust, confidence, and admiration of elected officials, her colleagues, and staff throughout the City; and

Whereas, Ms. Hutcheson will be deeply missed by the City's elected officials, department heads, staff and fellow members of the Public Works Department as a leader, mentor, colleague and friend;

Now, Therefore, Be It Resolved by The City Council of The City of Minneapolis:
