WHEREAS it is expedient to amend the Motor Car Act 1951 to increase the permit fees payable in respect of different classes of vehicles; to increase the licence duty payable in respect of different classes of vehicles; and to remove the licence duty exemption granted to senior car owners so that senior car owners pay 50% of the licence duty as provided in Part B of Schedule 2; Be it enacted by The Queen’s Most Excellent Majesty, by and with the advice and consent of the Senate and the House of Assembly of Bermuda, and by the authority of the same, as follows:

Citation 1 This Act, which amends the Motor Car Act 1951 (“the principal Act”), may be cited as the Motor Car Amendment Act 2013.

Amends section 62B 2 Section 62B of the principal Act (exemptions in favour of senior car owners) is amended—

(a) in subsection (1), by deleting “paying duty” and substituting “paying the full rate of duty”; and (b) by inserting at the end—

“(3) A senior car owner who is granted an exemption from paying the full rate of duty shall be liable to pay 50% of the amount set out in Part B of Schedule 2 for a relevant class of car.”

Repeals and replaces Schedule 1A 3 Schedule 1A to the principal Act is repealed and replaced with the following—

Repeals and replaces Schedule 1B 4 Schedule 1B to the principal Act is repealed and replaced with the following—

“SCHEDULE 1B (Sections 32A(4)(c), 36(4)(bb) and 36A(5)(bb)) PUBLIC SERVICE VEHICLES PERMIT FEES

Limousine Service $51,500 (per vehicle) Minibus Service $5,150 (per vehicle) Airport Limousine Service $2,060 (per vehicle) ”.

Inserts Schedule 1C 5 The principal Act is amended by inserting the following after Schedule 1B—

“SCHEDULE 1C (Sections 43(5a) and 47(6)) TRAILER PERMIT FEES

Light Trailer $206 Intermediate Trailer $412 Heavy Trailer $618 Special Permit Trailer $824 Container Chassis $1,236 Low Boy Trailer $1,442 ”.

Repeals and replaces Schedule 2 6 Schedule 2 to the principal Act is repealed and replaced with the following—

“SCHEDULE 2 (Section 59) LICENCE DUTIES

A MOTOR CYCLES Where the engine capacity— does not exceed 100 c.c. $86.47 exceeds 100 c.c. but does not exceed 125 c.c. $93.99 exceeds 125 c.c. but does not exceed 150 c.c. $150.38
