Retail availability of compliant handset models: Compliant handset models are available in all of Viaero’s retail outlets, where all of its compliant handset models are made available for consumers to test.

Explanation of the methodology for determining levels of functionality (e.g. operating capabilities, features, prices) of compliant phones: Phones are classified into the following five (5) categories according to retail price (not discounted as part of a contract for service):

• The first category is SmartPhones ($800+ Cost Outright). These phones have advanced features such as a camera, , some desktop functions, e-mail and Internet access capability. • The next category is Ultra Phones ($450-$799 Cost Outright). These phones have a camera, Bluetooth, and Internet access capability. • The next category is Best Phones ($300-$449 Cost Outright). These phones may have a camera, Bluetooth, and Internet access capability, but are usually older models. • The next category is Better Phones ($151-299 Cost Outright). These phones may have a camera, Bluetooth but are more basic models. • The final category is Good Phones (Less than $150 Cost Outright). These phones may or may not have a camera, Bluetooth, and Internet access capability, and generally are heavier and lack such features MP3 players and expandable memory.

Status of product labeling: The compliant phones offered by Viaero clearly display the M3 and T3 HAC rating on the packaging material of the handset. HAC handsets with different ratings over different air interfaces or different frequency bands display the lowest RF interference reduction (M3) and inductive coupling capability (T3) rating assigned to that handset for any air interface or frequency band. An explanation of the ANSI C63.19 rating system is included in the device’s user’s manual or as an insert in the packaging material for the handset. Viaero does not currently offer any handsets that incorporate Wi-Fi air interface, but upon offering such handsets, it will disclose to consumers of any handset model that incorporates a Wi-Fi air interface, by clear and effective means (e.g., supplying of information on the Viaero website) that the handset has not been rated for hearing aid compatibility with respect to Wi-Fi operation.

Outreach efforts: Viaero’s compliant handset models are publicly identified for consumers and audiologists. Compliant models are listed on Viaero’s web site. Viaero trains its retail salespeople regarding which digital wireless phones are compliant. Compliant HAC phones are identified at the point of sale in retail locations on the merchandising call out cards. Consumers are given a 30-day trial period within which to try out digital wireless phones to determine whether they will work properly with their hearing aids. Flexible return policies are made known to consumers seeking to obtain compliant phones.

The site lists all HAC models currently offered by Viaero, the ratings of those models, and an explanation of the rating system. The website describes the levels of functionality, as defined by Viaero, and specifies the level of each HAC model.
