It is my understanding you are seeking access to “the most up-to- date "Community Path Priority List", as at the date of your response to this request”. I am an Information Officer appointed by the Director-General under section 18 of the Act to deal with access applications made under Part 5 of the Act. A decision on access to government information was due to you by 25 February 2021 and was not made within the allowed timeframe. In accordance with section 39(3) of the FOI Act, TCCS have decided to continue process your application outside of time. D ecisio no naccess A search of records held by TCCS has been completed and an electronic database was identified to contain information relevant to your application. Relevant information held in this database was extracted on 16 February 2021 into a singular record (18 pages). As the list of community path requests is linked directly to requests made through Fix My Street, the list is altered daily. Requests are prioritised based on the following 5 factors: 1. Safety; 2. Strategic (how the request completes routes identified as part of the Active Travel Infrastructure strategic path network); 3. Community (proximity to community attractions and trip generators, shops, schools, residential areas); 4. Public transport- proximity to relevant public Transport facilities such as bus stops; and 5. Demand. Available funding is also considered in the management of these requests. While a request may be listed in the database, the fulfilment of a request depends on the above listed factors and in some instances the request may not be fulfilled. In accordance with section 17 of the Act, I have considered the public interest in relation to information within this document and have provided you with partial T C C S . I have refused access to some information within this record as I have found the information to be contrary to the public interest. My decision is detailed further in the following statement of reasons. The record is enclosed at Attachment A with deletions to information which is contrary to the public interest. Statement of Reasons In making my decision on disclosing government information, I must identify all relevant factors in schedule 1 and 2 of the FOI Act. I must also determine, on balance, where the public interest lies. In reaching my access decision, I have taken the following into account: Factors favouring disclosure in the public interest (Schedule 2.1) • Schedule 2.1(a) (ii) - contribute to positive and informed debate on important issues or matters of public interest. • Schedule 2.1(a)(iii) - inform the community of the government’s operations, including the policies, guidelines and codes of conduct followed by the government in its dealings with members of the community; • Schedule 2.1(a)(iv) - ensure effective oversight of expenditure of public funds; and • Schedule 2.1(a)(viii) - reveal the reason for a government decision and any background or contextual information that informed the decision. Factors favouring non-disclosure (Schedule 2.2) • Schedule 2.2 (a)(ii), prejudice the protection of an individual’s right to privacy. In reviewing the information within the record, it was identified that the disclosure of most of the information would contribute to a transparency of process, inform the community on government operations, and reveal the reason for a government decision. Personal information about third parties have also been identified within the documents subject to this request. Personal information means information or an opinion whether true or not about an individual whose identity is apparent or can be ascertained from the information or opinion. The Information Privacy Act 2014 prescribes how government collects, uses, shares, and stores this information. It is my understanding that this information was provided specifically for the purpose of making an application to TCCS and the information may not be currently available to the public. I have considered the likelihood that disclosing this type of information would prejudice an individual’s right to privacy or any other right under the Human Rights Act 2004. In this instance, I find that the disclosure of the personal information within this document is contrary to the public interest.
