1 TheFloodPrevention&LandDrainage(Scotland)Act1997 FifthBiennialReport-December2005 FloodinginAberdeenshire SUMMARYREPORT AberdeenshireCouncilpublishesareportonfloodingeverytwoyearsto informAberdeenshireResidents.ThelastreportwaspublishedinNovember 2003.This,theFifthBiennialReport,coverstheperiodfromNovember2003 tothepresenttime. AllfloodeventsreportedtotheCouncilhavebeeninvestigated.Over70%of thefloodeventsrecordedoverthelasttwoyearswereduetolocallandor roaddrainagesystemsbeingoverwhelmedbytheintensityofrainfall.Inmost cases,improvementactionwasagreedinconjunctionwiththevariouspeople involved.Frequently,itwasforindividuallandownerstocarryoutthese improvements.Roaddrainageimprovementswhererequiredhavebeen includedinannualroadmaintenanceprogrammes,prioritisedagainstother demands.Basicmaintenanceworkhasbeencarriedoutonwatercourses wheretodosowouldreducethelikelihoodofpropertiesbeingflooded. Improvementstowatercoursestoreducethelikelihoodoffloodinghavebeen carriedoutatsomeofthelocationswheresignificantfloodingoccurredin Autumn2003.Otherimprovementsareplanned,someonalargeenough scaletorequireauthorisationbytheScottishExecutive. ThereportdetailsbrieflyallthefloodingincidentsreportedtoAberdeenshire Council.Thelocationsoffloodingtabulatedaredeliberatelyvaguetoavoid unnecessaryconcernandpossibleblight.Anymemberofthepublicwhohas alegitimateinterestmaycomeintotheCouncilsOfficeatCarltonHouse, andlookatthefloodrecordsforanyparticularlocation. Alternatively,byarrangement,somerecordscanbemadeavailablefor inspectionatanylocalAberdeenshireOffice.Contactdetailsaregivenatthe endofthereport. A“FloodActionNetwork”basedonthewellestablishedNeighbourhood WatchhasbeenestablishedwithafirstgroupinPortElphinstone.Other communitieswhoareatriskoffloodingfromwatercoursesareencouragedto jointhenetwork. Manyoftheopportunitiestocarryoutfloodpreventionworkonriversystems alsoprovideopportunitiesforimprovingnaturalhabitat,waterqualityandbio- diversity,andviceversa.AberdeenshireCouncilisworkinginpartnershipwith agenciessuchasSEPA,SNH,ScottishWaterandtheSalmonFishery Boardsandwithlandownerstoachievesustainablefloodprevention maximisingfloodplainstorage.FloodPreventionSchemesonthisbasisare duetocommencein2006atandandareplannedfor and.

ReasonforReport 1.1ThisreportspecifiesthemeasureswhichAberdeenshireCouncilconsider theyrequiretotaketopreventormitigatefloodingonnon-agriculturalland withinAberdeenshire.ThisreportispublishedasrequiredbytheFlood Prevention&LandDrainage(Scotland)Act1997. 1.2Thisreportdetails: (1)allthefloodeventswhichhaveoccurredsincethepublicationofthe FourthBiennialReport: (2)allthemeasureswhichAberdeenshireCouncilhavetakentoprevent ormitigatefloodingsincepublicationoftheFourthBiennialReport; (3)allthefurthermeasureswhichAberdeenshireCouncilproposetotake topreventormitigateflooding. 1.3Thisreportisbasedonareviewofalltheinformationwhichisavailableto AberdeenshireCouncilatthepresenttimeandproposesactions considerednecessaryarisingfromthatreview.Asitisintendedprimarily toinformAberdeenshireResidents,theuseoftechnicaltermshasbeen kepttoaminimum.Nevertheless,technicaltermsareunavoidableina reportwhichisessentiallytechnical.Synonymshavegenerallybeen definedwithinthetextwherefirstencountered.PleaserefertoAppendixA atthebackofthereportforaglossaryoftermsusedinthetext.

FloodEventsinAberdeenshirebetween November2003andNovember2005 2.1Thegeneralweatherpatternoverthetwo-yearperiodcoveredbythis biennialreporthasbeen“drytonormal”.Theexceptionallywetperiodin Autumn2002wasfollowedbygenerallydryweatherin2003/04andmore normalweatherin2004/05.Thesaturatedgroundconditionstypicalof mostof2002werefollowedbydrygroundconditionsthroughmostof 2003and2004andmorenormalgroundconditionsin2005. Consequently,heavyraindidnotcausewatercoursestoovertopas frequentlyduringthereportedperiod2003to2005asduringtheperiod coveredbythepreviousbiennialreport. 2.2LocalfloodeventsoccurredinAberdeenshireduringtheperiodNovember 2003toNovember2005astabulatedbyrivercatchmentbelow.See AppendixBfordetailsofcommunitylocationsandrivercatchments. 2.3NomajorfloodeventsoccurredinAberdeenshireduringthereported period.Ofallthefloodproblemsreported,72%relatedtolandand/orroad drainageproblems;26%relatedtowatercourses. 2.4IncidentsoffloodingreportedtoAberdeenshireCouncilwereinvestigated andassessed.Thelocationsoffloodingtabulatedaredeliberatelyvague toavoidunnecessaryconcernandpossibleblight.Anymemberofthe publicwhohasalegitimateinterestmaycomeintotheCouncilsOfficeat CarltonHouse,Stonehavenandlookatthefloodrecordsforanyparticular location.Alternatively,byarrangement,somerecordscanbemade availableforinspectionatanylocalAberdeenshireOffice. 2.5AberdeenshireCouncilhasadoptedaninternalPerformanceIndicator(PI) tomeasurethepercentageoffloodreportswhichareinvestigatedwithin 10workingdaysofhavingbeenreported.Sinceinceptioninearly2005, thePIforinvestigationoffloodincidentshasconsistentlybeen100%.

ActionTakenbyAberdeenshireCouncil undertheFloodPrevention&LandDrainage(Scotland)Act1997 sinceNovember2003 3.1AssessmentofWatercourses Thesystematicinspectionandassessmentofwatercourseshascontinued. Mainriverchannelsandprincipaltributarieshaveallbeeninspectedandan interimfloodriskassessmentmade.Ageo-morphologicalassessmentofmost ofthemainrivershasbeencarriedout.Insummary,theoverallprogressto datewiththefirstinspectionandassessmentisapproximately85%complete. Locationsandfeatureswhichwereassessedasbeingtosomedegreelikely tofloodhavebeensubjecttoregularfollow-upinspectionsince. 3.2DiscussionwithRegulatoryBodies 3.2.1 TheNorthEastFloodLiaison&AppraisalGroup(NESFLAG)isnow wellestablishedastheforumfordiscussionandresolutionofissues relatingtotheimpactofdevelopmentonfloodingandviceversa.An integratedGISbasedsystemtosharefloodrelatedinformationisnow established.Adedicatedweb-siteiscurrentlyunderdevelopment,tobe hostedbyAberdeenshireCouncil. 3.2.2 InadditiontodiscussionwithintheFloodAppraisalGroup,theclose workingrelationshipdevelopedbetweenDevelopmentControlOfficers andtheFloodPreventionTeamwithintheCouncilandOfficersof SEPAhascontinued,tomutualadvantage. 3.2.3 Ad-hocliaisonmeetingsareheldwiththefishingcontrolbodiesin Aberdeenshire. 3.2.4 DiscussionwithOfficersofneighbouringcouncilswillcontinuethrough occasionalmeetingstoexchangeinformationandsharebestpractice. 3.2.5 TheRiverDeecatchmenthasbeendesignatedasanSAC(Special AreaofConservation)and,inordertominimisetheworkrequiredin carryingoutappropriateimpactassessmentsforallengineeringworks whichmayaffectwatercourseswithinthecatchment,Aberdeenshire CouncilcommissionedagenericEcologicalImpactAssessmentand CodeofGoodPracticeinconsultationwithSNH,SEPAandthe SalmonFisheryBoards.Followingaperiodoftrial,thisdocumentis beingfurtherdevelopedtobemoreuserfriendly.AngusCouncilwho facesimilarconstraintsandconditionstoAberdeenshire,arenow sharingthedevelopmentofthisdocumentasajointinitiative.Itis hopedthattheapproachwillgreatlysimplifytheworkrequiredbyboth councilstomeettherequirementsoftheWaterEnvironment&Water ServicesAct(WEWS)whenimplementedasofAprilnext.

13 TheFloodPrevention&LandDrainage(Scotland)Act1997 FifthBiennialReport-December2005 3.3FloodWarning&RiverGauging 3.3.1 Goodprogresshasbeenmadetowardestablishingaformalflood warningschemeinAberdeenshire,basedontheexistingriverlevel gaugingstationswhichSEPAmaintain.Aproposaltoimplementa schemehasbeensubmittedtotheSEPABoard.Thewarningscheme willsupplementtheSEPA“Floodline”WarningSystemandwillprovide moreaccuratewarningforNorthEastScotlandbasedonactualriver levelscontinuouslygaugedontheRiverDeeandRiverDon. 3.3.2 TheexistingSEPAgaugesarelocatedonthemainriverchannelsand someprincipaltributaries.Theyweresupplementedin2002/03byfour telemetricriverlevelgauges,fourtelemetricrainfallgaugesand20 stage-boardsonun-gaugedtributariestoprovideearlierwarningof floodingtocommunitieswithasignificantfloodingriskandwerefunded byAberdeenshireCouncil.Thesegaugeshavebeenmaintainedand datacollectedregularly. 3.4TheAberdeenshireFloodActionNetwork TosupplementtheSEPA“Floodline”,AberdeenshireCouncilhasdevelopeda proposaltoestablishlocalcommunitygroupswillingtoacttoprotecttheir communityduringfloodevents.Thissocalled“FloodActionNetwork”, modelledonthewellestablishedandfamiliarNeighbourhoodWatch schemes,hasbeenstartedoffwithagroupestablishedinPortElphinstone, Inverurie.Althoughstillinitsinfancy,itisanticipatedthatallcommunitieswho havebeenaffectedbyfloodinginthepastwilljoininthenetwork.Bydoingso, muchmoreeffectiveprotectionagainstfloodingwillberealised. 3.5TheDeeCatchmentManagementPlan Manyoftheopportunitiestodevelopfloodalleviationmeasuresonriver systemsalsoprovideopportunitiesforimprovingnaturalhabitat,waterquality andbio-diversity,andviceversa.AberdeenshireCouncilreadilyacceptthe needtoworkinpartnershipwithagenciessuchasSEPA,SNH,Scottish WaterandtheSalmonFisheryBoardsandwithlandownersinorderto progressfloodalleviationschemes.AberdeenshireCouncilaretherefore assistingintheproductionofaCatchmentManagementPlanfortheRiver Dee.Itisanticipatedthattheholisticapproachtakentocatchment managementwillfacilitatefutureschemesto,forexample,createareasof floodplainstorageandremoveheavilycanalisedsections,bothofwhichwill reducethepeakflooddischargedownstream,therebyreducingfloodrisk.

14 TheFloodPrevention&LandDrainage(Scotland)Act1997 FifthBiennialReport-December2005 3.6WorksofMaintenancebyAberdeenshireCouncil 3.6.1 WorksofMaintenancehavebeencarriedoutinmanylocationswhere todosowouldsignificantlyreducethelikelihoodofflooding.The demandforsuchworksinevitablyexceedstheavailablefunding.A simplesystemofassessingschemesbyapointscoremethodwas devisedsometimeagotoestablishrelativepriorities.Thissystem takesaccountoffloodfrequencyandsocialfactors.Ithasbeen reviewedrecentlyandisconsideredreasonableandworkable. 3.6.2 Wheneverpossible,“softengineering”methodshavebeenutilisedin WorksofMaintenance.Hydraulicandclimaticconditionsoftencontrol themethodswhichmaybeadopted.However,AberdeenshireCouncil proceedsgenerallyonthebasisofapresumptionforsoftengineering methodsunlessconditionsdictateotherwise. 3.6.3 WorksofMaintenancehavebeencarriedoutatthelocationslisted below: KeithallRoad,Inverurie BleachfieldRoad,Huntly KingsfieldRoad,Kintore Damfolds, LochSoy, ReidhavenStreet,Whitehills MondynesBridge 3.7FloodStudies Itisoftennecessarytocarryoutafloodstudyinordertoobtaina comprehensiveunderstandingwherethemechanismoffloodingiscomplex. Severalconsultantshavebeencommissionedfromtimetotimeforspecific studies.Thehydraulicmodelsgeneratedhavebeenusedtoquantifytheflood riskandtotestpossiblesolutionsinordertoidentifytheoptimumsolution. Floodstudieshavebeencarriedoutatthefollowinglocations: RiverDeveron,Huntly TownDrainageSystem,Huntly Strathburn,Inverurie Insch MillInn/Inchferry, TownDrainageSystem,Alford StationSquare,Aboyne Whereappropriate,thestudieswillgeneratecostbenefitanalyseswhichwill beusedtojustifyproposalsforFloodPreventionSchemes(seepara4.4 below).

15 TheFloodPrevention&LandDrainage(Scotland)Act1997 FifthBiennialReport-December2005 3.8 MillofGellan,Tarland Anoff-linefloodstoragedemonstrationsitehasbeenconstructedonthe TarlandBurnatMillofGellanasaprecursortoaFloodPreventionScheme forAboyneandTarland.Anareaofcontrolledfloodstoragehasbeencreated onagriculturallydormantlandadjacenttotheburn.Ashallowpondand wetlandhasalsobeenconstructedtoencouragebio-diversity.(Thispartof theworkswasaconditionalrequirementofthelandownersandreadily acceptedbytheCouncilbutisnotnecessaryforfloodpreventionpurposes.) FurtherActionProposedbyAberdeenshireCouncilunderthe FloodPrevention&LandDrainage(Scotland)Act1997andthe FloodPreventionAct1961 4.1FurtherWorksofMaintenance Itisrecognisedthatregularmaintenancecancontributesignificantlytothe preventionormitigationofflooding.AberdeenshireCouncilthereforepropose tocarryoutfurtherWorksofMaintenanceundertheFloodPrevention&Land Drainage(Scotland)Act1997toreducethelikelihoodoffloodingwherea significantriskhasbeenassessed.Suchworkswillrangeinsizefromclearing debriswhichblocksthewatercoursetominorengineeringworkstoprovide floodprotectionortoimprovehydraulicefficiency. 4.2FloodStudies AberdeenshireCouncilproposetocommissionfloodstudieswhenever necessarytobetterunderstandthemechanismofflooding. 4.3InspectionandAssessmentofWatercourses Inspectionandassessmentofwatercourseswillcontinueasrequiredbythe FloodPrevention&LandDrainage(Scotland)Act1997. 4.4FloodPreventionSchemesunderthe1961Act AuthorisationisbeingsoughtforFloodPreventionSchemesundertheFlood PreventionAct1961forworkswhicharebeyondthescopeofWorksof Maintenance.SchemesarecurrentlyproposedontheCauldcottsBurnat Fettercairn,theBurnofBalmakellyatMarykirkandtheTarlandBurnat AboyneandTarland. WorksarescheduledtostartinJanuary2006atFettercairnandMarykirkata costof£90,000and£45,000respectively.Inbothcases,floodstorageareas willbeconstructedtoattenuateextremefloodflowsinvolvingcreatedwetland anddeliberatecontrolledfloodingandsubsequentcontrolleddrainageof arablefarmland. AStrategicEnvironmentalImpactAssessmenthasbeencommissionedfor areaswhicharetopographicallysuitedforuseasfloodstorageareasonthe TarlandBurnasapre-requisitefortheapplicationforschemeauthorisation.

17 TheFloodPrevention&LandDrainage(Scotland)Act1997 FifthBiennialReport-December2005 4.5 FloodPreventionWorksontheB974toFettercairnRoad atStrachan AberdeenshireCouncilproposetoraisetheroadlevelandinstallfloodrelief structuresunderneaththeroadtopreventfloodingcausedbyfailureofthe floodbanksalongsidetheRiverFeughatStrachan.Thisworkdoesnotqualify asaFloodPreventionSchemeunderthe1961Actbecausehousingisnot affectedwhenfloodingoccurs.Theworkswillthereforebefundedentirelyby theCouncil. 4.6 FloodPreventionWorksatBoddam,Peterhead TheproblemcausedbysurfacewatercomingofftheTrunkRoadatBoddam andfloodingdomesticpropertyremainsunresolveddespitethebesteffortsof AberdeenshireCouncil.TheCouncilhaveprovidedthepropertieswith demountablefloodguardstocoverdoorwayopeningsandairventsas temporaryfloodprotectionmeantime.Anagreementtosharethecostsof designingasolutionwiththeTrunkRoadAuthorityhasnowbeenreached. Furtherprogresswilldependuponthesuccessofotherwiseofanapplication totheScottishExecutiveforgrantassistanceforaFloodPreventionScheme underthe1961Act. 4.7 LiaisonwithNeighbouringAuthorities Theneedtoensurethatneighbouringauthoritiesareawareofsignificant developmentproposalsisrecognised.TheNorthEastScotlandFlood AppraisalGroupservestoallowdataandadvicetobeshared.Floodstudies, WorksofMaintenanceandFloodPreventionSchemesarebeingandwill continuetobejointlypromoted. 4.8 PublicAwareness 4.8.1 Increasedawarenessoffloodrecordsheldbydifferentagencieswould beofbenefit.TheNorthEastScotlandFloodAppraisalGroupwebsite andtheintegratedGISinformationsharingsystemwillgreatlyassist awarenessofandfacilitateaccesstofloodrecords.(Para3.2.1refers). 4.8.2 Thereisstillmuchtobedonetoensurethatmembersofthepublicare fullyawareofalltheissuesrelatingtofloodinganditscauses.

Astimegoesbyandmoredataiscollected,theseestimateswillbereviewed andwillbecomeincreasinglyreliable. 4.10 TheAberdeenshireFloodActionNetwork AberdeenshireCouncilwillencourageand supportothercommunitygroups whoareatriskoffloodingfromwatercoursestojointheFloodActionNetwork .

19 TheFloodPrevention&LandDrainage(Scotland)Act1997 FifthBiennialReport-December2005 5 Funding 5.1ThefundingallocatedtoFloodPreventioninAberdeenshireCouncil’s RevenueBudgethasallowedreasonableprogresstobemadeinthe inspectionandassessmentofwatercoursesandforsomeWorksof Maintenancetobecarriedout.ItisclearthattheneedforfurtherWorksof Maintenancewillbeidentifiedastheassessmentofwatercourses continues.Itisalsoclearthat,byitsverynature,maintenanceworkisin mostcasesrepetitive.Itisevidentthereforethatthecurrentlevelof fundingmustbeatleastmaintained,atleastforthenext5to10years. 5.2Thefinancialconsequencesofflooddamagehavetraditionallybeenmet bypropertyinsurance.TheAssociationofBritishInsurershavemadeit clearthattheywillnotcontinuetoprovideblanketcoveragainstflooding asamatterofcourse.Insurancepremiumscanbeexpectedtoincrease significantlyforflood-pronepropertyandmayinsomecasesberefused.It wouldappearthattheytakeintoaccountthedegreetowhichcouncilsare pro-activeinfloodpreventionwhenassessinginsurancerisk.Itistothe benefitofAberdeenshireresidentsthereforetomaintainareasonablelevel offundingforfloodprevention. 5.3Whereappropriate,AberdeenshireCouncilwillseektorecoverreasonable costsfrompartieswhohaveresponsibilityandwhoseinactivitymayhave requiredtheCounciltocarryoutworkstopreventfloodingofnon- agriculturalland.
