RETRACING AUGUSTINE’S ETHICS Lying, Necessity, and the Image of God Matthew Puffer ABSTRACT Augustine’s exposition of the image of God in Book 15 of On The Trinity (De Trinitate) sheds light on multiple issues that arise in scholarly interpretations of Augustine’s account of lying. This essay argues against interpretations that pos- it a uniform account of lying in Augustine—with the same constitutive features, and insisting both that it is never necessary to tell a lie and that lying is abso- lutely prohibited. Such interpretations regularly employ intertextual reading strategies that elide distinctions and developments in Augustine’sethicsoflying. Instead, I show how looking at texts written prior and subsequent to the texts usually consulted suggests a trajectory in Augustine’s thought, beginning with an understanding of lies as morally culpable but potentially necessary, and cul- minating in a vision of lying as the fundamental evil and the origin of every sin. -

Sperotto: Counter-Insurgency, Human Rights, and the Law of Armed Conflict Counter-Insurgency, Human Rights, and the Law of Armed Conflict by Federico Sperotto* introduCtion ounter-insurgency is the dominant aspect in the United States-led Operation Enduring Freedom (OEF) in CAfghanistan, and, since the NATO-led International Security Assistance Force (ISAF) has assumed growing respon- sibility throughout insurgents’ sanctuaries, also a mission for Europeans. According to the U.S. military, insurgency represents an intermediate step in the spectrum of conflict, which ranges from stable peace to general war.1 The frame in which military opera- tions are conducted is known as irregular warfare, a violent struggle among state and non-state actors for legitimacy and influence over a population.2 This form of conflict is charac- terized by three principle activities: insurgency, counter-insur- gency, and unconventional warfare, referring to the avoidance of Association of the Courtesy of the Revolutionary Afghanistan. -

A Symposium: Morality Reconsidered David Hume and the Origin of Modern Rationalism Donald Livingston Emory University In “How Desperate Should We Be?” Claes Ryn argues that “morality” in modern societies is generally understood to be a form of moral rationalism, a matter of applying preconceived moral principles to particular situations in much the same way one talks of “pure” and “applied” geometry. Ryn finds a num- ber of pernicious consequences to follow from this rationalist model of morals. First, the purity of the principles, untainted by the particularities of tradition, creates a great distance between what the principles demand and what is possible in actual experience. The iridescent beauty and demands of the moral ideal distract the mind from what is before experience.1 The practical barriers to idealistically demanded change are oc- cluded from perception, and what realistically can and ought to be done is dismissed as insufficient. And “moral indignation is deemed sufficient”2 to carry the day in disputes over policy. Further, the destruction wrought by misplaced idealistic change is not acknowledged to be the result of bad policy but is ascribed to insufficient effort or to wicked persons or groups who have derailed it. In his most important writing in this field called "Politics", Aristotle classified authority in the form of two main parts: the correct authority and moose authority. In this sense, correct forms of government are 1.basileus, 2.aristocracy and 3.politeia. These forms of government are based on the common good. Bad or moose forms of government are those that are based on the property of an individual or small governmental structures and they are: 1.tiranny, 2.oligarchy and 3.democracy. Also, Aristotle's political thinking is not separate from the ethical principles so he states that the government should be reflected in the true virtue that is "law" or the "golden mean". Although many wars have been terribly bloody and destructive, history provides relatively few examples of wars of total annihilation. Rather, for reasons involving both self-interest and ethical conviction, political leaders and warriors have often observed limits in their resort to war and the conduct of battle. This course examines the historical, moral, and legal foundations of these limits, and their enduring relevance despite ongoing changes in world politics and the transformation of modern warfare. Although we consider alternative perspectives, the course focuses primarily on the just war tradition, major elements of which are reflected in international law governing the legitimate resort to force and proper conduct during wartime. Topics include aggression and self-defense, genocide, humanitarian intervention, nuclear deterrence, noncombatant immunity, terrorism, treatment of prisoners, torture, and prosecution of war crimes. Discussion of these topics is informed by contemporary just war thinking as well as classical political and moral philosophy. Snyder Michigan State University, 220 Trowbridge Rd, East Lansing, MI 48824, USA [email protected] Abstract The concept of leisure found in Aristotle’s corpus is both elusive and challenging. It eludes categorization into our current understandings of work and play while at the same time challenging those very conceptions. Here, I attempt to come to grips with Aristotelian leisure by (1) demonstrating its centrality in Aristotle’s thought, (2) explaining leisure as primarily a ‘way of being’ rather than merely the absence of occupation or one of several preconditions to the virtues, and (3) exploring what lei- sure might mean to liberal democracy. As a ‘way of being’, Aristotelian leisure is more than an absence of work, but is a positive comportment that itself requires virtues, material means, and an education. Keywords leisure – Aristotle – political science Leisure is a challenge to contemporary liberal democratic life. As Tocqueville assessed, the democratic citizen views labor as a ‘necessary, natural, and respectable condition of humanity’.1 Notable contemporary thinkers on the subject of leisure, especially Pieper and Huizinga,2 are in agreement that lei- sure does operate as this kind of challenge. DOUGlAS L. BENDELL AWARD THE STARVATION MYTH: THE U.S. BLOCKADE OF JAPAN IN WORLD WAR II CHRISTOPHER CLARY At 8:16 a.m., on August 6, 1945, the world changed. Fifty-seconds earlier, the Enola Gay had dropped an atomic bomb, "Little Boy", from 31,600 feet above Hiroshima, Japan. The world was ushered into the nuclear age. After seeing the "initial burst and 'ball of fire,'" co-pilot Robert Lewis questioned aloud, "My God, what have we done?" 1 Lewis, nearly six miles above the devastation, was responding to the pyrotechnic display. He could only imagine the very real damage the bomb had caused. While disagreements exist concerning the exact figures, it is undeniable that the bomb and its radioactive effects killed at least 70,000 people 2 Though he was one of the first to see its effects, Lewis was not the first to question the decision to use the atomic bomb nor would he be the last. The decision still sits at the center of one of the most debated historical (as well as historiographic) questions. The focus on this episode is justified. This singular event divides the Twentieth Century in numerous ways, but perhaps most relevantly it ends a hot and bloody war, and marks the beginning of a colder conflict. And since we examine the event in the year 2000, we must try to avoid the biases of the post-Cold War era. This paper tries to focus on two different realities: the first is what actually, really happened, the true state of affairs, then secondly the perceptions of that actuality. -

This is absolutely marvellous. I can switch off and let this instructor ramble on for 45 minutes. I know all about the Geneva Conventions anyway – the law is part of my culture and our military traditions. Since it is the strategic level of war that primarily affects war’s conduct, one might have expected that the law would focus upon it. Paradoxically, the current law generally ignores the strategic discourse and prefers to scrutinize the conduct of war through a tactical lens. This disregard of military strategy has a price that is demonstrated in the prevailing law of targeting. This Article challenges the current blind spot of IHL: its disregard of the direct consequences of war strategy and the war aims deriving from it. It asks those who want to comprehensively reduce war’s hazards to think strategically and to leverage military strategy as a constraining tool. The effect of the suggested approach is demonstrated through an analysis of targeting rules, where the restrictive attributes of military strategy, which could play a significant role in limiting targeting, have been overlooked. Contact: [email protected] 1 The Incoherence of Moral Relativism Abstract This paper is a response to Park Seungbae’s article, “Defence of Cultural Relativism”. Some of the typical criticisms of moral relativism are the following: moral relativism is erroneously committed to the principle of tolerance, which is a universal principle; there are a number of objective moral rules; a moral relativist must admit that Hitler was right, which is absurd; a moral relativist must deny, in the face of evidence, that moral progress is possible; and, since every individual belongs to multiple cultures at once, the concept of moral relativism is vague. Park argues that such contentions do not affect moral relativism and that the moral relativist may respond that the value of tolerance, Hitler’s actions, and the concept of culture are themselves relative. In what follows, I show that Park’s adroit strategy is unsuccessful. Consequently, moral relativism is incoherent.
