PETITION FOR RULEMAKING. Corey J. McCaslin ("McCaslin") hereby requests that the ll Federal Communications Commission ("Commission ) institute a Rulemaking proceeding to Amend Section 73.202 (b) of the Commission's Rules and Regulations to Allot FM Channel 262A to Susanville, California, as that community's fourth local FM Broadcast service. In order to Allot FM Channel 262A to Susanville, California, McCaslin requests: (1) FM Channel 265A be substituted for FM Channel 262A at Quincy, California; and (2) the downgrade of the FM Allocation at Corning, California from FM Channel 264C1 to FM Channel 264B. In support of MCCaslin's requests, EXHIBIT 1 (attached) demonstrates that FM Channel 262A can be Allotted to Susanville, California at the Reference Co-ordinates for that community. EXHIBIT 2 (attached) demonstrates that FM Channel 265A can be substituted for FM Channel 262A at Quincy, California using No. of Copies roc'd o+Lt UstABCOE ........__ __ _--_.........•......_.__ _-----------------_._-- the Licensed transmitter site of KHWG (FM) (Facility ID#: 31618). With regard to the downgrade of the FM Allocation at Corning, California, (which is theoretically short-spaced to the Allocation of FM Channel 265A at Quincy, California), the FM Allocation to use FM Channel 246C1 in place of FM Channel 264B became effective on Sept. 13, 1993 (58 FR 42020). However, FM Construction Permit No.: BPH-940426 IA to use that C1 Allocation at the Allocated site ( 40-15-31, 122-05-20) EXPIRED on Feb. 25, 1996. To date, no other Applications have been filed with the Commission to use the C1 Allocation at Corning, California. In fact, FM Station KTHU (FM), Corning, California, (Facility ID#: 52509) remains Licensed as a Class B FM Station (BLH-880419 KA) at it's Authorized transmitter site ( 39-53-17, 122-37-38), which is not short spaced to the Allocation of FM Channel 265A at Quincy, California. McCaslin affirms his intention to apply for FM Channel 262A at Susanville, California. Furthermore, should McCaslin become the Permittee of FM Channel 262A at Susanville, California, McCaslin pledges to reimburse the Licensee of KHWG (FM), Quincy, California for reasonable costs associated with the FM Channel change at Quincy (from Channel 262A to Channel 265A), consistent with Commission policy under Circleville, Ohio, 8 FR 2d 159 (1967).
