(1) (a) An individual who, immediately before the relevant date holds a valid certificate issued by a certification body in the United Kingdom under Article 5 of Commission Regulation (EC) No 304/2008 of 2 April 20081 in respect of an activity referred to in Article 2(1) of that Commission Regulation is deemed, for the purpose of carrying out that activity, to hold an equivalent certificate. (b) An individual who, immediately before the relevant date holds a valid certificate issued by a certification body in the United Kingdom under Article 3 of Commission Regulation (EC) No 306/2008 of 2 April 20082 in respect of an activity referred to in Article 1 of that Commission Regulation is deemed, for the purpose of carrying out that activity, to hold an equivalent certificate. (c) An individual who, immediately before the relevant date holds a valid certificate issued by a certification body in the United Kingdom under Article 3 of Commission Implementing Regulation (EU) 2015/2066 of 17 November 20153 in respect of an activity referred to in Article 1 of that Commission Regulation is deemed, for the purpose of carrying out that activity, to hold an equivalent certificate. (d) An individual who, immediately before the relevant date holds a valid certificate issued by a certification body in the United Kingdom under Article 4 of Commission Implementing Regulation (EU) 2015/2067 of 17 November 2015yes in respect of an activity referred to in Article 2(1) of that Commission Regulation is deemed, for the purpose of carrying out that activity, to hold an equivalent certificate. (e) An individual who, immediately before the relevant date holds a valid training attestation issued by an attestation body in the United Kingdom under Article 3 of Commission Regulation (EC) No 307/2008 of 2 April 2008 in respect of an activity referred to in Article 1 of that Commission Regulation is deemed, for the purpose of carrying out that activity, to hold an equivalent training attestation. (2) An individual who holds an equivalent certificate or equivalent training attestation may carry out the activity to which the equivalent certificate or equivalent training attestation relates until the date that is 6 months from the relevant date or the date on which a certificate or training attestation is issued by the Agency under subsection (3), whichever is earlier. (3) An individual who holds an equivalent certificate or equivalent training attestation shall apply to the Agency not later than 4 months after the relevant date for the issue by it of a certificate or training attestation in respect of the activity to which the equivalent certificate or training attestation relates and such certificate or training attestation shall, subject to subsection (4), be issued by the Agency not later than 6 months after the relevant date. (4) The Agency shall issue a certificate or training attestation where an application is made in accordance with the procedures established by the Agency in that behalf.”.

(b) A company which, immediately before the relevant date holds a valid certificate issued by a certification body in the United Kingdom under Article 6 of Commission Implementing Regulation (EU) 2015/2067 of 17 November 2015 in respect of an activity referred to in Article 2(2) of that Commission Regulation is deemed, for the purpose of carrying out that activity, to hold an equivalent certificate. (2) A company which holds an equivalent certificate may carry out the activity to which the equivalent certificate relates until the date that is 6 months from the relevant date or the date on which a certificate is issued by the Minister under subsection (3), whichever is earlier. (3) A company which holds an equivalent certificate shall apply to the Minister not later than 4 months after the relevant date for the issue by the Minister of a certificate in respect of the activity to which the equivalent certificate relates and such certificate shall, subject to subsection (4), be issued by the Minister not later than 6 months after the relevant date. (4) The Minister shall issue a certificate where an application is made in accordance with the procedures established by the Minister in that behalf. Statement of Principles 92. (1) On withdrawal of the United Kingdom from the European Union, European Union principles and legislation shall remain the standard for cross border bodies co- operating on the environment. (2) The Minister shall strengthen and build upon existing cross border agencies to ensure continuing cross border co-operation on environmental issues.”. —Eamon Ryan. 72. Special report on cross border co-operation on nuclear waste 92. (1) The Minister, in consultation with the Minister for Housing, Planning and Local Government, shall request the Head of the Defence Forces and the Irish Naval Service to provide a joint report and recommendations to the Oireachtas on the increased risk to Ireland presented by the withdrawal of the United Kingdom from the Euratom Treaty, and in particular in relation to the monitoring and supervision of the 12 mile nautical limit to the State’s territorial waters. (2) On withdrawal of the United Kingdom from membership of the European Union, the report in subsection (1) shall be laid before the Houses of the Oireachtas within 3 months of the enactment of this legislation.”. —Eamon Ryan.

Reporting obligations 92. (1) The Minister, in consultation with the Minister for Agriculture, Food and the Marine, and cross border environmental organisations, shall commission a report and recommendations on the implications of regulatory divergence on environmental matters on withdrawal of the United Kingdom from membership of the European Union. (2) The report and recommendations in subsection (1) will include, but not be restricted to, the following assessment of: (a) the need for additional biosecurity measures; (b) the need for protection against invasive species; (c) the need for cross border oversight on nuclear, including UK withdrawal from the Euratom Treaty; (d) measures to maintain coherence of an all-island Natura 2000 framework; (e) measures to protect cross border water resources and basins; (f) measures to prevent cross border illegal dumping and pollution; (g) measures to ensure and encourage regulatory convergence in line with existing and developing European Union environmental legislation. (3) In the writing of the report referred to in subsection (1) regard will be had to the island of Ireland being a single epidemiological and biogeographic unit with a shared environmental history and cultural heritage. (4) The report and accompanying recommendations in subsection (1) shall be before the Houses of the Oireachtas within 3 months of the enactment of this legislation.”. —Eamon Ryan. TITLE 74.
