Stow-on-the-Wold (on the Fosseway - A429) is 18 miles from Cheltenham, 10 miles from Chipping Norton and 18 miles from Cirencester. BIDDING NUMBERS – Please note that these will be used. Please register on arrival at the sale room and hand in the COVID form . THE SALE - Unless otherwise stated, all lots comprise baled Hay & Straw from the 2020 season. VIEWING - may be at any time during daylight hours by prospective purchasers in possession of a Sale Catalogue. Appointments are not necessary unless specifically indicated in the Catalogue, but COVID precautions and social distancing rulesare required. HELP TO LOAD – unless specifically indicated in the catalogue or at time of sale HELP TO LOAD WILL BE AVAILABLE providing at least 24 hours notice is given in order that arrangements can be made. Help to load is limited to the 28 day removal period or such extended period as agreed to by the Vendor under these Conditions of Sale. Private arrangements for an extension of the removal period beyond that stated in the catalogue or announced at the time of sale are strictly a matter between Vendor and Purchaser and we recommend that confirmation is obtained in writing or by email. There is no obligation on the Vendor to assist the sheeting up of lorries, with the responsibility being entirely with the Purchaser, who should have their own arrangements in place before bidding. CONDITIONS OF SALE 1. The highest bidder shall be the purchaser (subject to any reserve price) and if any dispute arises the lot(s) in dispute to be put up again and resold, or the purchaser may be decided by the Auctioneers, who reserve the right to bid for, withdraw, divide or amalgamate any lots. The sale price shall include loading by the Vendor of all bales unless specified. 2. All descriptive statements contained in advertisements or the catalogue or made by the Auctioneers, before or at the time of sale, are not to be taken as warranties, but as expressions of Vendor's or Auctioneers' opinion, and no warranty is to be implied. In all circumstances it shall be assumed that the purchaser has inspected the lot(s) he buys and has satisfied himself as to the quantity, quality, description, bale size or baler used, moisture content, weight, suitability for purpose or otherwise prior the sale. All buyers must exercise and rely on their own judgement as to whether the lot accords with its description before the sale as under no circumstances will we accept any dispute of any lots following the sale. 3. All lots must be removed within 28 days, unless otherwise stated at the time of sale. Any disputes which arise after the expiration of the collection date will be between the Vendor and Purchaser, the Auctioneer’s cannot be held liable or responsible for the refund of any monies. 4. All lots are at the purchasers' risk at the fall of the hammer, it is essential, therefore, that INSURANCE COVER should be taken out immediately. 5. Any damage caused by the removal of the lots shall be made good by the purchaser to the satisfaction of the Auctioneers and Vendor(s). 6. TERMS - PAYMENTS IN FULL ON DAY OF SALE in default of which the Auctioneers reserve the right to withhold delivery. Where payment is by cheque, removal will NOT be authorised until the cheque has been cleared. Any late payment for whatever reason will be charged interest at 4% over Lloyds Bank Base Rate. LOTS SOLD PER TONNE OVER THE WEIGHBRIDGE - In the event of any lot(s) being sold per tonne over the weighbridge, the purchaser will pay to the Auctioneers the full price of the lot, based upon the estimated tonnage in the catalogue at the time of sale. Any adjustment will be made upon receipt of the weight ticket, which must be delivered to the Auctioneers' office at Bourton-on-the-Water within five days of the removal date. The purchaser to pay any weighing charge or toll. 8. DESCRIPTIONS- Whilst only an indication, we have tested all lots for moisture where possible. The catalogue description indicates the moisture of the bales. Where found to be below 12% then we describe this as very dry, between 12-15% then this is dry. Where we have not described the lot then the bale may have a higher moisture or it was not possible to probe. Other Definitions PFB- Portal Framed building, LHS-left hand side, RHS-right hand side FCFS- First come first served, meaning where the lot is split in the sale or the lot is part of a larger stack then the produce will be loaded from the front on a first come first served basis. MIXTURE HAY- generally older leys Due to COVID requirements there will be NO Refreshments available throughout the sale. Money Laundering requirement: Due to HMRC rulings and to comply with the “Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017” the rules require that at the issuing of a paddle number there is an intention to enter into a contractual arrangement with the auctioneer. Tayler and Fletcher is required to comply and therefore will require the following ID to verify you and thus allow you to bid. If you have not already provided us with the relevant documentation, please bring the following information/items to the sale (or email before): For Sole Traders: One of either a valid passport; a valid photo card driving licence (full or provisional); Or a a firearms certificate For Businesses: Headed notepaper showing: a. The full name of the company b. Company or other registration number c. VAT registration number (if applicable) d. Registered address and principal place of business e. Names of the board of directors or equivalent body f. Names of the senior person responsible for its operations g. For partnerships- all the partners with greater than 25% share are required COVID-19 - IMPORTANT INFORMATION By attending the Sale, all attendees acknowledge, respect and will act responsibly to adhere to the COVID 19 measures to minimise transmission of the Virus. You agree that whilst Tayler & Fletcher LLP have taken every precaution to follow Government Guidance, it is impossible to eliminate all risk and there remains the potential for unintended transmission of COVID-19. All those attending the sale and viewing must play their part in minimising the risk to themselves and others by complying with the Government Guidelines as well as all on-site instructions and signage. If you are experiencing any cough, fever or other respiratory symptoms or believe that you may have been exposed to COVID-19 or any other respiratory illness, please stay at home and do not attend. Should Government guidance change these updates will be made available prior to the sale. All persons attending the sale MUST: 1. Agree the Sale is a business event and not a social gathering. Only those conducting business will be admitted to the sale. 2. Pre-Registering with the Auctioneers is a prerequiste as places are limited to 40.- Unfortunately the rules require that only ONE person per business is allowed to attend the sale. 3. Complete and bring the registration form to confirm that you do not have COVID 2. Agree that their details may be used in the NHS Test & Trace Programme. 3. Observe social distancing keeping 2m apart from other people. 4. Ensure that face coverings are worn at all times whilst in attendance. 5. To use hand sanitizer at the sale office. 6. Not to have travelled from, or through, a lock lockdown area. 7. To comply with any instructions from The Auctioneer or any Tayler & Fletcher member of staff in order to maintain Covid-compliance. 8. To vacate the building promptly after the sale.
