1.0 SUMMARY 1.1 The purpose of this report is:

1.1.1 To inform the Head of Regeneration & Development of the need to implement the proposal the subject of the above Traffic Regulation Order (TRO)

1.1 .2 To seek authorisation to publish a "Notice of Proposals" and:

a) .... where no objections are received or where objections are subsequently withdrawn "Make" the TRO and implement the proposal and:

b) ....where objections are received and not subsequently withdrawn, report the details of the objections together with Officels recommendations so that further instructions can be obtained

1.1 3 To seek authorisation to consult in the immediate vicinity of the proposal by means of a letter and plan drawing their attention to the published "Notice of Proposal" and explaining how they can obtain more details of the proposals and make representations should they wish.

2.0 RECOMMENDATIONS

2.1 That the Head of Regeneration & Development authorises all as described in paragraphs 1 .1 .2 and 1 .1 .3 above.

J. I ln 2012 a road accident took place in Garston Lane close to the junction with St AIbans Road which resulted in the death of a pedestrian. Following the Police investigation in to the accident HCC undertook its own investigation which resulted in additional 'at any trme' restrictions (double yellow Iines) being installed in Garston Lane earlier this year. During the consultation process associated with the installation of the additional parking controls HCC received a petition organised by two businesses on Garston Lane opposing the introduction of the double yellows because of the loss of parking opportunity for customers that would result. Following consideration of the representations by their Highways Panel, HCC resolved to continue with the yellow line proposals. It also decided however, to investigate the provision of additional short stay parking bays in Garston Lane close to the shops in Garston Park Parade to address the concerns raised in the petition.

3.2 has been requested to pursue the installation of these short-stay bays on behalf of the County Council. Following consultation with HCC Officers a detailed proposal has been developed. The proposal is shown on the plan at Appendix A and consists of a limited waiting parking bay sufficiently long to accommodate 5 vehicles, located on the north east side of Garston Lane between its junctions with St Albans Road and Garston Park Parade. Currently the identified length of kerb side space is not subject to any parking controls and is generally occupied by parked vehicles. Observation on site indicates that parking at this location does not give rise to any significant obstruction or road safety concerns. lf introduced parking in the bay would be restricted to a maximum of t hour with no return permitted within an hour. The controls would operate between 8.30 am and 6:30 pm, Monday to Saturday. This is consistent with the existing limited wait parking bay in Garston Park

4.4 The proposal has been the subject to formal consultation with the Police who have raised no objection. County Council has also been consulted and has raised no objection to the proposals. Ward and Divisional Members have also endorsed the proposals.

5.0 IMPLICATIONS 5.1 Financial

5.1 .1 The cost of promoting and processing the traffic orders and implementing the scheme is estimated at f3,000. The cost of the work is to be met by HCC.

5.1 .2 The Director of Finance advises that as HCC are meeting the cost, there are no financial implications for the Council.

5.2.1 The Watford Borough Council, pursuant to arrangements made under Section 19 of the Local Government Act 2000 and the Local Government (Arrangements for Discharge of Functions) (England) Regulations 2000 with the Hertfordshire County Council, and in exercise of the powers conferred on that County Council under Sections 1,2(1),2(2),4(2) and 45,46,46a,49,51 ,53,55,61,99,100-102 to the Road Traffic Regulation Act 1984 ("the Act of '1984") and of all other enabling powers, and after consulting with the Chief Officer of Police in accordance with Part lll of Schedule I to the Act of 1984, may make traffic regulation orders and implement proposals to manage parking on public highways and other roads.

5.2.2 fhe Legal & Democratic Services Section Head comments that if the recommendation is approved then the necessary statutory procedure will require consultation and may lead to a public inquiry should any objections not be resolved.

5.3 Equalities

5.3.1 A generic Equalities lmpact Assessment has been carried out for parking schemes which has been considered and approved by the Equalities Working Group. lt is available to view on the Council's website.
