REQUESTED ACTION/RECOMMENDATION: Staff recommends that the City Council review the list of pending legislation; authorize the Mayor to send letters of opposition for pending legislation: Assembly Bill (AB) 5 (Ammiano) Homelessness; AB 325 (Alejo) Land Use Planning: cause of actions: time limitations; AB 537 (Bonta) Meyers-Milias-Brown Act: impasse procedures: Senate Bill (SB) 7 (Steinberg) Public Works: charter cities; and SB 311 (Padilla) Local Elections: charters and charter proposals; SB 673 (DeSaulnier) Local Economic Development; and letters of support for pending legislation: AB 1229 (Atkins) Land use: zoning regulations; SB 33 (Wolk) Infrastructure Financing Districts; SB 391 (DeSaulnier) California Homes and Jobs Act of 2013; and ACA-4 (Olsen) and SCA-10 (Wolk) Legislative Transparency. DISCUSSION/ANALYSIS: Del Mar is a member of the League of California Cities (League). The League regularly reviews legislation that affects cities statewide. The League has recommended that the cities oppose and/or support various pending legislation (See Attachment A to see the positions the League has taken on pending legislation and requests for letters of support and opposition.) Staff has reviewed the League’s lists and recommends that Del Mar send letters to the legislature regarding the pending legislation: AB 5 (Ammiano) Homelessness. Oppose. Brief descriptions of the pending bills are in the League’s attached emails. Sample letters and additional information are listed in the attachments for the eleven bills that are recommended for City Council action. (See Attachments B through K.). For further information, the California Legislative website (http://leginfo.legislature.ca.gov/) includes the text of the bill, history/status of the bill, bill analysis, and how the proposed bill would amend existing law. In summary, the Council should review the brief descriptions of the legislation and determine if they are in agreement regarding the recommendation. If the City Council supports the recommendations then staff will prepare letters of support or opposition for the Mayor’s signature. In addition, the City will monitor other pending legislation as noted in the League’s list of priority legislation to watch. It should be noted that there may be worthy legislation that the City of Del Mar does not opt to take a position on. Council may direct staff to prepare letters (of support or opposition) on other pending legislation, or monitor specific legislation as it moves through the legislative process. Our lobbyists say we need to stop it in committee or it goes to the Governor for likely signature: Priority on this bill is a letter to your Assembly Member. I have reached out to the cities who have members on Local Government or H&CD and encourage all cities to weigh in on this bill as soon as possible. AB 5(Ammiano) OPPOSE. Bill establishes a Homeless Bill of Rights, but in doing so it makes city public safety regulations regarding loitering, sleeping in public spaces, soliciting donations and trespassing and other issues non enforceable. Local governments must establish and maintain heath and, hygiene,centers providing bathroom and shower,. ~...~~ facilities w_ ~.. _,~_.~~ 24 7. The bill impedes a aty from enforcing.anyregulations that=mould be viewed_ _.__ asg_—.. "anti- homeless". Letters are requested as soon as possible on this bill. SB 7(Steinberg) OPPOSE. Bill restricts state funding to any charter city that does not comply with state prevailing wage requirements on all projects including projects that use only city funding. Violates the local control rights of charter cities and constitutional limits of state authority over charter cities. SB 311 (Padilla) OPPOSE. Bill mandates charter cities may hold elections on charter amendments or changes to the charter only on the two year state wide election cycle. For similar reasons as the League's opposition to SB 7, this bill violates charter city autonomy, local control and constitutional limits of state authority over charter cities. AB 537(Bonta) OPPOSE. Meyers-Milias-Brown Act amendment. Bill authorizes either a public agency or employee organization can request mediation if an impasse has been reached. Current law requires both parties to agree to mediate, this bill changes that to say that just one of the parties can request it and both do not have to do so or agree to it. 3 May 6, 2013 Item 12 ~, SB 673(DeSauliner) OPPOSE. Bill establishes a state oversight program within the Governor's Office of (OPR) and requires every city and county to have a cost benefit analysis prepared before approving or disapproving a project estimated to receive over $1M in subsidies. Takes local land use decision making out of city and county hands and gives broad oversight to the state. SB 33(Wolk) SUPPORT. Bill implements changes to the statutes on Infrastructure Financing Districts to make them more useful to cities and allow cities to create funding opportunities for infrastructure projects. League has worked for two years on this proposal with Senator Wolk and requests cities show support for bill with letters to their Legislators. AB 1229 (Atkins) SUPPORT. Bill restores cities zoning authority for inclusionary housing in regards to rental housing. Assembly Member Atkins has specifically requested letters of support from cities on this bill and letters from the San Diego County cities are needed. AB 1080(Alejo) SUPPORT. Bill creates the Community Revitalization Investment Authority to provide a redevelopment options for local government most economically challenged areas. AB 981(Bloom)SUPPORT. Bill authorizes bond proceeds issued before June 28, 2011 and backed by Low and Moderate Income Housing Funds to be used for affordable housing purposes. Successor Agencies with Findings of Completion may use proceeds from bonds issued prior to June 28, 2011 for their intended purposes. .~ SB 391(DeSaulnier) SUPPORT. This bill would generate approximately $500m per year for affordable housing needs through a $75 recordation fey on real estate transactions excluding home sales. Prop 39 and Can-A id-Trade related bills to SUPPORT AB 574(Lowenthal) Greenhouse Gas Reduction Fund: Sustainable Communities Strategies.(As amended 4/4/13) Would create a Sustainable Communities Infrastructure Program and allocate funding from the transportation-related Cap-and-Trade revenues to integrate transportation and public infrastructure investments to reduce greenhouse gas(GHG) emissions. A coalition (transfundin~g.org) is working on this issue which is expected to be part of a larger budget
