O R D E R

Sri H. Upendra Chary, Yadadri Bhuvanagiri District has filed a Complaint dated 14-02-2018 which was received by this Commission on 17-02-2018 for not getting the information sought by him from the PIO / O/o the Gram Panchayat, Yadagirigutta Village and Mandal, Yadadri Bhuvanagiri District.

The brief facts of the case as per the Complaint and other records received along with it are that the Complainant herein filed an application dated 18-12-2017 before the PIO requesting to furnish the information under Sec.6(1) of the RTI Act, 2005, on the following points mentioned in his application annexed.

The Public Information Officer / O/o the Gram Panchayat, Yadagirigutta Village and Mandal, Yadadri Bhuvanagiri District, Vide Letter No. GPY/RTI/03/2016-17, Dated 19-01-2018, has informed to the Complainant that the sought information is voluminous and as they are burdened with the election work, the same will be furnished by date 06-02-2018.

As the Complainant did not receive the required information from the PIO even after 30 days of filing his application, he preferred this Complaint before the Commission requesting to arrange to furnish the information sought by him u/s 18(1) of the RTI Act, 2005.

The Complaint was taken on file and notices were issued to both the parties for hearing on 28-3-2019.

On 28-3-2019 the case is called. The complainant is present. The Public Information Officer, O/o the Gram Panchayath, Yadagirigutta Village is absent. Notice sent to the Public Information Officer is returned with the endorsement “No Gram Panchayath Office in Yadagirigutta. It has become Municipal Office. “Hence returned”.

The complainant submitted that he did not receive the sought information from the PIO.

The case was adjourned.

On 10-12-2019 the case is called. When the case was earlier called on 28.03.2019 the complainant was present and submitted that he did not receive the sought information from the Public Information Officer. The notice sent to the Public Information Officer, O/o the Gram Panchayath, yadagirigutta Village was returned with the endorsement “No Gram Panchayath Office in Yadagirigutta. It has become Municipal Office. Hence returned”. The case was adjourned with a direction to call the Public Information Officer, Municipal Office, Yadagirigutta.

Today when the case is called the complainant and the Public Information Officer, O/o the Municipal Commissioner, Yadagirigutta Municipality are absent.

A perusal of the record goes to show that the Public Information Officer, O/o the Municipal Commissioner did not furnish the information sought to the complainant.

The Commission directs the Public Information Officer, O/o the Municipal Commissioner, Yadagiri Gutta Municipality to furnish the sought information to the complainant within one week from the date of receipt of this order and submit compliance report to the Commission.

With the above direction, the complaint is closed.
