J U D G M E N T These cases were considered on petitions for review from the Federal Communications Commission, and on the briefs and oral arguments of the parties. The Court has afforded the issues full consideration and has determined that they do not warrant a published opinion. See Fed. R. App. P. 36; D.C. Cir. R. 36(d). It is ORDERED and ADJUDGED that the petitions for review of the orders of the Federal Communications Commission be DENIED. Petitioner PMCM TV, LLC obtained a license from the Federal Communications Commission to operate television station WJLP in northern New Jersey on radio-frequency channel 3, the same radio-frequency channel used by PMCM’s predecessor station in Nevada. However, the FCC assigned WJLP virtual channel 33, the channel to which viewers tune their televisions in order to watch WJLP. The FCC did this to protect the “Channel 3” brand identity of intervenor broadcasters that already used virtual channel 3 in service areas that overlapped with that of WJLP. For similar reasons, the FCC refused to require cable operators to carry WJLP on cable television as “Channel 3.” PMCM seeks review of both decisions. -

Wood SVP/Associate General Counsel-Gov and Reg Affairs Unimas Dallas, LLC 5999 Center Drive Los Angeles, CA 90045 Re: Interference Acceptance – KSTR, Dallas, TX Dear Mr. Wood: KTPN-LD, Tyler, Texas (the “Station”), a MyNetworkTV affiliate low power television station licensed to Warwick Communications, Inc., an indirect subsidiary of White Knight Broadcasting, Inc., is authorized to operate on Channel 48 in the Tyler-Longview (Lfkn&Ncgd), TX Designated Market Area (“DMA”). The Station is currently silent (See FCC LMS File No. 00000068468). The Station’s MyNetworkTV programming is now carried in the DMA on the digital subchannel of commonly owned KFXK-TV, Longview, Texas. It is our understanding that Unimas Dallas LLC (“Unimas”) intends to submit a Request for a DTV Experimental Special Temporary Authority (“STA”) in connection with the deployment of a single frequency network (“SFN”) associated with KSTR-DT, Irving, Texas. Unimas’ proposed SFN operation will utilize Channel 48 in connection with the conversion of KSTR-DT’s transmission facilities pursuant to the ATSC 3.0 transmission standard, which was recently authorized by the Commission. See FCC LMS File No. 0000063555. The proposed STA is intended to supplement the recently granted authorization to effectuate the KSTR-DT ATSC 3.0 conversion. Three sites in addition to the main KSTR-DT transmission site will comprise the SFN. Based upon predicted signal reach of the KSTR’s signal and the SFN nodes, KTPN-LD may receive interference in excess of that allowable under FCC rules. Interference prediction is 2.2% of KTPN’s audience. -

The ATSC member organizations represent the broadcast, broadcast equipment, motion picture, consumer electronics, computer, cable, satellite, and semiconductor industries. Specifically, ATSC is working to coordinate television standards among different communications media focusing on digital television, interactive systems, and broadband multimedia communications. ATSC is also developing digital television implementation strategies and presenting educational seminars on the ATSC standards. ATSC was formed in 1982 by the member organizations of the Joint Committee on InterSociety Coordination (JCIC): the Electronic Industries Association (EIA), the Institute of Electrical and Electronic Engineers (IEEE), the National Association of Broadcasters (NAB), the National Cable Telecommunications Association (NCTA), and the Society of Motion Picture and Television Engineers (SMPTE). INTRODUCTION 1. Parker Broadcasting of Dakota License, LLC (“Parker”), licensee of commercial broadcast television station KRDK-TV, Valley City, North Dakota, filed the above-captioned must carry complaint pursuant to Sections 76.7 and 76.61 of the Commission’s rules,1 seeking to ensure carriage on cable channel 4, the channel number corresponding to the station’s PSIP2 channel assignment, on cable systems operated by Cable One, Inc. (“Cable One”) in the Fargo-Valley City, North Dakota designated market area (Fargo-Valley DMA).3 Cable One filed an answer to Parker’s Complaint stating that it would commence carriage of KRDK-TV by July 1, 2016, but it has now refused to do so.”4 Gray Television Licensee, LLC (“Gray”) filed comments, and Parker filed a reply.5 For the reasons that follow, we grant Parker’s Complaint.
