Jest wynikiem nie tylko jego zdol- noci poznawczych, ale przede wszystkim konsekwencj¹ istnienia ró¿norod- nych form substancji (bytów) i przypad³oci (cech). Poznanie to najczêciej ma charakter spontaniczny, przypadkowy, a w rezultacie nie prowadzi do konstruktywnych wniosków czy systematyzacji rzeczywistoci. Tym bowiem zajmuje siê nauka w ró¿nych dziedzinach i obszarach problemowych. Mo¿na zatem mówiæ o metodzie porównawczej w naukach medycznych, przyrodni- czych czy ekonomicznych. W naukach prawnych natomiast porównuje siê systemy prawne, rodziny prawa, instytucje prawne, a tak¿e pojêcia i ich znaczenie. Wa¿ne, by okreliæ wczeniej cel porównywania. W potocznym rozumieniu komparatystyka prawna kojarzy siê z poszuki- waniem lepszych rozwi¹zañ celem wdro¿enia ich do rodzimego systemu prawnego. Tymczasem jej podstawow¹ funkcj¹ jest funkcja poznawcza, która pozwala na wychwycenie istniej¹cych podobieñstw i ró¿nic bez koniecznoci szukania wspólnego mianownika. Metoda komparatystyki porównawczej nie ma bowiem prowadziæ do stworzenia systemu prawa porównawczego. Tako- we istnieje wy³¹cznie w obszarze prawa miêdzynarodowego. W badaniach komparatystycznych winno siê d¹¿yæ do wychwycenia funkcji, jakie w danym systemie spe³niaj¹ instytucje prawne, pojêcia prawne czy konkretne rozwi¹- zania. Takie rozumienie badañ komparatystycznych pozwala na lepsze funk- cjonowanie w globalizuj¹cym siê wiecie zarówno jednostkom, jak i przedsiê- biorcom. Wydzia³ Prawa i Administracji Uniwersytetu Warmiñsko-Mazurskiego w Olsztynie przy wspó³pracy wydzia³ów prawa ze S³owacji, w szczególnoci z Uniwersytetu M. Bela w Bañskiej Bystrzycy, oraz pod patronatem prof. Ch. v. Bara z Uniwersytetu w Osnabrück w 2011 r. rozpocz¹³ organizacjê serii konferencji powiêconych badaniom komparatystycznym. Celem tego przedsiêwziêcia jest stworzenie miêdzynarodowej grupy badaczy z Europy rodkowo-Wschodniej oraz wypracowanie przedmiotu i metod badawczych na nastêpne lata. Udzia³ w pierwszym takim spotkaniu zg³osi³o ponad stu 6 S³owo wstêpne prawników z piêciu pañstw: Polski, S³owacji, Czech, Niemiec i Ukrainy. Przy- jêto doæ szerok¹ formu³ê tematyczn¹, tak aby jak najwiêksza liczba naukow- ców mog³a wzi¹æ udzia³ w konferencji. Usprawiedliwieniem dla takiego roz- wi¹zania

The “7+3” charges ban Tymoshenko from the next two presidential and three parliamentary elections. The sentence, refusal to heed the flood of Western criticism and the new charges against Tymoshenko only one day later led the EU to cancel the October 20 visit to Brussels by Yanukovych. The Ukrainian Security Service (SBU) has launched two new charges against Tymoshenko related to when she was CEO of United Energy Systems in 1995-1997 and the assassination of Viktor Yushchenko’s protégé Vadym Hetman in 1998. Ten factors explain how and why the Yanukovych administration dug itself into a hole. Feral elites: Ukraine’s elites have little connection to society whose citizens and voters they treat with contempt and do not feel any responsibility toward. Feral elites believe the world is Machiavellian and the ends justify the means. Most Western media coverage used language similar to the Economist (October 11) to describe Yanukovych as “thuggish and vindictive” (The Times, October 14, The New York Times, October 17). National interests: personal and business interests are of greater importance than Ukraine’s national interests. Revenge against Tymoshenko for removing the opaque gas intermediary RosUkrEnergo from the 2009 gas contract with Russia is more important for the feral elites than European integration.

The authors argue the problem of war crimes and collaboration in the modern information society and its resolution is important for Ukraine, especially in the context of a powerful information confrontation between the Russian Federation and Ukraine as part of a hybrid war. Based on the processed documents and literature, the authors propose their own definition of collaboration and its manifestations by definition and typology. It was concluded that the Soviet totalitarian system had morally maimed many generations of people. The ideological and political uncertainty, confusion, social amorphism of a certain part of Ukraine's population, the pro-Kremlin orientation of a part of Ukrainian politicians are still the main cause of collaboration and war crimes in Ukraine. Western Europe is characterized by the lawful and generally accepted international practice of prosecuting war criminals. In the former Soviet Union, this process was accompanied by mass violations of human rights, politicization of the judiciary, the application of collective responsibility, ignoring the principle of the presumption of innocence, and so on.

In this context, it is advisable to identify qualitatively the local area, which is not only a guarantee of their subjectivity and sustainability, but also the basis for the strategies forming for their socio- economic development, the realism and effectiveness of which is based on sustainable development management as well as administrative and financial capacity of communities. However, as practice has shown, most local areas, although willing to identify their unique features, but do not know how to do it, because the current legal field in Ukraine does not regulate the procedure and criteria for such identification. This article was an attempt to research the managerial possibilities of creating a positive image of the territory through the sustainable development and choice of appropriate assessment parameters – the criteria for identifying the amalgamated territorial communities of Ukraine as local territories. As a result of the research, a model list of such criteria is proposed, which is sufficiently universal to determine the unique and typical characteristics of any territories, and also contains a specific subsystem that allows reflecting the individual features of territories close to the armed conflict zone in the Eastern Ukraine.

Vadym Hetman Kyiv National Economic University KNEU’s history In 1997, the President of Ukraine granted Kyiv State Economic University the status of a national university in recognition of its substantial work focused on training highly qualified specialists and the development of the economic science. In 2005, Kyiv National Economic University was named after Vadym Hetman, a prominent Ukrainian economist and the founder of the domestic currency of Ukraine, the builder of its banking sector.
