MINUTE OF MEETING OF THE SCOTTISH BORDERS LICENSING BOARD held in Committee Rooms 2/3, Council Headquarters, Newtown St Boswells on Friday, 26 September 2014 at 10.00 a.m. ______

LICENCES ISSUED UNDER DELEGATED POWERS 2. For Members’ information there had been circulated copies of a list of licences issued under delegated powers for the period 13 August – 16 September 2014.

DECISION NOTED.

3. LICENSING (SCOTLAND) ACT 2005: (a) Section 29: Applications for Variation of Premises Licence. The Board considered the following applications for Variation of Premises Licence:-

(i) Co-operative Group Food Limited Co-op Food 70 High Street Selkirk

Amendments to operating plan and layout plan:

Addition of recorded music as an activity within and outwith licensed hours; Capacity increase to 28.6m² (inaccessible area 2.1m²and accessible area 26.5m²) - currently 17.25m².

No representations had been received.

Mr Alistair Macdonald of Macdonald Licensing appeared on behalf of the Co-operative Group Food Limited, he was accompanied by Mr Colin Telfer, Manager, Co-op Food, 70 High Street, Selkirk. Mr Macdonald explained that the Co-operative Food Group Limited had undertaken a national policy to refurbish and upgrade their premises. In responding to a question raised by Councillor Campbell in respect of the capacity increase, Mr Macdonald advised that the actual increase in the area was not that significant and that it was well below the Licensing Board’s Policy Statement Guidelines. The Legal and Licensing Services Manager advised that the Licensing Standards Officer had appraised the layout plans for the premises and made reference to a certain degree of confusion in regard to the required measurements for layout plans at the time of transition in 2009 which varied from Board to Board.

DECISION GRANTED.

(ii) Co-operative Group Food Limited Co-op Food Peebles Road Innerleithen

Amendments to operating plan and layout plan:

Capacity increase to 39.16m² (inaccessible area 2.1m²and accessible area 37.06m²) – currently 24.75m².

No representations had been received.

Mr Alistair Macdonald of Macdonald Licensing appeared on behalf of the Co-operative Group Food Limited accompanied by Mr Craig Boggs, Manager, Co-op Food, Peebles Road, Innerleithen. Mr Macdonald restated the position that Co-operative Food Group Limited had undertaken a national policy to refurbish and upgrade their premises as explained fully in the previous application.

DECISION GRANTED.
